Brenner D. Farr R. Johnson E. Pistritto D. Ryan S. Senis ALSO PRESENT: C.M.T. Sheffield B. Taylor D. Kearns - Town Manager - Town Clerk - Co-ordinator of Council Services (n ADOPTION OF MINUTES Regular meeting of November 28, 1994. Inaugural Meeting of December 5, 1994. (II) ~ATION A presentation was made by Mayor Arthurs to Verna Heath and Tim Platt of 868 Vicki Drive for their beautiful Christmas Light Display. (llI) DELEGATIONS 1. Stephanie Piercey, 654 Weyburn Square addressed Council with respect to the Notice of Motion to hold a public forum to address concerns about the Nuclear Generating Station. She advised that she has no affiliation with any nuclear organization or political group. She feels that the officials of Pickering Hydro are downplaying the incident, that we were lucky this time but may not be so lucky next time. She urged CounciJ to support the Notice of Motion for a public forum. 199 Resolution #269/94 Moved by Councillor Brenner Seconded by Councillor Farr To hear the remaining delegations. CARRIED Recorded Vote: Yes: No: Councillor Brenner, Farr, Pistritto, Ryan and Senis Councillor Johnson and Mayor Arthurs 2. David Martin, representing Durham Nuclear Awareness commented on the recent accident at the Pickering Nuclear Generating Station and requested that Council support the motion for a public forum but that this forum not replace the request for a full environmental assessment. 3. Chai Kalevar, 159 Glenanna Road also commented on the recent accident at the Pickering Nuclear Generating Station, stating that Pickering has the oldest Nuclear Plant and that we have now experienced the first level of accidents, but something more serious will occur eventually. He stated his support for the formation of a Mayor's Task Force to address this issue. (IV) RESOLUTIONS Resolution #270/94 - See Aooendix #1 Moved by Councillor Johnson Seconded by Councillor Brenner That the Report of the Executive Committee dated December 12, 1994 be adopted. CARRIED Resolution #271/94 Moved by Councillor Brenner Seconded by Councillor Pistritto That Tender T-14-94 submitted by Novacor Construction Ltd. in the amount of $3,422, 135.35 be approved. CARRIED 200 Resolution #272/94 Moved by Councillor Brenner Seconded by Councillor Farr That the Council of the Regional Municipality of Durham is hereby advised that Councillor Pistritto is nominated to sit on the Metropolitan Toronto and Region Conservation Authority, Councillor Johnson is nominated to sit on the Central Lake Ontario Conservation Authority and lain McCully is nominated to sit on the Land Division Committee. CARRIED Resolution #273/94 Moved by Councillor Brenner Seconded by Councillor Ryan WHEREAS the Pickering Nuclear Generating Station is located within the Town of Pickering; and WHEREAS by Resolution #238/94, passed on October 3, 1994, the Council of the Corporation of the Town of Pickering supported the request for hearings to be held under the Federal Environmental Protection Act; and WHEREAS it has been reported that there has been in excess of 380 significant events at the Station within the past two years; and WHEREAS the operation of the Station is regulated under Federal jurisdiction; NOW THEREFORE the Council of the Corporation of the Town of Pickering in addition to an Environmental Assessment Hearing, hereby requests that a public forum or hearing be held in the Town of Pickering to address these and other concerns that the residents of Pickering may raise; and THAT such forum or hearing include the Chair of the Atomic Energy Control Board, Ontario Riding MP Dan McTeague, a representative of Ontario Hydro as well as representatives from the appropriate Federal and Provincial ministries. CARRIED Council considered the following Motion in conjunction with the above resolution: Resolution #274/94 Moved by Councillor Brenner Seconded by Councillor Ryan That the fifth paragraph be amended to add: "in addition to an Environmental Assessment Hearing". CARRIED Recorded Vote: Yes: Councillors Brenner, FaIT, Johnson, Pistritto, Ryan, Senis and Mayor Arthurs 201 Recorded Vote on Motion as Amended: Yes: Councillors Brenner, Farr, Johnson, Pistritto, Ryan, Senis and Mayor Arthurs Resolution #275/94 Moved by Councillor Ryan Seconded by Councillor Brenner WHEREAS the residents of Pickering have expressed grievous concern in regard to the ongoing traffic gridlóck and resultant negative impact on safety on residential streets; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby directs the Executive Director of Operations to initiate the process of hiring a traffic engineer on a contractual basis to develop a set of comprehensive recommendations, both short and long term, to facilitate the flow of traffic on arterial roads and alleviate the negative impacts of overflow on our community roads. CARRIED Recorded Vote on Motion as Amended: Yes: No: Councillors Brenner and Ryan Councillors Farr, Johnson, Pistritto, Senis and Mayor Arthurs Resolution #277/94 Moved by Councillor Johnson Seconded by Councillor Brenner That a Mayor's Task Force concerning Nuclear Awareness be struck to include three members of Council and three members of the public to be appointed by Council to include a business representative, a community representative and a public appointee and any resource persons as deemed appropriate and that the Terms of Reference include: Community Awareness, Education and liaison with Ontario Hydro and their representative. By-law Number 4539/94 Being a by-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham in Part of Lot 24, Concession 1, in the Town of Pickering. (A 15/94) By-law Number 4540/94 Being a by-law to authorize the execution of Release of a Site PlanlDevelopment Agreement between the Town and J.D.S. Investments Limited respecting Blocks 7, 8, 9 and 10, Plan 40M- 1231, Pickering. By-law Number 4541194 Being a by-law to dedicate those parts of Lot 12, Plan 282, designated as Parts 20 and 22, Plan 40R-11205 (Oakburn Street) as public highway (LDIO/94 and LD11/94). By-law Number 4543/94 Being a by-law to dedicate those parts of Lot 9, Plan 282, designated as Parts 18, 19, 20, 21, 22 and 23, Plan 40R-11206 (Waterford Gate, between Oakburn Street and Woodview Avenue) as public highway. By-law Number 4546/94 Being a by-law to dedicate those parts of Lot 33, Concession 1, Pickering, designated as Parts 4 and 5, Plan 40R-12948 (Westcreek Drive) as public highway. By-law Number 4547/94 Being a by-law to appoint persons to various agencies, boards and committees. THIRD READING: Councillor Brenner, seconded by Councillor Farr moved that the report of the Committee of the Whole on By-law Numbers 4536/94, 4539/94, 4540/94, 4541194, 4542/94, 4543/94, 4544/94, 4545/94, 4546/94 and 4547/94 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (VI) OTHER BUSINESS 1. Councillor Johnson handed to staff correspondence on a paper fibre recovery program which is being investigated by the Region of Durham. 2. Councillor Senis wished council, staff and residents all the best for the holiday season. 3. Councillor Pistritto also expressed best wishes to everyone for the holiday season. 4. The following matters were discussed prior to the regular meeting: a. The Town Manager advised that the O.M.B. Hearing for the Whitevale Heritage District has been set for March 7, 1995. b. The Town Manager commented on the package which Council received concerning the Fire Fighters Association. c. The Town Manager advised that the sales trailer has been removed and clean-up has commenced with respect to the Landford Part Lot Control By-law. d. The Town Manager distributed correspondence, received from the Director of Public Works, concerning Zoning By-law Application AIO/94-Wideman. He stated that the storm sewer construction will commence in 1996. e. The Town Manager advised that a stop sign will be installed at the corner of Franklin Street and Joseph Street, but that a sidewalk would not be practical at this time. 204 f. The Town Manager distributed correspondence from the Treasurer concerning the tax reduction and status of the licence fees for the Metro East Trade Centre. g. Councillor Johnson commented on the announcement made by the Ministry of the Environment concerning Jobs Ontario. (VID CONFIRMATION BY -LAW By-law Number 4548/94 Councillor Brenner seconded by Councillor Johnson moved for leave to introduce a By-law of the T own of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meetings held on the 19th day of December, 1994 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. ZONING BY-LAW AMENDMENT APPLICATION A 12/93 S. & D. BARKEY PART OF LOT 19, CONCESSION 9 (SOUTHWEST CORNER OF THE UXBRIDGEIPICKERING TOWNLINE AND HOXTON STREET - CLAREMONT) FILE NUMBER - Jl2310 - A 12/93 That Zoning By-law Amendment Application A12/93 submitted to the Town of Pickering by S. & D. Barkey on lands being Part of Lot 19, Concession 9 Town of Pickering, to permit an agricultural auction use be APPROVED subject to the following conditions: 1. (e) 2. That prior to the forwarding of an implementing zoning by-law to Town Council the owner provide basic site plans to the satisfaction of the Director of Planning which shall identify the following: (a) the structures and facilities on the subject property; (b) (c) the area of the property located below top of bank; that adequate on-site parking will be provided; (d) location and details of any required site servicing facilities such as private well and sewage disposal systems; details of any grading changes that may impact stormwater management. That the lands be zoned and developed in accordance with the standards and design guidelines of the Town Centre West Urban Design and Land Use Study, as illustrated on Attachment #2 to Recommendation Report No. 43/94; 2. That the implementing zoning by-law consolidate the zoning requirements of the entire subject lands, and incorporate adequate floor area, building height and parking provisions in relation to the proposed new uses in order to maintain the mixed use regional commercial character of the subject lands; ZONING BY-LAW AMENDMENT APPLICATION A 15/94 WALNUT GROVE PLAZA INC. PART OF LOT 24, CONCESSION 1 (SOUTH SIDE OF KINGSTON ROAD AT WALNUT LANE) FILE NUMBER - B 2310 - A 15/94 1. That Zoning By-law Amendment Application A 15/94, submitted by Victor N. Lind, Urban Land Consultant on behalf of Walnut Grove Plaza Inc., on lands being Part of Lot 24, Concession 1, to permit the continuation of three existing temporary uses and to add full retail and personal service uses as temporary uses on the subject site, be APPROVED for an additional three year period; continued 3 and that the implementing by-law prohibit body rub parlours as a permitted use in the definition of "personal services" uses. 5. LEGAL SERVICES DEPARTMENT 1995 SALE OF SERVICES REVENUE FILE NUMBER - D 3300 WHEREAS, pursuant to the provisions of the Municipal Act, RS.O. 1990, chapter M.45, section 162, the Council of the Corporation of the Town of Pickering has prepared and adopted estimates of all sums required during 1995 for the purposes of the municipality, setting forth therein estimated revenues, including revenues related to the preparation, processing, registration, monitoring and releasing of certain agreements and by-laws by the Legal Services Department as authorized by the Municipal Act, RS.O. 1990 chapter M.45, sections 191, 210.107, 308.3 and 308.4, and the Planning Act, RS.O. 1990, chapter P.13, section 69; NOW THEREFORE BE IT RESOLVED THAT: Resolution 56/93, item 6 is hereby rescinded as of December 31, 1994.
