Brenner E.Higdon R Johnson E. Pistritto K. Van Kempen D. Wellman ALSO PRESENT: C.M.T. Sheffield B. Taylor N. Carroll T. Melymuk - Town Manager - Town Clerk - Director of Planning - Deputy Director of Planning m RESOLUTIONS Resolution #62/94 Moved by Councillor Wellman Seconded by Councillor Van Kempen WHEREAS pursuant to Section 58 of the Municipal Act, RS.O. 1990, a special meeting of Council may be either open or closed as in the opinion of the Council, expressed by resolution in writing, the public interest requires; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby declares a Special meeting of Council to commence at or about 5:30 p.m. on Monday, April 18, 1994 to hear a report ftom the Town Manager. CARRIED .-- 8 8 8 47 (ID BY-LAWS That Councillor Higdon, seconded by Councillor Van Kempen, took leave to introduce by-laws of the Town of Pickering: By-law Number 4412/94 Being a by-law to amend By-law 4317/93 authorizing the execution of a preliminary Settlement Agreement among Pickering harbour Company (Limited), Frenchman's Bay Harbour & Marine Service Company Limited, The Corporation of the Town of Pickering and Her Majesty The Queen in Right of the Province of Ontario, respecting Supreme Court of Ontario Action Number 860182 [L917501]. LOST The following motions were considered in conjunction with the above by-law: Resolution #63/94 Moved by Councillor Johnson Seconded by Councillor Pistritto That By-law Number 4412/94 be deferred for 30 days to allow staff to mediate a settlement between the Pickering Harbour Company and its three tenants. LOST Resolution #64194 Moved by Councillor Van Kempen Seconded by Councillor Higdon That the following conditions be added to Schedule A of By-law 4412/94: 1. That the tenants of the Pickering Harbour Company be offered a five year lease. CARRIED 2. That the agreement with the Pickering Harbour Company has the support of the M.T.R.C.A. and the Waterfront Trust. LOST 3. That a boat launch facility be incorporated into the marina development plan. LOST 4. That the public and present tenants of the Pickering Harbour Company have input into future development plans adjacent to the Bay. CARRIED 8 8 8 48 Resolution #65/94 Moved by Councillor Wellman Seconded by Councillor Higdon That By-law Number 4412/94 be reconsidered. CARRIED Resolution #66194 Moved by Councillor Wellman Seconded by Councillor Higdon That By-law Number 4412/94, as amended by directing staff to initiate a mediation process between the Pickering Harbour Company and its tenants, be read a first, second and third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED Recorded Vote: Yes: No: Cou~cillors Brenner, Higdon, Van Kempen, Wellman and Mayor Arthurs Councillors Johnson and Pistritto The following motions were considered in conjunction with the above: Resolution #67194 Moved by Councillor Johnson Seconded by Councillor Pistritto That By-law 4412/94 be deferred for two weeks to allow staff to determine if the Pickering Harbour Company is interested in a settlement with its tenants. LOST Resolution #68194 Moved by Councillor Johnson Seconded by Councillor Brenner That Schedule A to By-law 4412/94 be amended to direct staff to initiate a mediation process between the Pickering Harbour Company and its tenants. CARRIED Recorded Vote: Yes: Councillors Brenner, Johnson, Pistritto, Van Kempen, Wellman and Mayor Arthurs No: Councillor Higdon 8 8 8 49 Resolution #69/94 Moved by Councillor Johnson Seconded by Councillor Pistritto That By-law Number 4414/94 being a by-law to authorize the acquisition of Part Lot 18, Concession 8, Pickering [Lot 22, Plan 43, Pickering (Claremont)] for parkland purposes (Claremont Community Park), at a cost not to exceed $165,000, be read a first, second and third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED Recorded Vote: Yes: Councillors Brenner, Higdon, Johnson, Pistritto, Van Kempen, Wellman and Mayor Arthurs The following motion was considered in conjunction with By-law 4414/94: Resolution #70/94 Moved by Councillor Wellman Seconded by Councillor Higdon That the Offer to Purchase attached to By-law Number 4414/94 be amended to provide fora purchase price of the subject property of$160,000.
