Brenner E. Higdon R. Johnson - (Left E. Pistritto K. Van Kempen D. Wellman at 8 :45 p.m.) ALSO PRESENT: N.C. Marshall B. Taylor D. Kearns - Town Manager - Town Clerk - Co-ordinator of Council Services (IJ ADOPTION OF IfINUTES Regular meeting of February 15, 1993. 8 (II) DBLBGA'l'IONS The following persons addressed Council with respect Notice of Motion to regulate smoking in public places: to the l. Sandra Schmidt, Durham Region Health Unit stated that she was involved in the development of the Model By-law for the Region of Durham concerning the regulation of smoking in public places. The By-law states that 30% of the restaurant area be designated for smoking. A survey which was carried out in Peterborough showed that 10% of restaurant owners felt they had been adversely affected by the by-law and 65% wish the by-law to remain in affect. This by-law is self-enforcing as long as there is adequate signage and enough lead time for residents to be informed. Sandra Schmidt offered herself as a resource to Council if they so desired. 2. Bill Lewis, 909 Mountcastle Crescent stated that he fully supports all the recommendations in this by-law. He informed Council that 13,000 Canadians die a year due to tobacco products and he feels it is vital we do all we can to eliminate teen smoking. He asked Council to take up the challenge of prevention and to reverse the percentage of teens smoking in Pickering and Durham. . 8 4/93 30 (II) DBLBGA'l'IONS - continued 3. Gordon Potts, 844 Vicki Drive stated his opposition to this by-law. He stated that he has never seen anything so restrictive as this model by-law which takes away freedom from individuals which relatives, friends and acquaintances died for in the war. It is his feeling that the vehicle fumes are more dangerous to individuals than cigarette smoke. - The following persons addressed Council with respect to By-law 4l80/93 regarding the proposed apartment adjacent to the IGA Plaza: l. Paul Johnston, representing Benetor Investments stated that this by-law has been thoroughly reviewed by council and another Site Plan meeting was held on Thursday to address some of the concerns outlined. The area within the L-shape of the building has been designated as a play area for children. He stated Benetor's support of the draft by-law which has been prepared. 2. Tom Mohr, representing P.E.S.C.A. informed Council that he attended the Site Plan meeting with the understanding that he could have issues such as access and setback addressed but was told that these issues were settled. He asked Council why this application has gone through the Pickering process so quickly and requested that Planning be commissioned to find a better area for this development. He also requested that he be informed of a proposed high density development by the Pickering Harbour Company. He asked Council to take a leadership role not say their hands are tied. 8 (III) RESOLUTIONS Resolution #44193 - See ADDendiz #1 Moved by Councillor Van Kempen Seconded by Councillor Wellman To adopt the report February 22, 1993. of the Executive Committee Meeting of CARRIED Resolution #45193 Moved by Councillor Wellman Seconded by Councillor Brenner That the Council of the Town of Pickering petition the Ministry of Transportation for additional 1992 Subsidy Allocation as follows: Conventional Transit CAPITAL OPERATING 25,357 120,527 6,406 57,380 CARRIED 8 Handi-Trans 4/93 31 Resolution #46193 Moved by Councillor Brenner Seconded by Councillor Pistritto Whereas the Council of the Regional Municipality of Durham has endorsed a model by-law prepared by the Durham Region Health Department to regulate smoking in public places; and e Whereas this model by-law has been endorsed by the Council For A Tobacco-Free Durham Region and by individual ratepayers; and Whereas the Council of the Corporation of the Town of Pickering has established policies to restrict smoking in buildings under its jurisdiction; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby directs the Town Clerk to prepare a by-law, based on the model by-law prepared by the Durham Region Health Department, to regulate smoking in public places; and that this by-law be brought back to Council on or around May 1, 1993. CARRIED Recorded Vote: Yes: Councillors Brenner, Higdon, Wellman and Mayor Arthurs Councillor Johnson Pistritto, Van Kempen, Absent: 8 Resolution #47193 Moved by Councillor Pistritto Seconded by Councillor Brenner Whereas the Corporation of the Town of Pickering spends approximately 34 million dollars annually to operate the municipality; and Whereas the mill rate is based on the operating budget; and Whereas the operating budget is a reflection of the current and proposed programs of the municipality; and Whereas it would assist in more relevant public discussion if the operating budget was forecast over a longer period of time than just the current year; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby directs the Town Manager to report on the feasibility of implementing a five year operating budget forecast. CARRIED (IV) BY-LAWS Councillor Wellman, seconded by Councillor Johnson, leave to introduce by-laws of the Town of Pickering: moved for By-law Number 4175/93 Being a by-law to dedicate that part of Lot 10, Plan 282, Pickering, designated as Parts 4 and 5, Plan 40R-14601, as public highway (Oakburn Street; LD 27/92) By-law Number 4176/93 8 Being a by-law to dedicate that. part of Lot 33, Concession 1, Pickering, designated as Parts 6 and 7, Plan 40R-12948; Block 52, Plan 40M-1508, Pickering; and Block 63, Plan 40M-1700, Pickering, as public highway (Westcreek Drive). By-law Number 4177/93 Being a by-law to authorize the execution of a Transfer of Easement from Cougs Investments Ltd. to The Corporation of the Town of Pickering over those parts of Lots 20 and 21, Plan 818, Pickering, designated as Parts 1 and 2, Plan 40R-14572. By-law Number 4178/93 Being a by-law to amend By-law 2359/87 providing for the regulating of parking, standing and stopping on highways or parts of highways under the jurisdiction of the Corporation of the Town of Pickering and on private and municipal property. By-law Number 4179/93 Being a by-law to authorize the execution of a Licence Agreement for the period May 15, 1993 to May 14, 1996 between Ontario Hydro and The Corporation of the Town of Pickering respecting Part Lot 20, Range 3, B.F.C., Pickering for park purposes (Kinsmen Park Softball Fields). 8 By-law Number 4180/93 Being a By-law to amend Restricted Area (Zoning) By-law 2520, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham in Part of Lot 23, Range 3, being Part of Block Y, Plan M-16, in the Town of Pickering. Councillor Brenner introduced the following motion: Resolution #51193 Moved by Councillor Wellman Seconded by Councillor Brenner 8 That a motion be brought forward on April 5th, 1993 to review the Town Committee Appointments at the half term mark. CARRIED (V) 2. -- 3. 8 8 4/93 34 OTHER BUSINESS - continued Councillor Brenner stated that consideration had in the past been given to a compliance audit of three Town Councillors. This request was refused by Council and subsequently an appeal was launched to the Commission on Election Finances. Councillor Brenner stated his pleasure in reporting that this appeal was refused by the Commission. The following matters were regular meeting: considered prior to the a) Mayor Arthurs stated that he was pleased to see that the Ontario Municipal Board approved Bramalea Limited Zoning By-law Amendment Application A 82/92 and the Draft Plan of Subdivision l8T-9l0l9 (Res. 7, 8 and 9 "Pinegrove"). b) Resolution #52193 Moved by Councillor Wellman Seconded by Councillor Van Kempen That the request by Bramalea Limited to be issued building permits prior to the completion of base course asphalt for the internal roadways for its Res. 10 development be approved. CARRIED c) Mayor Arthurs offered to sit on the Firefighters Negotiating Committee. b) Resolution #53193 d) Moved by Councillor Van Kempen Seconded by Councillor Higdon That the proposals submitted by I.E.R. Planning, Research and Management Services dated February, 1993 for the completion of the Municipal Nuclear Response Plan, be adopted, in the amount of $l6,023.00 subject to $4,500.00 of JEPP funding being available through the Region of Durham. Pistritto offered the name of Frank Greenwood to be submitted to Durham a candidate for Governor of Durham (VI) CONFIRlfATION BY-LAW By-law Number 4181/93 Councillor Wellman, seconded by Councillor Van Kempen moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 1st day March, 1993 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. AMENDMENT TO BROCK INDUSTRIAL AREA DEVELOPMENT PLAN FILE NUMBER - B 1000 8 That the Amendment No. 14 to the Brock Industrial Area Development Plan to permit limited outdoor storage, in special circumstances, for all industrial development with the Brock Industrial Area, as outlined in Appendix No. I to Planning Report No. 1/93, be approved. 2.
