Kearns en (II) 1. 2. 3. - General Manager - Town Clerk - Director of Planning - Deputy Director of Planning - Co-ordinator of Council Services ADOPTION OF MINUTES Regular Meeting of June 2, 1997 Special Meeting of May 26, 1997 DELEGA TIONS Patrick Olive, Commissioner, and Patty Watson, Economic Development, Region of Durham presented to Council the Department's Annual Report for 1996. He advised that they do not create jobs but an environment conducive to job creation. He outlined a number of initiatives in his department as follows: a Strategic Alliance Program was implemented in the Region in 1989, a Durham Visitors Guide has been distributed to all hotels within Toronto and a Resource Guide Book was created pertaining to filming within the Region. Barry Parson, Senior Project Officer with the Atomic Energy Control Board addressed Council with respect to the re-licencing of the Pickering Nuclear Generating Station and the results of the AECB' s enhanced assessment of the PNGS. Mr. A. W. Anderson, representing Banner Agencies, addressed Council with respect to the application for development on Altona Road. He requested Council approve the staff report and advised that they would be willing to change the units on Strouds Lane to semi-detached. ~! 8 "... . 50 4. Grant Morris, representing Maxcon Developments Ltd. addressed Council with respect to his request for a refund of the application fee for a Committee of Adjustment application. He stated that staff acknowledged the variances were minor and that the Committee of Adjustment agreed to the reduction in the fee. He advised that they are not creating any additional lots. CARRIED Resolution #225/97 Moved by Councillor Dickerson Seconded by Councillor Brenner That the memorandum of the Town Clerk dated June 6, 1997 regarding Council Communications and Dinner Allowance be received; and That Resolution #161/90, Item #8, passed on November 5, 1990, establishing an annual Communications Allowance of $4,200 for each Member of Council be repealed. CARRIED Resolution #227/97 Moved by Councillor Johnson Seconded by Councillor Pistritto WHEREAS the Council of the Corporation of the Town of Pickering enacted By-law Number 3802/91 to establish a reward of $1,000.00 to any person who provides information leading to a conviction of a person or persons who dispose of garbage or refuse on Town roads or property; and WHEREAS a person who sees another person dumping garbage or refuse on Town roads or property must appear in Court to act as a witness that the defendant was indeed seen dumping garbage or refuse; and WHEREAS most people are either intimidated to appear in Court or find it costly to sit in Court until they are called as a witness; and . , f - tØ 8 . 54 WHEREAS more people may be willing to follow through on a complaint they make of witnessing a person dumping garbage or refuse on Town roads or property; and WHEREAS the Council has clearly stated that it will not tolerate the dumping of garbage on its roads or property; NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby directs staff to amend By-law Number 3802/91 to provide a reward of $2,000.00 to any person who supplies information leading to a conviction of a person who disposes of garbage or refuse on Town roads or property. By-law Number 5042/97 Being a by-law to authorize the execution of a Subdivision Agreement and related documentation proposing to subdivide Lots 94,95 and 96, Registrar's Compiled Plan 1051, Pickering (672003 Ontario Limited, Draft Plan 18T -95001). Council considered the following motion in conjunction with By-law 5038/97: Resolution #228/97 Moved by Councillor Brenner Seconded by Councillor Johnson To defer by-law 5038/97 to the June 23rd Council Meeting. CARRIED THIRD READING: Councillor Johnson, seconded by Councillor Ryan moved that the report of the Committee of the Whole on By-laws Numbers 5030/97, 5031/97, 5032/97, 5033/97, 5034/97, 5035/97, 5036/97, 5037/97,5039/97,5040/97,5041/97 and 5042/97 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED .1 . . 56 (V) OTHER BUSINESS 1. Councillor Johnson requested that an alternative option for waste be investigated. 2. Councillor Johnson advised that a Notice of Motion would be brought forward concerning a 3-way stop at the intersection of Altona Road and Whitevale Road. 3. Councillor Johnson advised that a Notice of Motion would be coming forward concerning coverage by Shaw Cable. 4. Councillor Johnson requested that the property between Valley Farm Road and Guild Road be cleaned up. 5. Councillor Johnson invited Council and the residents to attend the official opening of the new Claremont Community Centre on Saturday, June 21 st. 6. Councillor Brenner advised that the General Manager and himself attended the National Transit Conference in Ottawa last week. 7. Councillor Senis congratulated Pearl Clement for receiving the award for Senior of the Year. 8. Mayor Arthurs congratulated Glen Hendry on his promotion. 9. The following matters were discussed prior to the regular meeting: a. The General Manager distributed information pertaining to traffic calming in Whitevale, road work being carried out by the Region of Durham, unusual number of alarms handled by the Fire Department, rehabilitation of Stott's and Maxwell's Bridges, and implementation - centralized customer service and information kiosk. b. Councillor Pistritto requested status on traffic calming within the hamlets. c. Councillor Pistritto questioned the status on the super mailbox location matter. d. Councillor Senis questioned what authority, if any, firefighters have in questioning managers of units regarding rent. e. Councillor Dickerson questioned whether or not Acorn Lane was to be curbed or have a swale. Councillors Johnson and Pistritto are in agreement with the swale concept. f. Councillor Dickerson commented on the memo from the Town Clerk concerning Councillors Communication and Dinner Expenses. (Vfl CONFIRMATION BY-LAW By-law Number 5052/97 Councillor Johnson seconded by Councillor Brenner moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its meeting held on the 2nd day of June, 1997 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. Appendix #1 TOWN OF PICKERING That the Executive Committee of the Town of Pickering having met on May 26, 1997, presents its tenth report to Council and recommends: PICKERING DOWNTOWN CORE: A LAND USE AND DESIGN STUDY FINAL REPORT - PHASES I AND II FILE NUMBER - B 2310 1. 2. 1. That Town Council endorse the Phase I and Phase II Final Reports on the Pickering Downtown Core: A Land Use and Urban Design Study, prepared by Markson Borooah Hodgson Architects Inc. et aI., as the basis for the preparation of Development Guidelines for the Pickering Downtown Core. 2. That Town Council adopt the "Development Guidelines for the Pickering Downtown Core" as set out in Appendix No. I, and direct that these Guidelines be included in the Town' Compendium Document to the new Official Plan. 3. That Town Council endorse the "Implementation Strategy for the Pickering Downtown Core" as set out in Appendix No. II to IDT Report No. 3/97, as a guide to the preparation of future departmental work programs and budget submissions. 4. That Town Council adopt "Modification No.2 to the Council Adopted Pickering Official Plan (March 1997)" as set out in Appendix No. III to IDT Report No. 3/97, and request the Region of Durham to modify the new Pickering Official Plan accordingly. CITY OF SCARBOROUGH OBJECTION TO CERTAIN TRANSPORTATION POLICIES OF THE COUNCIL ADOPTED OFFICIAL PLAN, AND RELATED MATTERS FILE NUMBER - B 2310 1. THAT Town Council requests the Provincial Ministry of Transportation of Ontario to undertake forthwith, an Environmental Assessment to determine the technically preferred alignment for a tfeeway connection between Highways 401 and 407, west of the Rouge River; and 2. THAT Town Council adopt proposed modifications to section 4.14(e) of the Council Adopted Official Plan, as set out in Appendix No. I to Planning Report No. 14/97, and requests the Region of Durham to modify the new Pickering Official Plan accordingly; and 3. THAT Town Council advise the City of Scarborough that Pickering has no comments on City of Scarborough Zoning By-law Application W96012, nor the proposed amendments to the Scarborough Official Plan - Schedule "C" Roads Plan insofar as the amendments do not prejudice the northerly extension of Mornings ide Avenue to Steeles Avenue, but requests notice of further activity on these proposals; and 4. REGIONAL OFFICIAL PLAN AMENDMENT APPLICATION 86-10ID(R) MODIFICATION #4 TO THE PICKERING OFFICIAL PLAN DRAFT PLAN OF SUBDIVISION 18T-86013(R) ZONING BY-LAW AMENDMENT APPLICATION A 15/86(R) 770661 ONTARIO INe. PART OF LOT 2, CONCESSION 5 (EAST SIDE OF AUDLEY ROAD, NORTH OF THE UNOPENED CONCESSION ROAD ALLOWANCE) FILE NUMBER - B 2310 -A15/86(R) 1. That Council APPROVE Town-Initiated Zoning By-law Amendment Application A 4/97 to permit Home-Based Business in the Town of Pickering, subject to conformity with a set of performance criteria as outlined in Appendix A to Recommendation Report No. 12/97; 2. That, in order to permit home-based businesses in the Town of Pickering in an appropriate manner, the necessary amendments to each of the Town's Zoning By-laws (Nos. 2511, 2520, 3036, & 3037), and the Town's Sign By-law (No. 2439/87) be forwarded to Council; and 3. That Council endorse the establishment of a Licensing System for Home- Based Business, and that a by-law establishing such a system be forwarded to Council. 5. PICKERING RURAL STUDY RURAL LANDS WEST OF WEST DUFFINS CREEK FILE NUMBER - B 1000 1. That Council authorize the commencement of a "Pickering Rural Study". 2. That Council adopt appropriate modifications to the Council Adopted Official Plan (March 1997) as set out in Appendix No. I to Planning Report No. 16/97, to extend the boundary of the Rural Study Area to include all lands in rural Pickering west of the West Duffins Creek. 3. That Council endorse a Study Process for the Pickering Rural Study as set out in Appendix II to Planning Report No. 16/97. .1 . . 3 6. APARTMENTS IN HOUSES (TWO-UNIT HOUSES) FILE NUMBER -B 1000 1. That Town Council receive for information Interdepartmental Development Team Report No. 1/97 regarding Two-Unit Houses; 2. That through the Home Fire Safety Program commencing in 1997, the Fire Department identify existing Two-Unit Houses and develop an inventory of these units within the Town's computer property system data base, including Fire Code conformity status and other relevant data; 3. That Town Council authorize the Planning Department to initiate a zoning review addressing the establishment of new Two-Unit Houses in the Town; 4. That Town Council consider the establishment of a Registry for Two-Unit Houses concurrent with its consideration of zoning provisions for new Two-Unit Houses in the Town, following completion of the zoning review outlined in Recommendation 3 above. 7. COMMITTEE OF ADJUSTMENT DECISION TO PARTIALLY REFUND APPLICATION FEES FOR EIGHT MINOR VARIANCE APPLICATIONS BY MAXCON DEVELOPMENTS LTD. FILE NUMBER - B 2310 That the Report of the Director of Planning dated May 23, 1997 be received; and That a charge of $600 be made to Maxcon Developments; and That the Committee of Adjustment Rules of Procedure be clarified to specify that on any lot of record where a minor variance or variances are requested, a separate minor variance application and fee shall be required for each part of that lot affected by the requested variance which will ultimately be created as a separate lot through plan of subdivision, consent or part lot control, as anticipated by the Planning Department. As amended 8 SHARED SERVICES WITH THE TOWN OF AJAX 1. That the Council of the Corporation of the Town of Pickering hereby approves in principle the partnering of the Fire and Transit Departments with the Town of Ajax; and That the Council of the Corporation of the Town of Ajax be requested to give its approval in principle to the partnering of the Fire and Transit Departments. 2. That a committee comprised of the Mayor, General ManagerlChief Administrative Officer and one senior Treasury staff person from each of the Towns of Pickering and Ajax be established to prepare a business case to address the issue of shared services; and That subject to the approval of the Council of the Town of Ajax, Mr. Jack Gartley be invited to act as a consultant to the committee. TENDER APPROVAL BY GENERAL MANAGER FILE NUMBER - C 4300 That the approval of tenders by the General Manager during Council's 1997 Summer Recess period (i.e. from June 24, 1997 to July 31, 1997 and from August 6, 1997 to august 29, 1997) be approved on condition that, (a) (b) (c) the lowest acceptable tender is approved, the cost thereof is within the budget previously allocated therefor by Council, and a report respecting those tenders is subsequently submitted to Council. 10. MODIFIED WORK PROGRAM POLICY FILE NUMBER - A 4000 That the Town's formalized Modified Work Program Policy as set out in Human Resources Report HR 5/96 be adopted 11. PROPOSAL TO OUT SOURCE THE DISTRIBUTION OF TAX CERTIFICATES FILE NUMBER - C 5000 That the proposal to start the process of outsourcing the distribution of Tax Certificates, as set out in Report IS 1/97 be adopted. 12. TENDER NO. T-6-97 TENDER FOR BOILER REPLACEMENT PICKERING RECREATION COMPLEX FILE NUMBER - C 4300 That Tender No. T -6-97 submitted by Canadian Tech Air Systems Inc. in the amount of$114,363.74 be accepted; and that a project cost of $115,238.46, including the tender amount and other associated costs, be approved. 13.
