SPECIAL COUNCIL MEETING
A Special Meeting of the Pickering Town Council was held on Monday, October 16, 1995
at 8:22 p.m.

Resolution #221/95
Moved by Councillor Pistritto
Seconded by Councillor Ryan
That pursuant to Section 55(7) of the Municipal Act, R.S.O. 1990, c M.45, as amended,
the Council of the Corporation of the Town of Pickering hereby resolves to conduct a
meeting closed to the public for the purpose of considering a matter of litigation.

WHEREAS the Council of the Corporation of the Town of Pickering wishes to effect the
closure of the Brock West Landfill Site; and
WHEREAS Council is prepared to negotiate the settlement of the current litigation in the
46 interest of closing the Brock West Landfill Site;
NOW THEREFORE the Council of the Corporation of the Town of Pickering is hereby
prepared to continue negotiations with Metropolitan Toronto towards closure of the
Brock West Landfill Site based on the following elements:
a timely closure of the Brock West Landfill Site as an active landfill site;
2. financial compensation to the Town of Pickering;
3. full protection of the health and safety of the residents of the Town of Pickering
during the closure and remediation activities at the Brock West Landfill Site; and
THAT these elements be negotiated on the basis of the October 13, 1995 correspondence
from the Deputy Commissioner of Works of Metropolitan Toronto to Mr. C.M. Timothy
Sheffield entitled "Principles of Agreement".

closure of the Brock West Landfill Site; and
WHEREAS Council is prepared to negotiate the settlement of the current litigation in the
interest of closing the Brock West Landfill Site;
NOW THEREFORE the Council of the Corporation of the Town of Pickering is hereby
prepared to continue negotiations with Metropolitan Toronto towards closure of the
Brock West Landfill Site based on the following elements:
a timely closure of the Brock West Landfill Site as an active landfill site;
2. a relocation of waste from the Brock North Landfill Site to the Brock West
Landfill Site;
3. both the closure and effective remediation of both the Brock North and Brock
West Landfill Sites;
4. financial compensation to the Town of Pickering;
5. full protection of the health and safety of the residents of the Town of Pickering
during the closure and remediation activities at the Brock North and Brock West
Landfill Sites; and

Councillor Johnson seconded by Councillor Senis moved for leave to introduce a By-law
of the Town of Pickering to confirm those proceedings of the Council of the Corporation
of the Town of Pickering at its meetings held on the 16th day of October, 1995 and that
the same be now finally passed and that the Mayor and Clerk sign the same and that the
Seal of the Corporation be thereto affixed.
