A Meeting of the Pickering Town Council was held on Monday, March 6, 1995 at 7:30 P.M.

(I) ADOPTION OF MINUTES
Regular meeting of February 20, 1995.
(ID DELEGATIONS
1. The following residents addressed Council with respect to the application for a
draft plan of subdivision by Garthwood Homes Limited in the Rosebank
Community:
a) Don Goundry, 482 Rougemount Drive stated that this is an isolated,
residential community with 50' and 100' lots. There is only one access and
one school. The residents are not opposed to Garthwood's original plan
and have been assured time and time again that downsizing would not
occur without the residents approval. The residents are not in favour and
hope that Council will continue to support their stand.

(M DELEGATIONS
b) Don Parker, 534 Oakwood Drive stated that he sold the back of his
property to Garthwood under the assumption that the lots being developed
would be 50'. He is not afraid of development but would like the
neighbourhood to remain the same.
c) Tim Politis, representing Garthwood Homes Limited advised that this is a
local developer who does not feel that this application is unreasonable.
There are 13.5 metre lots proposed, four lots on Oakwood Drive conform
with the current zoning by-law and this proposal falls within the Official
Plan allowable limits. Overcrowding at schools seems to be a concern, yet
when the school board was circulated they did not see a problem. There is
a traffic problem in the area which needs to be addressed separately, this
rezoning would not have an impact on situation.

WHEREAS the Ministry of Transportation proposes to widen Highway 401 through Pickering;
and
WHEREAS Ministry of Transportation policies for Bicycles, and for Transit-Supportive Land
Use Planning Guidelines requires integration, facilitation and co-ordination of pedestrian, cycling
and transit methods of movement, particularly for transportation transfer nodes and major activity
nodes; and

WHEREAS the Town of Pickering Official Plan designates a pedestrian and bicycle bridge
between the GO Station and the downtown core containing the Pickering Town Centre Mall and
transportation terminal; and
WHEREAS the importance of providing such a pedestrian and cycling bridge has been reaffirmed
through recent Provincial, Regional and local work including: two on-going Ministry of
Transportation Studies for the Greater Toronto Area; the proposed Provincial Urban Form policy;
the GO Transit Gateway Study; the Urban Transportation Briefing prepared by the
Transportation Association of Canada; the Durham Regional Official Plan; the on-going Region
of Durham Transportation System Review; the Town's Pickering District Plan Review; and the
Town's Trail and Bikeway Study; and
WHEREAS the Ministry of Transportation has been advised of the Town's interest in a
pedestrian and bicycle bridge over the Highway 401; and
WHEREAS the Ministry of Transportation continues to proceed with the widening without
accommodating the pedestrian and bicycle bridge contrary to Provincial, Regional and local
policy;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Town of
Pickering requests that the Province of Ontario amend the plans for the Highway 401 widening
between Liverpool Road and Glenanna Road, to design for and construct a pedestrian and bicycle
bridge between the Pickering GO Station and the downtown core; and
FURTHER, that this resolution and Planning Report No. 5/95 be forwarded to the Hon. Bob Rae,
Premier of Ontario; the Hon. M. Farnan, Minister of Transportation; J. Wiseman, M.P.P. Durham
West; the Hon. Lyn McLeod, leader of the Provincial Liberal Party; the Hon. Mike Harris, the
leader of the Provincial Progressive Conservative Party; R. C. Ducharme, the Managing Director
GO Transit, G. Herrema, the Chairman for Durham Region; A. Georgieff, the Commissioner of
Planning for the Region of Durham; and V. Silgailis, the Commissioner of Works for the Region
of Durham.

WHEREAS the United Nations has proclaimed March 21, 1995 as the "International Day for the
Elimination of Racial Discrimination"; and
WHEREAS racial discrimination is a disease that if allowed to spread robs society of its economic
• and social fabric; and
WHEREAS the fight against racial discrimination cannot be won without the partnership of all
levels of government, business and the communities we represent;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby proclaims
March 21, 1995 as the "International Day for the Elimination of Racial Discrimination" in the
Town of Pickering; and
THAT copies of this proclamation be forwarded to the Regional Clerk, all area municipalities in
the Region of Durham, to the principals of all Pickering schools and to the Director of both
School Boards, with a request to encourage special acknowledgment on that date.

WHEREAS, on October 18, 1994, The Corporation of the Town of Pickering, as Plaintiff,
commenced an action in the Ontario Court (General Division) (Court File No. 94-CU-804851
against The Corporation of the Municipality of Metropolitan Toronto and Her Majesty the Queen
in Right of Ontario, as Defendants, respecting the operation of the Brock West Landfill Site; and
WHEREAS the Court, on its own initiative, referred this action to Alternate Dispute Resolution
for the purpose of exploring the possibility of settling the litigants' differences; and
WHEREAS, following an Alternate Dispute Resolution session held on February 15, 1995, the
Corporation of the Municipality of Metropolitan Toronto proposed, by letter dated February 16,
1995, a framework for settlement on a without prejudice or precedent basis; and
WHEREAS the terms and conditions of the framework for settlement proposed by The
Corporation of the Municipality of Metropolitan Toronto are unsatisfactory to the Council of The
Corporation of the Town of Pickering;

NOW THEREFORE BE IT RESOLVED THAT:
1. The Council of the Corporation of the Town of Pickering hereby authorizes and
directs its solicitors, Osler, Hoskin & Harcourt, to advise the Corporation of the
Municipality of Metropolitan Toronto and Her Majesty the Queen in Right of
Ontario that the terms and conditions of the framework for settlement proposed by
. the Corporation of the Municipality of Metropolitan Toronto in its letter dated
February 16, 1995 are unsatisfactory to the Council of The Corporation of the
Town of Pickering.

WHEREAS it is difficult for the physically challenged to travel along Highway #2 due to the road
conditions and limited sidewalks;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby directs the
• Director of Public Works to work in conjunction with the Commissioner of Works for the
Regional Municipality of Durham to review and prepare a feasibility study for wheelchair
accessibility along Highway #2 with regards to sidewalks and road conditions and to ascertain if
Provincial funding is available for such a study and/or work.

THAT this amount be charged to Account 2195 (Grants to Organizations and Individuals).

PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed
thereto.

(y) OTHER BUSINESS
1. Councillor Ryan requested a status report on his recent request for information
concerning the use of the 911 Emergency Number.
2. Councillor Ryan commented on his concern over an article which appeared in the
weekend paper. He requested that the Director of Planning explore our Zoning
By-laws and application process.
3. Councillor Johnson advised that the Claremont Winter Carnival was a great
success.
91 4. The following matters were discussed prior to the regular meeting:
'` a. The Town Manager distributed copies of a resolution concerning the Brock
West Landfill Site.
b. Councillor Johnson thanked Councillor Farr for the change in time in By-law
4575/95.

(V) OTHER BUSINESS
C. Councillor Johnson commented on the Good Roads Conference, the
M.E.A. Conference and the Economic Development Conference which he
recently attended.
d. Councillor Johnson commented on the one-time grant request for the Brad
Shearer Benefit Night.
e. Councillor Johnson commented on a request from M.E.T.C.
f. Councillor Farr commented on a seminar he recently attended which was
held by the Ministry of Municipal Affairs.

Councillor Ryan seconded by Councillor Farr moved for leave to introduce a By-law of the Town
of Pickering to confirm those proceedings of the Council of the Corporation of the Town of
Pickering at its meetings held on the 6th day of March, 1995 and that the same be now finally
passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be
thereto affixed.

That the Executive Committee of the Town of Pickering having met on February 27, 1995,
presents its fourth report to Council and recommends:
1. PICKERING DOWNTOWN CORE:
• A DESIGN AND LAND USE STUDY
DRAFT TERMS OF REFERENCE AND
PROPOSED STUDY PROCESS

That Council receive for information Planning Report 3/95, outlining preliminary
draft Terms of Reference for a proposed Pickering Downtown Land Use and
Design Study, and identifying that staff will:
(a) release the draft Terms of Reference to the public, landowners and

for Council's consideration;
(b) meet with key area landowners to discuss possible funding partnerships;
and
(c) obtain "Expressions of Interest" from qualified consultant firms interested
in undertaking the Downtown Land Use and Design Study.
