Brenner, Chairman R Johnson D. Ryan S. Senis ABSENT: D. Dickerson (attending FCM Conference) E. Pistritto (ill) ALSO PRESENT: T. Quinn N. Carroll B. Taylor P. Wyger T. Moore D. Kearns - General Manager - Director of Planning - Town Clerk - Town Solicitor - Manager of Building and Plumbing Services - Co-ordinator of Council Services AUTHORITY TO MEET IN CAMERA Resolution #208/97 Moved by Mayor Arthurs Seconded by Councillor Ryan That pursuant to Section 55(7) of the Municipal Act, RS.O. 1990, c MA5, as amended, the Council of the Corporation of the Town of Pickering hereby resolves to conduct a meeting to consider a matters of litigation and personnel. CARRIED - 8. e 2 Resolution #209/97 Moved by Mayor Arthurs Seconded by Councillor Ryan That the draft by-law attached to Legal Services Report L 92/97 to provide for the indemnification and defence of Members of Council, Officers and Employees of the Corporation of the Town of Pickering with respect to liability arising out of acts or omissions done or made by them in their capacity as Members, Officers or Employees of the Municipality be forwarded to Council for enactment. CARRIED Recorded Vote: Yes: No: Absent: Councillors Brenner, Johnson, Ryan, and Mayor Arthurs Councillor Senis Councillors Dickerson and Pistritto The Town Solicitor gave an update on the status of the litigation respecting Novacor. Resolution #210/97 Moved by Mayor Arthurs Seconded by Councillor Ryan That the firm ofHurren, Flett, Sinclair be retained for the purpose of reviewing the books and records of Nova cor, made available through the Trustee's office, relating to the ongoing litigation matter with Novacor. CARRIED The Town Solicitor further advised Council that the Fulco Automotive decision has been made and the funds respecting this matter have been paid into Court. The Town Solicitor advised that Ontario Hydro is appealing the levying of development charges on behalf of Mitchell Construction, which company is undertaking work at the Pickering Nuclear Generating Station. Resolution #211/97 Moved by Mayor Arthurs Seconded by Councillor Johnson That the recommendation set out in the memorandum of the Mayor dated May 27, 1997 respecting a personnel matter be approved.
