COUNCIL MINUTES
A Meeting of the Pickering Town Council was held on Tuesday, May 19, 1998 at 7:30 p.m.

ADOPTION OF MINUTES
Regular Meeting of May 4, 1998
D~EGATIONS
Mark Reesor, R. R. #2, Pickering, asked Council to consider the importance of
agricultural easements. He stated it was beneficial to have a buffer or green belt
within the Greater Toronto Area and that agricultural easements are required in
order to prevent land speculation.
John Kay, representing the Last Green Door Co-op, noted that Council is the
steward of the land and that many people who use the agricultural lands do not live
on the land. He supports the imposition of agricultural easements and noted that
the Rouge Park Alliance does not want easements because it restricts flexibility.
Tommy Thompson, representing the Green Door Alliance, strongly commended
Council for holding a public meeting to come to a consensus on the issue of
agricultural easements. The Council must have influence over land use planning in
Pickering and stated that the Town has been unfairly treated over the years by
expropriations and the lack of control over the lands.

Mark Osbaldeston, representing the Ontario Realty Corporation, noted that the
Regional Planning Committee has deferred making decisions affecting the subject
agricultural lands pending the public meeting to discuss the issue of agricultural
easements. He asked that Council request the Regional Planning Committee to
consider the planning matters at its meeting of May 26, 1998.

Joanne Dies, representing the Concerned Citizens of Durham, stated that she is a
homemaker and volunteers with various groups in the community and is concerned
about the effects of globalization on the proposed new Municipal Act. She and
other parents inquired into the Quality of Education Act but their concerns were
not addressed. The changes taking place in the various legislation passed by the
Provincial Government is to make way for globalization. The Multilateral
Agreement on Investment is a factor in the proposed new Municipal Act and will
have a huge impact on local government.

Tom Mohr, representing the Pickering Historical Society, stated that he supports
the Preliminary Report prepared by Heritage Pickering on the Palmer House. The
Palmer House is currently serving a purpose in the East Woodlands Park by
providing space for the Senior Citizens. The preservation of the Palmer House
will set a positive precedent for further preservation of historical buildings and
show the Town's commitment to its history.

Jill Foster, Chair, Public Library Board, stated that there are time constraints with
respect to the development of the proposed western library branch and that there
has been and continues to be a lengthy process that involves public consultation.
The Library Board is requesting a 10,000 square foot building and noted that
anything smaller will not properly service the community.

That Council endorse and support the initiative of the Province to re-write the Municipal Act for
the purpose of creating a streamlined legislative framework that would give municipalities
significantly more flexibility and autonomy; and
That the recommendations set out in Town Solicitor's Report L 42/98 be adopted; and
That Council direct the Town Clerk to forward a copy of the Council resolution to the Ministry of
Municipal Affairs and Housing, Local Government Policy Branch, prior to May 8, 1998; and
That this report be received for information purposes.

That the second and third paragraphs of the above resolution be replaced with the following:
That the Council of the Corporation of the Town of Pickering opposes the proposed new
Munitipal Act as it fails to offer municipalities with the significant increase in flexibility and
autonomy that was promised and in fact more restrictive and controlling than the existing
legislation; and
That Council will maintain its opposition to the proposed new Municipal Act until such time as it
addresses the concerns enumerated in Town Solicitor's Report L 42/98.

sq. ft. library; plus 1,500 sq. ft. community room [total 11,500 sq. ft.]; and
That a pre-budget expenditure for professional services related to the design development and
construction drawings for the selected option is hereby authorized; and
That staff be directed to report back to Council in June 1998 with a recommended design for the
selected option.

That the Council of the Town of Pickering hereby recommends to Regional Council:
1.
That the Town of Pickering position for public alerting and public notification, as set out
in Councillor's Report CO 1/98, be adopted.
2.
That Councillor's Report CO 1/98 be forwarded to the Solicitor General and the Minister
of Correction Services for approval and direction that the Town's position be
incorporated into the Provincial Nuclear Emergency Plan (PNEP).
3.
That Councillor's Report CO 1198 also be forwarded to each Member of the Provincial
Legislature representing Durham Region.

WHEREAS the Corporation of the Town of Pickering hosted the Brock West Landfill Site for
oyer twenty-five years and accepted imported waste from Metro Toronto and the surrounding
region during that time; and

WHEREAS the residents of the Town of Pickering have clearly expressed their opposition to
further importation of waste and their desire for their municipal government to have autonomy
over the placement of dumps and waste transfer stations within Pickering's municipal borders; and
WHEREAS there is uncertainty about who will assume control over the placement of dumps and
have the final decision with respect to the placement and size of waste transfer stations; and

WHEREAS the Ministry of the Environment is processing Can-Sort's application for a Certificate
of Approval to increase their operations by 500% despite the Council of the Corporation of the
Town of Pickering stating its strenuous objection to the application; and
WHEREAS J & F Waste is attempting to overturn the decisions of Pickering and Ajax citizens
and Councils by appealing the decision to the Ontario Municipal Board; and
WHEREAS current proposed changes to the Municipal Act would further erode municipal
autonomy over waste and, in many instances, place it in the hands of staff at the Ministry of the
Environment through the Certificate of Approval process; and
WHEREAS it was the platform of the current government during the last Provincial election that
municipalities would receive autonomy over decisions with respect to waste in their communities;
NOW THEREFORE the Council of the Corporation of the Town of Pickering hereby firmly
asserts its position that decisions concerning the placement of garbage dumps and waste transfer
stations be under the jurisdiction of each willing host municipality where government is closest to
its constituents and best understands the interests of their respective municipalities; and
THAT this resolution be forwarded to all Mayors and Chairs within the GT A with a letter from
the Town Clerk stating the Council of the Town of Pickering's position on this matter and
requesting that they adopt similar motions in their municipalities to ensure autonomy over waste
related matters within their boundaries; and

THIRD READING:
Councillor Dickerson seconded by Councillor Brenner moved that the report of the Committee of
the Whole on By-law Numbers 5302/98, 5303/98, 5304/98, 5307/98, 5308/98, 5309/98, 5310/98,
5311/98, 5312/98 and 5313/98 be adopted and the said by-laws be now read a third time and
PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed
thereto.

OTHER BUSINESS
1.
Councillor Brenner reported that Alan Tonks will be at the Executive Committee
Meeting of May 25, 1998 to discuss the Greater Toronto Services Board.
2.
Councillor Ryan reported that he has been working successfully with staff on
reducing the amount of garbage generated at the Civic Complex.
3.
The following matters were considered prior to the regular meeting:
a)
The General Manager reported that he and the Director of Finance will be
providing Council with a report on the restructuring of the Treasury
Department.
b)
The General Manager distributed for Council's information a brochure
prepared by the Customer Care Centre entitled "Making A Difference".
c)
The General Manager distributed a letter from the Durham Regional Police
Services dated May 19, 1998 regarding Operation Cleanup.
d)
Mayor Arthurs asked if there was any consensus to approving the request
from the Aerials Gymnastics Club for a waiver of a hall rental fee.
e)
Mayor Arthurs asked if there was a consensus to support the Frenchman's
Bay Watershed Project by proving an in-kind donation of office space and
other resources. Council concurred with the donation of office space and
other resources such as vehicles based on the availability of those
resources.
t)
Mayor Arthurs reported that staff is preparing a report on a request from
Tridel to stagger the payment of lot levies on the development of their
apartment tower.

T own of Pickering to confirm those proceedings of the Council of the Corporation of the Town

thereto affixed.

APPENDIX #1
TOWN OF PICKERING
That the Executive Committee of the Town of Pickering having met on May 11, 1998, presents
its eighth report to Council and recommends:
1.
AGRICULTURAL EASEMENTS
RURAL STUDY AREA
FILE NUMBER - B 1000
That Report to Council IDT 05-98 dealing with agricultural easements be
received and forwarded to Regional Council and the Ontario Realty
Corporation (ORC); and
That the Region of Durham be advised that the Town does not support the
use of agricultural easements established and held by the Region and ORC
as a condition of approving Regional Official Plan Amendment 96-014/D;
and
That Town staff be directed to have a meeting with the local community to
consider the merits of establishing agricultural easements to be held by the
Town of Pickering and that ORC be encouraged to attend this meeting;
and
That the ORC be requested to suspend its sales program in the Agricultural
Assembly until the Town has received comments from the local community
concerning agricultural easements, and until ORC has entered into an
Agreement with the Town addressing the various matters identified in
Council Resolution #175/97, Item #1.
