Higdon R. Johnson E. Pistritto K. Van Kempen D. Wellman ALSO PRESENT: C.M.T. Sheffield B. Taylor D. Kearns - Town Manager - Town Clerk - Co-ordinator of Council Services (I) ADOPTION OF IIIlIUTES Regular meeting of March 22, 1993. 8 (II) DBLBGA'l'IONS 1. Tom Band and Dave Jarrett, representatives of Bell Canada addressed Council with respect to the proposed local telephone rate increase for 1993. 2. Alex Robertson, 893 Modlin Road addressed Council with respect to his two requests for a Compliance Audit for Maurice S. Brenner and Douglas Dickerson. He stated that he has no personal animosity towards anyone on Council and is requesting this audit only for the purpose of clearing Council and showing that Council are not out to make money. He stated that an audit would not be that costly and requested the a vote of support for a Compliance Audit be carried. 3. Paul Johnston, representing Arcon Non-Profit Housing addressed Council with respect to the motion to table the development application he has submitted for an apartment complex next to the IGA Plaza. He requested that the by-law be lifted from the table and passed. He pointed out that the proposal is for 87 units, 7 storeys high and all commenting agencies as well as the Planning Departmen.t are in support. He stated that a building with less than lOO units does not warrant a traffic study but he did request that one be carried out and it concluded that there would not be an adverse impact on the traffic. He also stated that the Ministry of Natural Resources and the M.T.R.C.A. would be involved tn further reviews. 8 , 6/93 45 (II) DBLBGA'l'IONS 4. Fred Beer, Westney Road representing the National Wildlife Week Committee addressed Council with respect to activities his committee has planned for National Wildlife Week. He stated that the Committee decided to focus on children and that a poster contest is being carried out and that awards will be handed out on Saturday at the Pickering Town Centre. He also commented on his displeasure with the letter sent to The Ontario Cabinet by Councillor Wellman stating that the letter gave the impression that the comments expressed were those of Council. e (III) RESOLUTIONS Resolution #70193 Moved by Councillor Higdon Seconded by Councillor Van Kempen 8 WHEREAS, pursuant to the provisions of subsection 156(1) of the Municipal Elections Act, R.S.O. 1990, chapter M.53, Alexander M. Robertson, an elector in the Town of Pickering, having reasonable grounds for believing that Maurice S. Brenner, a registered candidate, has contravened Part II of the Act, has applied in the prescribed form to the Clerk of The Corporation of the Town of Pickering, being the municipality with whom Maurice S. Brenner was registered under section 139 of the Act, requesting that a compliance audit of the 1991 election campaign finances of that registered candidate be conducted; and WHEREAS the Council of The Corporation of the Town of Pickering has considered that application, and the grounds set out therein for believing that the registered candidate has contravened Part II of the Act, and has decided to appoint an auditor licensed under the Public Accountancy Act, R.S.O. 1990, chapter P.37, to conduct a compliance audit of the 1991 election campaign finances of that registered candidate; NOW THEREFORE BE IT RESOLVED THAT: The firm of Madgett, Roberts, Marlowe, Hurren and Partners, being an auditor licensed under the Public Accountancy Act, R.S.O. 1990, chapter P. 37, is hereby appointed to conduct a compliance audit of the 1991 election campaign finances of Maurice S. Brenner, registered candidate, in accordance with the provisions of the Municipal Elections Act, R.S.O. 1990, chapter M.53. CARRIED Recorded Vote: Yes: No: Councillors Higdon, Pistritto, Van Kempen and Wellman Councillors Brenner, Johnson and Mayor Arthurs Resolution #77193 Moved by Councillor Johnson Seconded by Councillor Brenner That Council petition the Ministry of Transportation for 1993 Subsidy Allocations as follows: 8 Capital Operating Conventional Transportation $ 596,064 $ 750,302 Specialized Services $ 69,600 $ 215,600 CARRIED 6/93 49 Resolution #78193 Moved by Councillor Johnson Seconded by Councillor Brenner 8 Whereas the Durham Regional Police Service will be hosting the 34th Annual International Police Hockey Tournament on March 2 and 3, 1994 in conjunction with the 20th Anniversary of the establishment of the Durham Regional Police Service and the Regional Municipality of Durham; and Whereas all money raised by this event will be donated to the Kids Safety Village of Durham Region; and Whereas a tournament of this nature will project a positive image of the Region of Durham and add to the local economy; Now Therefore the Council of the Corporation of the Town of Pickering hereby wholeheartedly endorses and supports the efforts of the Durham Regional Police Service in hosting the 34th Annual International Police Hockey Tournament in 1994. By-law Number 4200/93 e Being a by-law to amend By-law 2359/87 providing for the regulating of parking, standing and stopping on highways or parts of highways under the jurisdiction of the Corporation of the Town of Pickering and on private and municipal property. THIRD READING Councillor Johnson, seconded by Councillor Wellman, moved that the report of the Committee of the Whole on By-law Numbers 4190/93, 4191/93, 4192/93, 4.193/93, 4194/93, 4195/93, 4196/93, 4197/93, 4198/93, 4199/93 and 4200/93 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (V) OTHER BUSINESS 1. Councillor Van Kempen, seconded by Councillor Higdon proposed the following Notice of Motion to be considered on April 19, 1993: 8 WHEREAS Chief Stephen Stewart accepted a position with the City of York and has submitted his resignation as the Fire Chief of the Town of Pickering effective May 31, 1993; and WHEREAS prior to filling the vacancy in the office of Fire Chief, the Council should examine the administration of the Fire Department because it owes it to the taxpayers of the Town to be more efficient and cost-effective; and WHEREAS police and education services are offered effective on a Regional basis through the Board of Police Commissioners and the school boards; and WHEREAS the cost of fire services in the Town of Pickering is expected to increase from $165 per household in 1987 to $253 per household in 1997; and WHEREAS the Town is currently spending 5.3 dollars annually on fire services; million 48 NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby directs the Town Manager to examine the feasibility of: 1. amalgamating basis, and the fire services on a Regional (V) 8 2. 3. 4. 5. 6. 8 7. 8 6/93 52 OTHER BUSINESS - continued 2. amalgamating the fire services of the Town of Pickering and the Town of Aj ax (on the understanding that such an amalgamation is not permitted by the Municipal Act and special legislation would be required). and that the Town Manager report to Council findings before May 31,1993. on his Councillor Van Kempen commented on the letter sent to The Ontario Cabinet by Councillor Wellman. Councillor Van Kempen stated that as part of the Good Will Embassador program for the Town of Pickering he will be visiting Brazil. He stated that he received and accepted this invitation by Brazilian diplomats and will be going next week at his own expense. Councillor Van Kempen commented on the request of Mr. Johnson representing Arcon Non-Profit Housing with respect to having lifting the item from the table. Councillor Van Kempen requested that the item be lifted in one months time to give interested residents time to comment. Councillor Brenner requested information from Councillor Van Kempen with respect to the M.T.R.C.A. lands abutting the Brock West Landfill Site. Councillor Higdon stated that she has received calls from residents in the Lynn Heights Subdivision concerning construction traffic travelling through the subdivision due to the closing of Fairport Road. Councillor Wellman, seconded by proposed the following Notice considered on April 19, 1993: Councillor Brenner, of Motion to be WHEREAS the Council of The Corporation of the Town of Pickering from time to time appoints various persons, including members of the Council, to represent the Councilor the Corporation on certain boards, committees and other agencies; and WHEREAS it is desirable that such appointees faithfully represent the wishes of the Council and the Town in their participation on those boards, committees and other agencies; NOW THEREFORE BE IT RESOLVED THAT: l. This Resolution does not apply to Council appointees to the following boards, committees and agencies: (a) (b) (C) (d) Pickering Hydro-Electric Commission; Pickering Committee of Adjustment; Pickering Property Standards Committee; Pickering Local Architectural Conservation Advisory Committee; any board, committee or agency composed entirely of members of Council; or any board, committee or agency composed entirely of members of Council and employees of the Town. Prior to attending the first meeting (after his or her appointment) of the board, committee or agency to which he or she has been appointed by Council, each Council appointee shall meet with the Councilor a Committee of the Council to determine, (a) the policies, positions and interests of the Council and the Town respecting the purpose and function of the board, committee or agency, and (b) the terms of reference within which the Council expects its appointee to operate in his or her participation on the board, committee or agency. 3. Each Council appointee shall provide to the Town Clerk on a regular and timely basis, (a) copies of all draft and final reports issued by the board, committee or agency, and (b) copies of all minutes of meetings of the board, committee or agency, whether or not he or she attended the meetings, for circulation by the Town Clerk to the members of Council, the Town Manager and the directors of relevant Town departments. 4. Each Council appointee shall provide to the Town Clerk in every February, May, August and November during the term of his or her appointment, and on other occasions when requested to do so by the Council, (a) a full report on the activities board, committee or agency, of the (b) an assessment of the manner in which the policies, positions and interests of the Council and the Town respecting the purpose and function of the board, committee or agency have or have not been furthered by the activities of the board, committee or agency, and (c) an assessment of the appropriateness of the terms of reference within which the appointee has been required to operate in his or her participation on the board, committee or agency. 5. Councillor Wellman, seconded by proposed the following Notice considered on April 19,1993: Councillor Johnson, of Motion to be That By-law 4180/93 regarding the Arcon Non-Profit Housing application be lifted from the table on April 19, 1993. Councillor Wellman commented on his letter to The Ontario Cabinet stating that he was concerned with the direction this application was taking and that Council have not had the opportunity for over two years to speak with the Province. He stated that he is pleased that a meeting has been scheduled for Wednesday concerning this item. Councillor Johnson stated his support to the residents who live along Rosebank Road in the Altona Forest area who desire to upgrade their homes. Councillor Johnson commended the Mayors' Task Force Against the Dump for all the work they have done and continue to do in the community fighting the dump. He stated that over l,OOO people turned up at the organized rally sending a good message to the I.W.A. Councillor Johnson announced that the Bay Ridges Hockey Tournament raised $2,300 towards buying a bed at the Ajax/Pickering Hospital. Councillor Pistritto announced that the Italian Community are holding a Dinner/Dance on Saturday at the Complex. Mayor Arthurs commended the Task Force volunteers for the rally. 8 8 8 . - - "-, 6/93 55 (V) OTHER BUSINESS - continued l5. Mayor Arthurs stated that the Fire Chief should be invited to the Chambers prior to his leaving the Town for his new position with the City of York. l6. Mayor Arthurs announced that the Town of Pickering won the Big Brothers Town Challenge. (VI) CONFIRlIA'l'ION BY-LAW By-law Number 4201/93 Councillor Johnson, seconded by Councillor Wellman moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 5th day April, 1993 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed.
