(OPA 99-001/P) THIRD READING: Councillor Johnson seconded by Councillor Brenner moved that the report of the Committee of the Whole on By-law Numbers 5691/00, 5706/00, 5707/00, 5708/00, 5709100, 5710100, 5711/00, 5712/00, 5713100, 5714/00 and 5715100 be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal of the Corporation be affixed thereto. CARRIED (IV) CONFIRMATION BY-LAW By-law Number 5716100 - Councillor Johnson, seconded by Councillor Holland, moved for leave to introduce a By- law of the City of Pickering to confirm those proceedings of the Council of the Corporation of the City of Pickering at its Special Council Meeting of June 26, 2000 and the Regular Council Meeting of June 26, 2000, and that the same be now finally passed and that the Mayor and Clerk sign the same and that the Seal of the Corporation be thereto affixed. COUNCIL RECOMMENDATION SOCIAL DEVELOPMENT COUNCIL WOMEN'S SHELTER IN AJAXlPICKERING WHEREAS the Council of the Corporation of the City of Pickering has advocated the critical need to establish a women's shelter in Ajax/Pickering; and WHEREAS on June 20, 2000 Pickering was devastated by the horrible tragedy that took the life of an innocent mother, Gillian Hadley, in our community; and WHEREAS Gillian Hadley had been a client of the Social Development Council; and WHEREAS clients of the Social Development Council often decide against uprooting their family, ITiends and work to move to the only shelter in Durham located in Oshawa; and WHEREAS it is imperative that the tragedy that took the life of Gillian Hadley not be in vain and that changes occur locally, provincially and federally to attempt to end such violence; and -- WHEREAS the waiting list for housing of residents in emergency situations is currently 18 months long, NOW THEREFORE the Council of the Corporation of the City of Pickering receive for information the motion adopted by the Social Development Council on June 21, 2000; and THAT the Council of the Corporation of the City of Pickering agree to participate in the Civic Summit and that it recognizes and strongly supports the immediate, critical need for a women's shelter in Ajax/Pickering; and THAT the Council of the Corporation of the City of Pickering further endorse the premise that immediate changes are needed in the provincial and federal legal systems to properly protect spouses who are in danger of violence from their former or current partners; and THAT the Council of the Corporation of the City of Pickering further express the pressing and critical need for housing in Durham and urgently request that the Province of Ontario work with Durham Region to alleviate the backlog, particularly for emergency housing situations; and - THAT this motion be forwarded to Janet Ecker, M.P.P., Ajax Pickering Uxbridge and Minister of Education; Jim Flaherty, M.P.P. Ajax Whitby, Minister of the Attorney General; Dan McTeague, M.P. Ajax Pickering Uxbridge; Judi Longfield, M.P. PLANNING & DEVELOPMENT REPORT 34-00 OFFICIAL PLAN AMENDMENT APPLICATION 99-001/P DRAFT PLAN OF SUBDIVISION 18T~98018 (REVISION 2) ZONING BY-LAW AMENDMENT APPLICATION A 6199 BOP A DEVELOPMENTS INC. PART OF LOT 33, CONCESSION 1 (SOUTH- WEST CORNER OF FINCH AVE. AND AL TONA RD.) 1. That Official Plan Amendment Application 99-001/P, submitted by Bopa Developments Inc., on lands known as Part of Lot 33, Concession 1, City of Pickering, to redesignate a portion of the subject lands from "Urban Residential Areas - Low Density" to "Urban Residential Areas - Medium Density", be APPROVED, as outlined in Appendix I to Report Number PD 34-00; 2. That Zoning By-law Amendment Application A 6199, submitted by Bopa Developments Inc., to permit residential development and conserve open space lands, on lands known as Part of Lot 33, Concession 1, City of Pickering, be APPROVED to implement Draft Plan of Subdivision 18T- 98018 (Revision 2), subject to the conditions outlined in Appendix III to Report Number PD 34-00. 3. PLANNING & DEVELOPMENT REPORT 31-00 ZONING BY-LAW AMENDMENT APPLICATION A 9100 . A. AND C. AL-JOUNDI AND CLAREMONT UNION CEMETERY CO. LTD. PART OF LOT 14, CONCESSION 9 (NORTHEAST CORNER OF REGIONAL ROAD NO.5 & SIDELINE #14) That Zoning By-law Amendment Application A 9100, submitted by Mr. A. Al- Joundi, to rezone lands owned by A. and C. Al-Joundi and Claremont Union Cemetery Co. That Zoning By-law Amendment Application A 30199, submitted by Fred Campitelli in trust, on Block 11, Plan 40M-1231, to amend the zoning of the subject lands to the "RH/MU-2" zone as established on the southerly-abutting property, to permit the development of high density residential and mixed uses, be APPROVED. 2. That the amending zoning by-law to implement Zoning By-law Amendment Application A 30199, as set out in draft in Appendix I to Planning Report Number PD 29-00, be forwarded to Council for passing. 5. PLANNING & DEVELOPMENT REPORT #32-00 ZONING BY-LAW AMENDMENT APPLICATION A 10/00 BRYDALE DEVELOPMENTS (PICKERING) INC. PART OF LOT 1, PLAN 819 (NORTH SIDE OF GRAY ABBEY CRT. WEST OF FAIRPORT RD.) 1. That Zoning By-law Amendment Application A 10100, submitted by Brydale Developments (Pickering) Inc., for lands known as Part of Lot 1, Plan 819, City of Pickering, to amend the zoning on the subject lands to permit the establishment of three detached residential dwellings on lots with minimum lot frontages of 12 metres, be APPROVED, subject to the conditions outlined in Appendix I to Report Number PD 32-00. 6. PLANNING & DEVELOPMENT REPORT #33-00 ZONING BY-LAW AMENDMENT APPLICATION A 7/00 LONG & MCQUADE LIMITED PART OF LOTS 5 TO 7, PLAN 230 PART OF LOT 31, CONCESSION 1 WEST SIDE OF ROSEBANKRD. SOUTH OF HIGHWAY 401) 1. That Zoning By-law Amendment Application A 7/00, submitted by Long & McQuade Limited, on lands being Part of Lots 5 to 7, Plan 230 and Part of Lot 31, Concession 1, City of Pickering, to change the zoning of the subject lands from "Rl" - Residential Detached Dwelling to "Ml-l" - Industrial (Employment) Zone, in order to facilitate the construction of a new warehouse/office building, be APPROVED, subject to the conditions outlined in Appendix I to Report Number PD 33-00. 7. PLANNING & DEVELOPMENT REPORT #30-00 MINOR V ARlANCE APPLICATION PICA 20100 A. O'BRIEN & 1. COLLINS LOT 74, PLAN M-14 ALSO KNOWN AS 1329 TATRA DRIVE 1. That Council receive for information a request made through a resolution passed by the Committee of Adjustment recommending that Council consider the waiving or reduction of an application fee of $350.00 with respect to minor variance application PICA 20100, submitted by A. O'Brien and J. Collins. - - 9. - --4-- 8. CHIEF ADMINISTRATIVE OFFICER REPORT #12-00 PICKERING "A" RETURN TO SERVICE PEER REVIEW TEAM COMMENTS ON DRAFT ENVIRONMENTAL ASSESSMENT 1. That Council receive Report to Council CAO 12-00, which Report includes as Attachment No.1, comments from the City's Peer Review Team on the Draft Environmental Assessment Report for the return to service of Pickering "A". 2. That Council endorse the Peer Review Team's comments on the Draft Environmental Assessment Report for the return to service of Pickering "A" and forward these comments to the Canadian Nuclear Safety Commission for consideration, and the Ontario Power Generation for information. 3. That in light of the Peer Review Team's finding that it is not possible at the present time to support the conclusion that the restart of PNGS-A is without significant adverse environmental effects, Council request the federal Minister of the Environment to refer the project either to a Review Panel or to a Mediator, under the Canadian Environmental Assessment Act, in order to address the issues and concerns raised by the Peer Review Team in response to the Draft Environmental Assessment Report, and in response to the Draft Scope of Assessment Document. 4. That a copy of Report to Council CAO 12-00, be forwarded to the Canadian Nuclear Safety Commission, the Federal Minister of the Environment, the Ontario Power Generation, and the Honourable Dan McTeague, M.P. Pickering- Ajax- U xbridge. CHIEF EXECUTIVE OFFICER REPORT PUBLI C LIBRARY BOARD NAMING OF NEW WESTERN LIBRARY BRANCH AND COMMUNITY CENTRE WHEREAS by Resolution #84/00 passed on May 15, 2000, the Council of the Corporation of the City of Pickering confinned that the Pickering Public Library Board could hold an open competition for the naming of the new library branch and community center; and WHEREAS in a presentation made to Council at its meeting of June 26, 2000, the Chair of the Library Board presented the new name for the branch; NOW THEREFORE the Council of the Corporation of the City of Pickering hereby approves the name of the new library branch and community center to be PETTI COAT CREEK LIBRARY AND COMMUNITY CENTRE. 10. MUNICIPAL PROPERTY & ENGINEERING REPORT #20100 TENDER NO. T-6-2000 - STORM SEWER IMPROVEMENTS AND ROAD RECONSTRUCTION - VICKI DRIVE 1. That Tender No. T-6-2000 submitted by Bishop Construction to complete Storm Sewer Improvements and Road Reconstruction in the amount of $206,398.72 including 7% G.S.T. be accepted; and 2. That a project cost of $203,833.28 including the Tender amount and other associated costs be approved; and. 3. That funding in the amount of $204,000.00, be approved. 11. - - - --5-- CORPORATE SERVICES & TREASURER REPORT #15-00 DEVELOPMENT CHARGES That Report CS15-00 of the Director, Corporate Services & Treasurer be received; and 1. That as provided for in Section 16 of By-law 5546199, the Development Charges referred to in Sections 6 and 11 of that by-law be increased by 3.85 per cent being the annual increase in the Construction Price Statistics as reported by Statistics Canada for the year ended March 31, 2000; and 2. That the appropriate officials of the City of Pickering be given authority to give effect thereto.
