Brenner D. Dickerson M. Holland R. Johnson D. Pickles D. Ryan ALSO PRESENT: T. Quinn B. Taylor D. Kearns - General Manager - Town Clerk - Co-ordinator of Council Services (I) ADOPTION OF M~ Regular Meeting of December 15, 1997 (II) RESOLUTIONS Resolution #465/97 Moved by Councillor Dickerson Seconded by Councillor Ryan That the General Manager's Report GM 07-97 advising that there were no Tenders approved by the General Manager during the 1997 Election period (i.e. fÌ'om October 15, 1997 to December 5, 1997) be received. CARRIED Resolution #466/97 Moved by Councillor Dickerson Seconded by Councillor Brenner That Resolution Number 187/93 be repealed; and That Treasurer's Report TR 24/97 be received; and 8 8 8 149 That the Director of Finance be authorized and directed to undertake any and all activities, including the execution and signing of agreements and contracts, necessary to undertake, safeguard and ensure the financial affairs and banking of the Town, including, but not limited to, those items and activities indicated in Attachment 2, Section (a) to Treasurer's Report TR 24/97; and That the Mayor, Director of Finance, Treasurer, Deputy Treasurer and Manager of Accounting be named Signing Officers for the purposes of conducting the financial affairs and banking of the Town of Pickering and that any two of them be authorized to undertake the activities outlined in Attachment 2, Section (b) and anyone of them be authorized to undertake the activities outlined in Attachment 2, Section (c) to Treasurer's Report TR 24/97; and That the appropriate official of the Town of Pickering be authorized to give effect thereto. CARRIED Resolution #467/97 Moved by Councillor Ryan Seconded by Councillor Dickerson That Mayor Arthurs be authorized to make the following proclamation: "KIDNEY MONTH" - MARCH, 1998 CARRIED Resolution #468/97 Moved by Councillor Brenner Seconded by Councillor Ryan That Legal Services Report L 197/97 regarding the closing and sale of a part of Rosebank Road be receiyed; and That the Town Solicitor be authorized to commence the road closing process as set out in Legal Services Report L 197/97 and obtain an appraisal of the value of the subject lands. CARRIED Resolution #469/97 Moved by Councillor Brenner Seconded by Councillor Holland That pursuant to Section 13 of the Terms and Conditions and Section 8 of the Information to Bidders pertaining to RFP 7-97, none of the proposals submitted under RFP 7-97 for an Automated Fare Collection System be accepted. CARRIED 150 ... Resolution #470/97 Moved by Councillor Dickerson Seconded by Councillor Pickles That an interim levy be adopted for 1998, not exceeding that permitted under existing legislation, being a levy on the whole of the assessment according to the last revised assessment roll, a sum not exceeding 50 percent, as described in the Fair Municipal Finance Act, 1997 (Bill 106 and No. 2 Bill 149), and the dates be set as February 24 and April 27, 1998; and 8 That the final levy due dates, subject to change, be set at June 25 and September 25, 1998; and That the penalty for non-payment of current year taxes be increased from 12.0 per cent per annum to 15.0 per cent per annum, commencing March 1, 1998; and That the interest on tax arrears be increased fÌ'om 12.0 per cent per annum to 15.0 per cent per annum, commencing March 1, 1998; and That the appropriate officials of the Town of Pickering be authorized to give effect thereto. CARRIED Resolution #471/97 Moved by Councillor Brenner Seconded by Councillor Holland That the mileage allowance for Councillors be increased fÌ'om $200 per month or $2,400 per annum to $300 per month or $3,600 per annum effective January 1, 1998. . CARRIED Recorded Vote: Yes: No: Councillors Brenner, Dickerson, Holland, Johnson, Pickles, and Mayor Arthurs Councillor Ryan Resolution #472/97 Moyed by Councillor Holland Seconded by Councillor Dickerson For a Leave to Introduce a motion regarding Provincial funding. CARRIED Resolution #473/97 8 Moved by Councillor Holland Seconded by Councillor Brenner WHEREAS the Council of the Corporation of the Town of Pickering has not increased the mill rate for Town purposes for the past four years; and WHEREAS Council has made eyery effort and continues to make every effort to provide an efficient and effective local government for its residents; and 151 WHEREAS the Province of Ontario, through the Minister of Finance, is intending to proceed with the realignment of Provincial and Municipal financial responsibilities; and WHEREAS the Premier of the Province of Ontario clearly stated that this realignment was to be revenue-neutral across the Province; and 8 WHEREAS in a question placed on the ballot of the November 10, 1997 municipal election, the residents of the Town of Pickering responded with a majority of 82.44% of the voters that the costs of welfare, social services and social housing should not be downloaded by the Province and paid by the taxpayer through municipal property taxes and shared (pooled) across the entire GT A; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby expresses its strenuous objection to the proposal received fÌ'om the Minister of Finance which provides a substantial loss of revenue for the Town of Pickering resulting fÌ'om the downloading fÌ'om the Province; and FURTHER that the Corporation of the Town of Pickering expresses its desire to meet with the Minister of Finance or his designate to discuss the funds withheld fÌ'om the Town as announced; and THAT the Town be allowed to state its business case for accessing those funds; and THAT this resolution be forwarded to: 1. The Honourable Mike Harris, Premier of Ontario 2. The Honourable Ernie Eves, Minister of Finance 3. The Honourable Janet Ecker, MPP Durham West 4. All Mayors and Chairs within the GT A . CARRIED Recorded Vote: Yes: Councillors Brenner, Dickerson, Holland, Johnson, Pickles, Ryan and Mayor Arthurs Council considered the following motions in conjunction with the above resolution: Resolution #473/97(a) Moved by Councillor Dickerson Seconded by Councillor Holland That the above resolution be amended by adding: FURTHER that the Corporation of the Town of Pickering expresses its desire to meet with the Minister of Finance or his designate to discuss the funds withheld fÌ'om the Town as announced; and THAT the Town be allowed to state its business case for accessing those funds; and 8 CARRIED J . 152 (III) BY-LAWS That Councillor Johnson seconded by Councillor Brenner took leave to introduce by-laws of the Town of Pickering: By-law Number 5179/97 Being a by-law to appoint persons to various agencies, boards and committees. - By-law Number 5180/97 Being a by-law to dedicate that part of Block M, Plan M-1O57, Pickering, designated as Part 3, Plan 40R-17968, as public highway (Eastbank Road). By-law Number 5181/97 Being a by-law to provide for the addition of interest to tax arrears. By-law Number 5182/97 Being a by-law to provide for the imposition of a penalty for non-payment of taxes. By-law Number 5183/97 Being a by-law to establish Instalment Due Dates for the 1998 Interim and Final Levy. THIRD READING: . Councillor Johnson seconded by Councillor Holland moved that the report of the Committee of the Whole on By-law Numbers 5179/97 to 5183/97 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. (IV) OTHER BUS~ 1. The following matters were discussed prior to the regular meeting: a) The General Manager advised that a firefighter has been charged after entering an intersection and hitting a car. The driver of the other vehicle has also been charged. b) The General Manager advised that the United Way goal has been reached. c) The General Manager distributed a report concerning Rosebank Road. d) The Director of Finance gave an overview of his reports concerning banking authorities and Interim Tax Levy. (V) CONFIRMATION BY-LAW CARRIED By-law Number 5184/97 8 Councillor Dickerson seconded by Councillor Johnson moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 22nd day of December, 1997 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. e - 8 Dated (VI) A~MENT The Meeting adjourned at 9: 12 p.m. 153 ~ CZ~~ MAYOR ÁL .
