Q ~ COUNCIL MINUTES A Meeting of the Pickering Town Council was held on Monday, October 5, 1998 at 7:58 p.m. PRESENT: Mayor Wayne Arthurs COUNCILLORS: M. Brenner D. Dickerson R. Johnson M. Holland D. Kearns (I) (ll) 1. 2. - General Manager - Director of Planning - Executive Co-ordinator - Town Clerk - Committee Coordinator ADOPTION OF MINUTES Regular Meeting of September 22, 1998 Special Meeting of September 28, 1998 DELEGA TIONS John Fowle, representing Hospice Durham, addressed Council to thank them for their support and to request that October 12-18, 1998 be proclaimed as "Hospice Week". He thanked Council for their generous offer to fly the Hospice Banner and the Hospice Flag during the week of October 12-18, 1998. He also thanked them for their generous donation and for inviting them to share in the opening of the Princess Diana Park. Inspector Greg Mills, Durham Regional Police Services, addressed Council with respect to an update on the Community Policing project in Ajax and Pickering. He advised that there has been a proliferation of pawn shops across Durham. In the absence of a by-law within the municipalities dealing with these types of shops, the police have prepared and are requesting Councils to review and approve a by-law concerning pawn shops. He also advised that traffic problems are greater within Ajax/Pickering than anywhere else in Durham and that this will continue unless measures are taken to deal with this matter at all times rather than sporadically. A Traffic Watch Neighbourhood Program is proposed to deal with speeding within neighbourhoods. He requested Council's support for this comprehensive program. .. .. 119 3. The following persons addressed Council on the issue of agricultural easements: 8 8 (ill) a) Geraldine Hollinger, 2300 Rosebank Road, spoke against agricultural easements. If easements are put in place there will be no assurance for agriculture in the future. Easements should be voluntary and owners who choose them should be given a tax break. b) Sandy Rider, 494 Whitevale Road, requested Council to support and establish agricultural easements. Agricultural easements are a benefit to those attempting to acquire a mortgage. c) Bruce Flattery, advised that easements will guarantee that agricultural lands are used for agricultural purposes and will contribute to the stability of the community. He also stated that he is not in support of the rider which states that the ORC are requesting the authority to veto amendments to the easement document for a period of 40 years. d) Ian Attridge, 44 Don Mills Road, Don Mills, lawyer for the Green Door Alliance distributed information to Council regarding Agreement Values Over Time, and The Economic Benefits of Land Conservation. He stated his support and outlined the benefits of agricultural easements. e) Angie Jones, R. R. #5, Claremont, stated her support of the agricultural easements. Developers gain and residents lose if these easements are not put into place. She requested Councils unanimous support. f) Colin O'Handley, 2640 Altona Road, stated his support of the agricultural easements. He requested that Council preserve the agricultural lands. g) Norman Collier, 2825 Townline, Pickering stated his support of the easements. h) Tommy Thompson, 3181 Byron Street, Whitevale, stated that senior bankers consider easements an advantage. Mr. Thompson read out a letter from Mr. Gord Willson in support of the easements, requesting the protection of public land. i) Pat Home, R. R. #5, Claremont, representing Pickering Rural Association, stated that this is a golden opportunity to put a stop to development. If easements are effective in stopping urban sprawl, she fully supports them. She requested Councils support. j) Eleanor Nash, 2645 Altona Road, stated her support of easements. RESOLUTIONS Resolution #191/98 - Appendix #1 Moved by Councillor Brenner Seconded by Councillor Ryan 8 That the Report of the Executive Committee dated September 28, 1998 be adopted. CARRIED .. 8. 8 8. .' 120 Resolution #192/98 Moved by Councillor Pickles Seconded by Councillor Holland 1. That Report to Council IDT 06-98 be received and forwarded to the Region of Durham, the Ontario Realty Corporation and the Ontario Municipal Board, 2. That the Region of Durham and the Ontario Municipal Board, in considering Regional Official Plan Amendment 96-014/D, be advised that: (a) Town Council recommends as a mandatory condition, that agricultural easements held by the Town be established on all farmland sold in the area by the Ontario Realty Corporation and identified in the 1997 Pickering Official Plan as the Agricultural Preserve lying west of the West Duffin Creek. CARRIED Recorded Vote: Yes: Councillors Brenner, Dickerson, Holland, Johnson, Pickles, Ryan and Mayor Arthurs Council considered the following motion in conjunction with the above resolution: Resolution #192a/98 Moved by Councillor Dickerson Seconded by Councillor Ryan That #2( c) be amended by adding "and identified in the 1997 Pickering Official Plan as the Agricultural Preserve lying west of the West Duffin Creek". CARRIED Resolution #193/98 Moved by Councillor Dickerson Seconded by Councillor Holland 1. That Zoning By-law Amendment Application A 11/98, submitted by 672003 Ontario Ltd. on lands being Part of Lots 75, 76, 77, and 78, Plan 1051, Town of Pickering, to change the zoning on the subject lands from "R3" - Residential Detached Dwelling - Third Density Zone (minimum lot frontage of 18.0 metres), to an "S3- 7" - Residential Detached Dwelling Zone (minimum 12.0-metre lot frontages), in order to permit the development of eight lots with frontages of 13.5 metres on the east side ofFalconwood Way, be APPROVED. 2. That the request by 672003 Ontario Ltd. to permit the creation of the eight residential lots, proposed by Zoning By-law Amendment A 11/98, on Part of Lots 75, 76, 77, and 78, Plan 1051, through land severance applications to the Durham Land Division Committee, rather than by draft plan of subdivision, be APPROVED, subject to the following condition: 1. That the land severance applications reflect the lotting pattern identified on the applicant's plan submitted with Zoning By-law Amendment Application A 11198. CARRIED .' 8 8 8 121 Resolution #194/98 Moved by Councillor Dickerson Seconded by Councillor Brenner That Report L 102/98 regarding the Register of Municipally-Owned Lands be received. CARRIED Resolution #195/98 Moved by Councillor Ryan Seconded by Councillor Holland That Mayor Arthurs be authorized to make the following proclamations: "Hospice Awareness Week" - October 12 - 18, 1998 "National Space Day" - October 16, 1998 "Child Abuse Prevention Month" - October, 1998 CARRIED Resolution #196/98 Moved by Councillor Holland Seconded by Councillor Brenner That Mayor and Clerk are hereby authorized to execute a development agreement in a form satisfactory to the Town Solicitor between the Estate of V.E. Swan (or its successors) and the Corporation of the Town of Pickering, respecting the development of model homes on Part of Lot 28, Concession 2 being part of Draft Plan 18T-97006. CARRIED Resolution #197/98 Moved by Councillor Pickles Seconded by Councillor Brenner WHEREAS the Council of the Corporation of the Town of Pickering and its residents wish to be fully informed and consulted on all matters related to the Federal Airport Lands in the Town of Pickering including any proposals for development of an airport; and WHEREAS correspondence dated August 18, 1998 from Regional Chair Roger M. Anderson to Transport Canada regarding the Declaration of Pickering Lands as an Airport Site states: "In order to further demonstrate the Region's commitment towards facilitating the development of an airport, the Region is currently formulating an accord with the GT AA respecting the Pickering Lands (refer to Appendix No.6). The Accord will put in place an association between the Region of Durham and the GT AA and will outline the mechanisms and processes for changes regarding airport matters in the Region of Durham"; and WHEREAS the Toronto Star reported on September 16, 1998 that "a preliminary draft vision of airport services in Greater Toronto foresees a new Pickering resident airport up and running within 10 years"; and .' 8. 8 8 122 WHEREAS the Town of Pickering has not been directly informed or consulted on this matter; NOW THEREFORE the Council of the Corporation of the Town of Pickering affirms its desire and the moral obligation of other parties to contact, consult with and involve the residents and Town of Pickering in all matters pertaining to a proposed airport in the Town of Pickering; and THAT the GT AA President and Chief Executive Louis Turpen be requested to provide further information on the "draft vision", with respect to an airport in Pickering; and THAT the Clerk request through Freedom ofInformation from the Minister of Transport Canada, the Provincial Minister of Transportation, the Chair and Council of Durham Region, the Chair and Council of York Region, and the Mayor and Council of the Town of Markham and GT AA, any information they have regarding any initiatives for an airport in Pickering from 1994 and 1998; and THAT staff report on the GT AA/Regional airport process; and THAT the above letters be copied to Dan McTeague, M.P. and Janet Ecker, M.P.P. CARRIED Councillor Johnson declared an interest as he leases land from the Federal Government. Council considered the following motion in conjunction with the above resolution: Resolution #198/98 Moved by Councillor Ryan Seconded by Councillor Brenner That paragraph 32 of the substantive part of the Motion be amended to read: THAT the Clerk request through Freedom of Information from the Minister of Transport Canada, the Provincial Minister of Transportation, the Chair and Council of Durham Region, the Chair and Council of York Region, and the Mayor and Council of the Town of Markham and GT AA, any information they have regarding any initiatives for an airport in Pickering from 1994 and 1998. CARRIED (IV) BY-LAWS That Councillor Holland seconded by Councillor Brenner took leave to introduce by-laws of the Town of Pickering: By-law Number 5394/98 Being a by-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham in Part of Lot 28, Concession 2, in the Town of Pickering. (A 11/97, 18T -97006) By-law Number 5395/98 Being a by-law to dedicate that part of Lot II, Plan 505, Pickering, designated as Part I, Plan 40R-16I52; that part of Lot 12, Plan 505, Pickering designated as Part I, Plan 40R-15461 and that part of Lot 13, Plan 505, Pickering designated as Part 1, Plan 40R-15419, as public highway (Rosebank Road). .' 8. 8. 8 123 By-law Number 5396/98 Being a by-law to appoint By-law Enforcement Officers for certain purposes (Parking Regulation - 1995 Royal Road). THIRD READING: Councillor Holland seconded by Councillor Brenner moved that the report of the Committee of the Whole on By-law Numbers 5394/98, 5395/98 and 5396/98 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (V) OTHER BUSINESS 1. Councillor Holland requested that a Special Meeting be held next week to deal with a number of Notices of Motion. 2. Councillor Holland advised that he will be bringing forward a Notice of Motion concerning Stormwater Management and one concerning the Pickering Nuclear Generating Station. 3. Councillor Johnson requested a Leave to Introduce a Notice of Motion concerning an appointment to the Public Advisory Committee to the Regional Waste Management Committee. Resolution #199/98 Moved by Councillor Johnson Seconded by Councillor Ryan That David Steele be appointed to the Public Advisory Committee to the Regional Waste Management Committee. '. 124 (VI) CONFIRMATION BY-LAW By-law Number 5397/98 Councillor Brenner seconded by Councillor Johnson moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 5th day of October, 1998 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. TRANSPORTATION AND GO TRANSIT FUNDING ISSUES IN THE GT A FILE NUMBER - A 2510 That. the resolution from the Regional Municipality of Halton, passed on July 15, 1998 regarding Transportation and GO Transit Funding Issues in the GT A, is hereby endorsed by the Council of the Town of Pickering. 3.
