Special Meeting of April 6, 1999. I!EkEGA TIONS Ira Kagan, representing Geraldine Hollinger, requested that Council support a new Schedule F to the Memorandum of Understanding regarding the agricultural easements to add the Hollinger's property as being exempt from agricultural easements. He questioned why their name was on the exempted list that was produced on March 31, 1999 but later that day was removed. He noted that the Region of Durham asked the Ontario Realty Corporation to exempt a property only if there is a signed Agreement of Purchase and Sale whereas the Town has agreed to exempt a property if there was an agreed upon deal between with ORC to acquire land. He stated that the Hollingers have made an agreement to buy their land but do not have an Agreement of Purchase and Sale in the prescribed form. If the Hollingers are not exempt from agricultural easements, he will be required to negotiate the Memorandum of Understanding in order to ensure that his client's interests are protected. Mr. Kagan distributed a copy of a letter from James W. Harbell of the lawfirm of Stikeman, Elliott, as the representative of the ORC, indicating that the ORC is willing to place the Hollinger's property on Schedule F if so desired by the Town. . " .
