Lloyd Thomas, representing the Whitevale & District Residents Association, advised Members of Council of a petition signed by residents of Whitevale requesting that the Ontario Realty Corporation not consider the demolition of a building in Whitevale that was damaged by fire on December 23rd. He advised that the resident wishes to return to her home and that the Association wants to work with the ORC and the City of Pickering to repair the damage so this is possible. (III) MA TTERS FOR CONSIDERATION 1. PLANNING & DEVELOPMENT REPORT PD 04-02 ZONING BY-LAW AMENDMENT APPLICATION A 33/00 802226 ONTARIO LIMITED PART OF LOT 18, CONCESSION 1 PARTS 6-8, 12, 13, PLAN 40R-I0635 (1048 TOY AVENUE) Approved as Amended by Deletim!: 1.0(a) from Appendix I See Recommendation #1 a) Michael Nunes, Sonic Automobile, questioned why, after eleven years, has it just been realized that the use on this property is not conforming to the zoning by-law. He stated his concern that both buildings on this property will be zoned to contain mechanical use and that both buildings will contain garbage disposal. He also stated his concern with parking. Planning Committee Meeting Minutes Monday, January 14, 2002 7:55 p.m. Chair: Councillor Johnson b) Charles Wiltshire, 1048 Toy Avenue, advised that when he purchased the property eleven years ago he new the zoning was for truck repairs but only realized, due to notification from MTO, that car repairs were not under the present zoning. c) The General Manager at 1048 Toy Avenue, advised that waste handling will only take place in the rear building. 2. PLANNING & DEVELOPMENT REPORT PD 0102 ZONING BY-LAW AMENDMENT APPLICATION A 19/97(ROl) CHRISTOPHER SPEIRS LOTS 15, 16 AND 17, PLAN 21 430 WHITEV ALE ROAD Approved See Recommendation #2 1. Jim Thompson, resident at the corner of Mill St. and Churchwin St., stated that the Planning Report does not address the concerns of the residents and until this occurs the application is premature and should not be dealt with. 2. Charles Sopher, 440 Whitevale Road, lives adjacent to the subject property and requests that this application be tabled until the concerns of the residents are addressed. 3. Marion Thomas, Whitevale, advised that this property blocks the Seaton Trail and unless you trespass you can't access the trail to the north. She suggested that land must be available for exchange for Mr. Speirs property. 4. Chris Speirs, owner and applicant, stated that the trail still operates even with the purchase of his property. He further stated that the property at the rear of his land is a greenbelt and not a parking lot. He wants to improve the appearance of this property with landscaping, ref acing the existing building and building a new home. 5. Laurie Humphries, Altona Road, advised that she uses the Seaton Hiking Trail and the north end of the trail has been cut off since the property was sold. 6. Janice Locke, Whitevale, advised that she has spent a lot of time on the trail but since the property was sold, access through the Speirs land is cut off. She also advised that parking has always been allowed on the property to the rear of the Speirs land. 3. PLANNING & DEVELOPMENT REPORT PD 05-02 ZONING BY-LAW AMENDMENT APPLICATION A 13/99 E. MATTACCHIONE AND M. LAPOSTA LOTS 14 AND 15, PLAN 489 1210 AND 1218 KINGSTON ROAD (NORTH SIDE OF KINGSTON ROAD, EAST OF WALNUT LANE Approved Part 1 Lost Part 2 See Recommendation #3 1. Doug Howard, 775 Storrington St., stated that he is encouraged with some of the changes but further stated his concern with the consideration of a future road, what type of ownership is planned and if consideration has been given to fencing along the back of the property. He also advised that informing residents of future applications must be addressed as many area residents were not aware of this meeting. He advised that they have attempted to address issues raised by residents 3. Paul Howard, 1769 Storrington St., advised that he had not been notified of any meetings. He stated that he would be more supportive of condominiums and further stated his concern with the future roadway and consideration for fencing. 4. Kathy Keller, Storrington St., advised that she also was not notified of the meeting and added that she is pleased with the adjustments made by the applicant. 4. PLANNING & DEVELOPMENT REPORT PD 06-02 ZONING BY-LAW AMENDMENT APPLICATION A 14/01 MARSHALL HOMES (ALTONA) LTD. ON BEHALF OF M. 1. MITCHELL AND M. L. PYPER LOT 6 AND PART OF LOTS 3, 4 AND 5, PLAN 506 314-350 FINCH AVENUE (NORTH SIDE OF FINCH AVENUE, EAST OF ALTONA ROAD) Approved As Amended In Appendix I & II to Implement The Chan2es ReQuested by the Applicant See Recommendation #4 1. Craig Marshall, representing applicant, thanked Planning for bringing this forward but requested changes be made to Appendix I as follows: a) Condition 2.1.1 be amended by adding: Applicants Revised Plan (Attachment 3); b) Condition 2.3.6(b)(i) be deleted in its entirety; c) Condition 2.3.12.c, replace the word "bungalow" with "dwelling"; and Appendix II be amended as follows: a) insert l.a.xiii, "Porches shall be permitted to encroach in the minimum front yard, side yard, and flankage side yard widths"; b) an end xi by adding: "The construction of four model homes shall be permitted under this by-law." 2. Laurie Humphries, Altona Road, stated she would like to see more open type streetscape and suggested deer crossing signs be erected. 3. Philip Stotart, 2005 Altona Road, advised that Craig Marshall has been great with his time, providing lots of opportunity for meetings. He stated his support of the application but concern with well interference and possible damage to foundation and concrete pad. 5. That in accordance with section 34(17) of the Planning Act and notwithstanding that the rezoning proposed in the public meeting notice, public meeting report and at the public meeting differs to some degree from that presented in the report of the Director, Planning & Development, dated January 7,2002, Planning Report Number PD 06-02, such difference are not substantial enough to require further notice and another public meeting. 5. (a) That Zoning By-law Amendment Application A 19/01, initiated by the City of Pickering, on lands being Part of Lot 17, Concession 1, on the west side of Notion Road in the City of Pickering, to permit a range of prestige and higher order mixed employment uses, be APPROVED; (b) That the draft by-law to amend Zoning By-law 3036, as amended, to permit a range of prestige and higher order mixed employment uses including related development standards, as specified in Appendix II to Report Number PD 02-02 be FORWARDED to Council for enactment; 4. That the revised Notion Road Area Development Guidelines, be ADOPTED as the City's strategy for detailed land use, urban design, transportation and infrastructure within the Notion Road Area, as set out in Appendix III to Report Number PD 02-02; 5. That "Informational Revision 10 to the Pickering Official Plan" be ADOPTED, as set out in Appendix IV to Report Number PD 02-02; 6. (a) That Pickering Official Plan Amendment Application OP A 87-002/P, submitted by Silwell Developments Limited & Berma Estates Limited (now the Metrontario Group), on lands being Part of Lot 17, Concession 1, City of Pickering, to amend the Pickering District (Official) Plan from Light Industrial to Medium Density Residential be REFUSED, and the applicant be so advised; (b) That Zoning By-law Amendment Application A 5/87, submitted by Silwell Developments Limited & Berma Estates Limited, on lands being Part of Lot 17, Concession 1, City of Pickering, to amend Zoning By-law 3036 to permit townhouse residential dwellings be REFUSED, and the applicant be so advised; 7. That the City Clerk be directed to forward a copy of Report Number PD 02-02 to the Clerk of the Region of Durham, the Clerk of the Town of Ajax, the Toronto and Region Conservation Authority and to the Metrontario Group.
