A Meeting of the Pickering Town Council was held on Monday, January 20, 1997 at 7:30

DELEGATIONS
Shane Harbinson, representing Ontario Volunteer Emergency Response
Team Inc. (OVERT), stated that his organization is now officially
recognized by the Durham Regional Police Services and they have helped
them with several searches. He is asking each municipality in the Region of
Durham to help support OVERT by approving a grant to help offset its
operating expenses. He asked Council for a grant in the amount of $2,500.
Karen Marks, Health Promotion Chairman of the Durham Chapter of the
Canadian Cancer Society, stated that this is National Non-Smoking Week
and presented Council with potted daffodil bulbs to recognize Council's
efforts in establishing a complete smoke free workplace and enacting
smoking regulations.

WHEREAS there is a vacancy in the position of Chief Administrative Officer for both the
Towns of Pickering and Ajax; and
WHEREAS there is merit in studying the feasibility of hiring one Chief Administrative
Officer to serve both the Towns of Pickering and Ajax; and
WHEREAS in Resolution #419/96 passed on December 16, 1996, Council requested that
a meeting be convened between the Corporations of the Town of Pickering and the Town
of Ajax in an effort to review possible partnerships and co-operative servicing;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby
requests that during the meeting with the Council of the Corporation of the Town of Ajax,
a discussion to explore the merits of hiring a Chief Administrative Officer to serve both
municipalities take place.

Plan 40M-1719, Pickering.
THIRD READING:
Councillor Johnson, seconded by Councillor Dickerson moved that the report of the
Committee ofthe Whole on By-law Numbers be adopted and the said by-law be now read
a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the
Corporation be affixed thereto.

OTHER BUSINESS
1.
Councillor Brenner introduced a Notice of Motion seconded by Councillor
Pistritto to implement a portion of the Bradford Report.
2.
Councillor Ryan introduced a Notice of Motion seconded by Councillor
Brenner to allow speed limits to be enforced by a Municipal Law
Enforcement Officer.
3.
Councillor Johnson reported that Janet Eker has offered to meet with
Council about some of initiatives taken by the Provincial Government last
week.
4.
Mayor Arthurs invited all residents to attend a function at the Recreation
Complex on Saturday, January 25th to celebrate the closing of the Brock
West Landfill Site.
5.
Mayor Arthurs expressed a concern about the announcements made by the
Provincial Government last week and stated that the full effect of these
announcements will be determined in the near future.
6.
The following matters were discussed prior to the regular meeting:
a)
The Executive Director of Operations circulated a memo from the
Acting Director of Public Works dated January 20, 1997 regarding
the York Region Long Term Water Supply Project.

The Executive Director of Operations reported that there is a
problem with a resident on Primrose Court who is installing a
backyard skating rink and allowing water to spill onto Fairport
Road.
The Executive Director of Operations asked that Council meet
prior to the budgets for a presentation on Kingston Road.
d)
Councillor Senis reported that residents have been calling her
requesting information about equipment used by North York to
clear driveways and asked that this information be made available to
Council.
e)
Councillor Senis asked Council to provide staff with direction on
the purchase ofland for the Fairport RoadIBonita Avenue park and
the following motion was considered:

That the Town Solicitor be authorized to negotiate for parkland at
the intersection of Fairport Road and Bonita Avenue with the
strategy that using 5% ofland ftom 18T-95001(R) and 5% ofland
ftom 18T-94022 and in the alternative, using 5% ofland from 18T-
95001(R).

Councillor Ryan stated a concern he had about the Town raising
money for community groups and using Yuk Yuks as the
entertainment at a fundraising function.

Councillor seconded by Councillor moved for leave to introduce a By-law of the Town of
Pickering to confirm those proceedings of the Council of the Corporation of the Town of
Pickering at its meeting held on the 20th day of January, 1997 and that the same be now
finally passed and that the Mayor and Clerk sign the same and that the Seal of the
Corporation be thereto affixed.

That the Executive Committee of the Town of Pickering having met on January 13, 1997,
presents its first report to Council and recommends:
1.

That Council recommend to Regional Council that Draft Plan of Condominium
18CDM-96004, submitted by Commercial Devco Incorporated, for the
establishment of condominium tenure on lands being Part of Lots 8, 9 and 10,
Registered Plan 489, BE APPROVED, subject to No. I to Recommendation
Report conditions listed in Appendix No. 1/97.

APARTMENTS IN HOUSES
FILE NUMBER - B 1000
WHEREAS the previous Provincial Government passed legislation which
permitted apartments in houses as a matter of right with few restrictions; and
WHEREAS this type of housing, unless strictly regulated, can have a negative
impact on the tenants of such housing, and the neighbourhood and community in
which they are situated by:

creating additional parking and traffic problems
unsafe conditions such as no smoke detectors or lack of proper
exits
putting unplanned pressure on municipal services such as water and
sewers
creating additional pressure on the schools because owners are not
paying additional education taxes; and

WHEREAS on May 22, 1996, the present Provincial Government passed the Land
Use Planning and Protection Act which reinstates municipal authority in
determining whether or not to allow apartments in houses; and
WHEREAS the said Act states that no apartment created after November 16,
1995 is permitted, except where a building permit was applied for and issued
before May 22, 1996; and
WHEREAS the said Act also provides a grandfathering provision which serves to
allow "as of right" any apartment which was used or occupied on or before
November 16, 1996 and that such units must comply with the requirement of the
Fire Code; and
,
WHEREAS the issue of apartments in houses is of such an importance that
Council must be aware of the number of such units in existence and the impact
they have;

NOW THEREFORE the Council of the Corporation of the Town of Pickering
hereby directs staff to prepare a report setting out recommendations for inspecting
such units and ensuring compliance with the Fire Code, Zoning By-laws, Property
Standards By-law and other municipal regulations; and
THAT this report and the report submitted by the Director of Planning and
Building Services Manager dated January 2, 1997 be tabled at a Council Meeting
no later than March 3 1, 1997.

EMPLOYEE BENEFIT GROUP INSURANCE

That a by-law should be enacted to authorize the execution of the necessary
documents to provide the following for entitled Town employees or retired
employees during 1997:
(a)
group life insurance and long term disability benefits, to be provided by
Maritime Life Assurance Company; and
(b)
group health and dental insurance, to be provided by Liberty Health
(Liberty Mutual Insurance Group).
4.
RECOMMENDATIONS OF THE TOWN OF PICKERING
AS TO REGIONAL ROAD CONSTRUCTION PRIORITIES

That Public Works Report PW 1/97 on Regional Road construction priorities
within the Town be received, adopted and forwarded to the Regional Municipality
of Durham with the request that its recommendations be implemented.

REGIONAL "WHO DOES WHAT" COMMITTEE

That the letter ftom the Regional Municipality of Durham dated November 25,
1996 advising that the Regional Council has established a "Who Does What"
Committee with a mandate to look at all aspects of service delivery at the Regional
level and see how they fit into the Municipal Services Delivery Program be
received.
