Resolution #169/01 Moved by Councillor Brenner Seconded by Councillor Ryan That an additional delegation be heard. CARRIED 2. Dave Martin, representing the Uxbridge Conservation Association, addressed Council concerning the Trans Canada Trail Funding. - - 1 - Council Meeting Minutes Monday, December 17, 2001 8:00 p.m. (III) RESOLUTIONS Resolution #170/01 - Appendix #1 - Moved by Councillor Holland Seconded by Councillor Pickles That the Report of the Committee of the Whole dated December 10, 2001 be adopted. CARRIED Resolution #171/01 Moved by Councillor Holland Seconded by Councillor Ryan 1. That City Council receive for information the report of the Director, Planning & Development, dated November 26, 2001, Report Number PD 43-01. 2. That City Council adopt the draft by-law, Attachment No.4 to the Report of the Director, Planning & Development, dated November 26,2001, Report Number PD 43-01. 3. That a copy of Report to Council PD 43-01, together with a copy of the adopted by-law delegating certain authority under the Planning Act to the Director, Planning & Development, be forwarded to the Region of Durham and the Ministry of Municipal Affairs and Housing. - CARRIED Resolution #172/01 Moved by Councillor Johnson Seconded by Councillor Ryan 1. That the Clerk of the Town of Ajax be advised that, Pickering City Council recommends the use of one street name for that section of the road between the interchange of Pickering Beach Road and Highway 401 (in the Town of Ajax) and the future interchange of Salem Road and Highway 407 (in the City of Pickering); and 2. That the Clerk of the Town of Ajax be advised that Pickering City Council recommends that the name "Salem Road" be used for the section of road between the interchanges of Highway 401 and Highway 407. CARRIED Recorded Vote: Yes: Councillors Brenner, Holland, Johnson, Pickles, Ryan and Mayor Arthurs. Resolution #173/01 - Moved by Councillor Johnson Seconded by Councillor Holland 1. That the joint report of the Operations & Emergency Services Department and the Corporate Services Department, be received; and 2. That Council approve the calling of a Tender for the Don Beer Expansion & Renovation Project; and - 2- Council Meeting Minutes Monday, December 17,2001 8:00 p.m. 3. That staff report back to Council, through the Finance & Operations Committee, at the earliest possible date in 2002 on the results of the Tender (RFP) and the financing of this project; and - 4. That the appropriate staff ofthe City of Pickering be given authority to give effect thereto. CARRIED Recorded Vote: Yes: Councillors Brenner, Holland, Johnson, Pickles, Ryan and Mayor Arthurs. Councillor Johnson declared an interest in the matter concerning the application of the Uxbridge Conservation Association to the Ontario Trillium Foundation as he is involved in litigation concerning the Uxbridge/Pickering Townline and Sideline 8. He left the Council Chambers prior to the discussion returning after Resolution #174/01 was considered. Resolution #174/01 Moved by Councillor Brenner Seconded by Councillor Pickles 1. That the Council of the City of Pickering having reviewed the application of the Uxbridge Conservation Association to the Ontario Trillium Foundation, hereby advises that the application has the support of the City of Pickering as it relates to those portions of the Trans Canada Trail in Pickering. - REFERRED TO STAFF FOR ADDITIONAL INFORMATION Council considered the following motion in conjunction with the above resolution: Resolution #174/01(a) Moved by Councillor Holland Seconded by Councillor Ryan 1. That the above resolution be referred to staff to seek input from the Federal Government and from the Solicitor for the City, and report back to Committee on January 14, 2002. CARRIED Resolution #175/01 Moved by Councillor Brenner Seconded by Councillor Holland .- WHEREAS the Council of the Corporation of the City of Pickering enacted By-laws 5476/99, 5477/99 and 5478/99 to amend the urban area Comprehensive Zoning By-laws 2511, 2520 and 3036, respectively, with the intent to allow various types of commercial vehicles that are deemed appropriate or compatible due to their size to park off-road in urban residential areas; and WHEREAS the effect of these amendments was to allow tow trucks, that are not considered to be in character with a quiet residential neighbourhood, to park off-road in urban residential areas; and - 3 - Council Meeting Minutes Monday, December 17,2001 8:00 p.m. WHEREAS the off-road parking regulations established by the amendments should be re-examined based on feedback over the past two years from residents who have expressed that tow trucks are not appropriate in residential areas; .-. NOW THEREFORE the Council of the Corporation of the City of Pickering hereby directs the Director, Planning & Development to prepare a report prohibiting tow trucks in urban residential neighbourhoods; and FURTHER THAT the Director, Planning & Development report back to Council no later than March 31, 2002 on this matter. (IV) BY-LAWS That Councillor Brenner, seconded by Councillor Pickles, took leave to introduce by-laws of the City of Pickering: By-law Number 5928/01 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan ofthe City of Pickering District Planning Area, Region of Durham in Part of Lot 122 and 123, Plan 1051, in the City of Pickering. (A 2/94, 18T-93018) - By-law Number 5929/01 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the City of Pickering District Planning Area, Region of Durham in Part of Lot 20, Concession 2, in the City of Pickering. (A 28/00) By-law Number 5930/01 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the City of Pickering District Planning Area, Region of Durham in Part of Lot 29, Range 3, B.F.C., City of Pickering. (A 8/00) By-law Number 5931/01 Being a by-law to delegate certain authority under the Planning Act to the Director, Planning & Development Department. By-law Number 5932/01 - Being a by-law to delegate the powers of the Head to the City Clerk and the Solicitor for the City under the Municipal Freedom of Information and Protection of Privacy Act. By-law Number 5933/01 Being a by-law to amend By-law Number 3665/91 to govern the proceedings of Council, any of its committees, the conduct of its Members, and the calling of meetings. By-law Number 5934/01 Being a by-law to amend By-law 5419/98 to amend the scope of signing services fees. - 4 - Council Meeting Minutes Monday, December 17, 2001 8:00 p.m. By-law Number 5935/01 - Being a by-law to appoint By-law Enforcement Officers for certain purposes (Parking Regulation DCC 93, 1890 Valley Farm Road). By-law Number 5936/01 Being a by-law to appoint By-law Enforcement Officers for certain purposes (Parking Regulation Pickering T own Centre) CARRIED THIRD READING: Councillor Brenner, seconded by Councillor Pickles, moved that the report of the Committee of the Whole on By-law Numbers 5928/01, 5929/01, 5930/01, 5931/01, 5932/01, 5933/01, 5934/01, 5935/01 and 5936/01, be adopted and the said by-laws be now read a third time and PASSED and that the Mayor and Clerk sign the same and the seal ofthe Corporation be affixed thereto. CARRIED (V) OTHER BUSINESS 1. Councillor Brenner advised that the Regional draft Smoking by-law was passed at the Health & Social Services Committee and will go forth to Regional Council in January. Councillor Brenner also noted that the Municipality of Clarington has posted a question on their website regarding the draft by-law to seek input from residents. - 2. The Mayor and Council passed on their best wishes for the holidays to staff and residents. 3. The following matters were discussed prior to the regular meeting: a) Councillor Ryan advised that the Race Relations Committee has partnered with three schools and will be conducting an event on February 28th in the Council Chambers. b) The Chief Administrative Officer advised he would be on vacation for the next two weeks, returning to work on January 2,2002. CHIEF ADMINISTRATIVE OFFICER REPORT CAO 10-01 NUCLEAR EMERGENCY PUBLIC ALERTING DUKE ENGINEERING - PRELIMINARY DESIGN REPORTS 1. That Report to Council CAO 10-01, concerning the Preliminary Design Reports by Duke Engineering for the 3 kIn Contiguous Zone and the 3-10 kIn Primary Zone around the Pickering Nuclear Generating Station (PNGS), be received; and 2. That Council reaffirm its commitment to public alerting throughout the entire 10 kIn Primary Zone around PNGS; and 3. That Council endorse the Preliminary Design Report for the 3 kIn Contiguous Zone as the basis for implementing a public alerting system within this zone; and 4. That Council endorse the Preliminary Design Report for the 3-10 km Primary Zone as the basis for implementing a public alerting system within this zone, and that on the basis of the Duke Engineering Report, Council advise that it is open to other options for alerting within the Primary Zone so long as the intent of alerting within this zone is met and that funding no fall to the Region or the City; and 5. That a copy of this Report be forwarded to the Solicitor General and Minister of Correctional Services, and that the Province be urged to: - a) accept the Duke Engineering Preliminary Design Report for the 3 km Contiguous Zone so that implementation can begin immediately; and b) amend the Interim Provincial Nuclear Emergency Plan to require public alerting to extend to the entire 10 km Primary Zone; and c) accept the Duke Engineering Preliminary Design Report for the 3-10 km Primary Zone or propose an alternate solution so that public alerting can be extended to this zone. 2.
