COUNCIL MINUTES A Meeting of the Pickering Town Council was held on Monday, May 31, 1999 at 7:40 p.m. PRESENT: Mayor Wayne Arthurs COUNCILLORS: D. Dickerson M. Holland D. RESOLUTIONS Resolution #122/99 . See Appendix #1 Moved by Councillor Holland Seconded by Councillor Pickles That the Report of the Executive Committee dated May 25, 1999 be adopted with the following amendment: That Item #1 concerning Zoning By-law Amendment Application A 22/98 be tabled. CARRIED . . ... , . 8 -- 35 Resolution #123/99 Moved by Councillor Pickles Seconded by Councillor Dickerson That Human Resources Report #HR 01-99 and #HR 02-99 concerning the Collective Agreement be approved. CARRIED (III) BY -LA WS That Councillor Holland seconded by Councillor Pickles took leave to introduce by-laws of the Town of Pickering: By-law Number 5498/99 Being a by-law to amend By-law 2359/87 regulating parking, standing and stopping on highways and on private and municipal property (Bayfleld Street). By-law Number 5499/99 Being a by-law to adopt the estimates of all sums required to be raised by taxation for the year 1999 and to establish the Tax Rates necessary to raise such sums.. By-law Number 5500/99 Being a by-law to amend Restricted Area (Zoning) By-law 3036, and amending By-laws 1158/80 and 3878/91, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham in Block 1, Plan 40M-1236, in the Town of Pickering (A 22/98). TABLED Council considered the following motion in conjunction with By-law 5500/99: Resolution #124/99 Moved by Councillor Dickerson Seconded by Councillor Holland That By-law 5500/99 be tabled. CARRIED THIRD READING: Councillor Holland seconded by Councillor Pickles moved that the report of the Committee of the Whole on By-law Numbers 5498/99 and 5499/99 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal ofthe Corporation be affixed thereto. CARRIED " , '". . e . 36 (IV) OTHER BUSINESS 1. Mayor Arthurs advised that Council had reached mid point of their Term of Office. 2. The following matters were discussed prior to the regular meeting:. a) The Director of Finance & Treasurer made a presentation to Council on Development Charges. A public meeting has been scheduled for June 16th concerning this matter. He distributed information on Development Charge Rules, Proposed Tax Payment Schedule and Development Charges Apportionment Table. He advised that a report would be coming forward concerning Insurance Pooling. b) The Chief Administrative Officer commented on the Darwin Drive Pool Ravine concern and the Declaration of Surplus Lands matter, Council were in support of the recommendation for declaring the lands surplus on Darwin Drive. c) The Chief Administrative Officer advised that a Police Services meeting was held with himself, Region Fire Departments concerning possible amgamation of Fire Dispatch and a report would be coming forward. d) The Chief Administrative Officer distributed correspondence which he recently forwarded to Garry Cubitt, c.AO. of the Region of Durham concerning Nuclear Emergency 3K to 10K Notice Zone. (V) CONFIRMATION BY-LAW By-law Number 5501/99 Councillor Pickles seconded by Councillor Holland moved for leave to introduce a By-law of the Town of Pickering to confirm those proceedings of the Council of the Corporation of the Town of Pickering at its regular and special meeting held on May 25, 1999 and regular meeting of May 31, 1999 and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. APPENDIX #1 TOWN OF PICKERING That the Executive Committee of the Town of Pickering having met on May 25, 1999, presents its ninth report to Council and recommends: ZONING BY-LAW AMENDMENT APPLICATION A 22/98 J. & K. SHOPPING CENTRE INc. (MAPLE RIDGE PLAZA; SOUTHWEST CORNER OF LIVERPOOL ROAD) FILE NUMBER - A 2310 - A22/98 1. . - 2. 3. 8 1. That Zoning By-law Amendment Application A 22/98, submitted by Grant Morris Associates Limited on behalf of J. & K. Shopping Centre Inc., on lands being Block I, Plan 40M-1236, Town of Pickering, to amend the zoning on the subject lands by adding additional uses, be APPROVED, subject to the conditions outlined in Appendix I to Recommendation Report No. 7-99, as revised to amend all references to restaurant-type A to a sit down only restaurant; and further That the owner provide a fully enclosed, roofed garbage structure on-site. 2. That the amending zoning by-law to implement Zoning By-law Amendment Application A 22/98, as set out in draft in Appendix II to Recommendation Report No. 7-99, be forwarded to Town Council for enactment, with appropriate revisions to address a sit- down only restaurant. TABLED ZONING BY-LAW AMENDMENT APPLICATION A 24/98 DAVID A. DEMERINO (NORTH SIDE OF KINGSTON ROAD AT PETTICOAT CREEK) FILE NUMBER - A 2310 - A24/98 That Zoning By-law Amendment Application A 24/98, submitted for David A. Demerino, on Lot 165, Plan 816, to amend the zoning on the subject lands to allow the existing building to be used for business office use, as well as residential use, be APPROVED, subject to the conditions outlined in Appendix I to Recommendation Report Number 8-99, as revised to permit 180 square metres gross leasable floor area of limited business office use and to require 9 parking spaces on site. ZONING BY-LAW AMENDMENT APPLICATION A 2/99 ONTARIO REALTY CORPORATION (WHITEVALE GOLF CLUB) (EAST SIDE OF GOLF CLUB ROAD, SOUTH OF CONCESSION 5 ROAD) FILE NUMBER - A 2310 - A2/99 1. That Zoning By-law Amendment Application A 2/99, submitted by Whitevale Golf Club, on north part of Lots 29 and 30, Concession 4, to extend the temporary use zoning of the existing golf practice facility on the site to allow its operation for an additional three year period from August 5, 1999, to August 4,2002, be APPROVED. 2. That the appropriate implementing By-law, included with Recommendation Report No. 9-99 as Appendix I, be forwarded to Council for enactment. , . , , , . i< , 2 4. 1999 TAX RATES FILE NUMBER C 1000 That the 1999 tax rates for the Town of Pickering be approved as contained in Schedule A to draft By-law No. 5499/99 attached hereto; and . That the attached draft By-law No. 5499/99, providing for the imposition of the tax rates approved under Recommendation I above; be enacted; and That the Director of Finance & Treasurer be authorized to make any changes or undertake any actions necessary, including altering due dates, in order to ensure the tax billing process is completed; and That the appropriate staff of the Town of Pickering be given authority to give effect thereto. 5. APPLICA nON TO CONDUCT A CARNIV AL FILE NUMBER B 2200 That the application for a Carnival Licence submitted by Bowmanville Zoo, operated by Savannah Land Corporation and Bowmanville Zoological Park Limited, to conduct a carnival at the Metro East Trade Centre on Saturday, June 12, 1999 and Sunday, June 13, 1999, be approved. 6. APPROVAL OF TENDERS BY CAO DURING SUMMER RECESS FILE NUMBER C 4300 8 That the Chief Administrative Officer be authorized to approve Tenders during Council's Summer Recess period (i.e., from June 29 to July 30, 1999 and from August 4, 1999 to September 10, 1999), on condition that, a) b) the lowest acceptable Tender is approved, the cost thereof is within the budget previously allocated herefor by Council, and a report respecting those Tenders is subsequently submitted to Council. c) 7. SIXTY MINUTE DOCUMENTARY ON THE TOWN OF PICKERING - "ONCE IN A MILLENNIUM' 8 That Mayor Arthurs and the Town Clerk be authorized to sign the letter of understanding as prepared by Legal Services for the production of the 60 minute documentary on the Town of Pickering "Once in a Millennium".
