HomeMy WebLinkAboutDecember 22, 1995 (Special) SPECIAL COUNCIL MEETING 0 A Special Meeting of the Pickering Town Council was held on Friday, December 22, 1995 at 5:00 p.m. PRESENT: Mayor Wayne Arthurs COUNCILLORS: M. Brenner R. Johnson E. Pistritto D. Ryan S. Senis ALSO PRESENT: C.M.T. Sheffield - Town Manager is T.J. Quinn - Executive Director of Operations B. Taylor - Town Clerk This Special Meeting of Council was called by Mayor Arthurs pursuant to Section 3 of By-law 3665/91 (Procedural By-law) to consider By-laws 4712/95 to 4717/95 that were originally scheduled to be considered on December 18, 1995. Councillor Johnson rose on a point of personal privilege to state that he objects to the holding of this meeting because the date of the meeting is so close to Christmas and the meeting is being held at the end of the work day. (I) DELEGATIONS Eric Barclay, 946 Reytan Boulevard, stated that he first heard about the proposed adult entertainment parlour at the former Sir Lancelots Restaurant two days ago. He objects to such a use and noted that his house is only 500 feet from this establishment. He stated that By-law 4717/95 to prohibit adult entertainment parlours in certain areas of the Town should have been circulated so that residents would have known about this meeting. 205 (1) DELEGATIONS - continued 2. Dick Comeau, representing the Royal Canadian Legion, stated that the Legion agrees with the passing of By-law 4717/95 to regulate the location of adult entertainment parlours. The Legion does not condone an adult entertainment parlour that is on a road that is widely traveled and can be viewed by the public and he noted that such an establishment will draw more traffic and is dangerous. 3. Scotty Ramage, representing the Royal Canadian Legion, stated that the Legion contributes much money to various Town groups an should be heard that they do not want an adult entertainment parlour to be located at the former Sir Lancelots Restaurant. 4. Wendy Robinson, 919 Krosno Boulevard, stated that she has young children and moved to the area because she thought is was safe. An adult entertainment parlour located at the former Sir Lancelots Restaurant will bring more traffic into the area along with problems with drinking and drugs. 5. Len Anderson, 824 Miriam Road, stated that he has lived in Bay Ridges since 1968 and objects to an adult entertainment parlour in an area that is near families. Such a facility will not benefit anyone and he stated that he supports the enactment of By-law 4717/95 to prohibit adult entertainment parlours in the Bay Ridges area. 6. Alex Brender stated that he has lived in Bay Ridges since 1961 and lives very close to the proposed adult entertainment parlour to be located at the former Sir Lancelots Restaurant. He opposes the establishment of such a use at that location. 7. Mary Thacken-Cary, 580 Eyer Drive, Unit 108, stated that exotic dancing leads to AIDS, family breakup, drug abuse, etc. She stated that she objects to an adult entertainment parlour being located that the former Sir Lancelots Restaurant. • 8. Lee Becker, 928 Krosno Boulevard, urged Council to oppose an adult entertainment parlour at the former Sir Lancelots Restaurant. He noted that he experienced problems when Rumours was located across the street from his property. An adult entertainment parlour will lower property values, lead to drug abuse and make a neighbourhood dangerous. 9. Tim Capp stated that he has lived in the Bay Ridges area for 27 years. When he drove a taxicab, he was disgusted with the clientele that patronized the adult entertainment parlour on Dillingham Road. 10. Cecilia McCoy, 903 Krosno Boulevard, stated that she does not want to see the residential area deteriorate because of an adult entertainment parlour. She noted that Pickering Playing Fields, which is a family facility, is across the street from the proposed adult entertainment parlour to be located at the former Sir Lancelots Restaurant. She felt that the present adult entertainment parlours such as the Palace, Centerfields and Cecile's should be closed. 11. Ed Plitz, 1523 Bayly Street, stated that he objects to an adult entertainment parlour being located in the former Sir Lancelots Restaurant. 12. Karen Balsdon stated that she works hard in the community and does not want to see an adult entertainment parlour located near a residential subdivision. 13. Peter Lazarou representing the owner of the proposed adult entertainment parlour, stated that he has raised money for the Legion and other charities. Although area residents do not want an adult entertainment parlour in the area, they see many explicit activities on television and other forms of the media. Much money has been spent on renovating the former Sir Lancelots Restaurant. 206 (11) DELEGATIONS 14. A representative of the Royal Canadian Legion asked who John Lazarou is and when he gave money to the Legion. 15. John Lazarou stated that he has been in the adult entertainment business in Pickering before and noted that he does not allow lap dancing in his establishments. He checked with the staff of the Town and determined that there was no zoning or other regulatory by-law that prohibits an adult entertainment parlour. He stated that he tried to get a lawyer to represent him at this meeting, however, none could accommodate him because of the closeness of the date to Christmas. In answer to a question from a Member of Council, he stated that he would not open on Thursday, December 28, 1995 or until an Interim Control By- law was passed. 16. Bruce Edwards, representing the Royal Canadian Legion, stated that he would not move to Pickering if an adult entertainment parlour was allowed in such a public area as the former Sir Lancelots Restaurant. (U) BY-LAWS That Councillor Ryan, Seconded by Councillor Brenner, took leave to introduce by-laws of the Town of Pickering: By-law Number 4712/95 Being a by-law to dedicate Block 75, Plan 40M-1811, Pickering as public highway (Dixie Road). 0 By-law Number 4713/95 Being a by-law to dedicate Blocks 172, 173 and 184, Plan 40M-1810, Pickering as public highway (Rosebank Road). By-law Number 4714/95 Being a by-law to appoint By-law Enforcement Officers for certain purposes (Parking Regulation - 1890/80 Valley Farm Road). By-law Number 4715/95 Being a by-law to authorize the execution of a Transfer of Easement over part of Lot 20, Plan 819 and part of Lot 62, Plan 1041, Pickering (designated as Part ^ Plan 40R- ), for storm sewer purposes. By-law Number 4716/95 Being a by-law to amend By-law 4582/95 to delete the "(H)" Holding Symbol land related text therefrom. By-law Number 4717/95 Being a by-law to define areas within the Town of Pickering in which adult entertainment parlours may or may not be located. 207 Council considered the following resolutions with respect to By-law 4717/95: Resolution #264/95 Moved by Councillor Brenner Seconded by Councillor Ryan That By-law 4717/95 be amended to prohibit an adult entertainment parlour within 400 feet of any community facility. 0 CARRIED Resolution #265/95 Moved by Councillor Brenner Seconded by Councillor Ryan That By-law 4717/95 be amended to provide a restriction that in the permitted area, no owner or operator of an adult entertainment parlour allow touching. LOST Recorded Vote: Yes: Councillor Brenner No: Councillors Johnson, Pistritto, Ryan, Senis and Mayor Arthurs THIRD READING: • Councillor Ryan, seconded by Councillor Brenner, moved that the report of the Committee of the Whole on By-law Number 4712/95, 4713/95, 4714/95, 4715/95, 4716/95 and 4717/95 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. (IM CONFIRMATION BY-LAW By-law Number 4718/95 Councillor Brenner, seconded by Councillor Johnson, moved for leave to introduce a By- law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 22nd day of December 1995 and that the same be now finally passed and that mayor and Clerk sign the same and that the Seal of the Corporation be affixed thereto.
