HomeMy WebLinkAboutJune 17, 1999 STATUTORY PUBLIC INFORMATION MEETING MINUTES A Statutory Public Information Meeting was held on Thursday, June 17, 1999 at 7:00 p.m. in the Council Chambers. PRESENT: C. Rose - Manager, Policy Division L. Taylor - Manager, Current Operations Division V. Rodrigues - Senior Planner G. McKnight - Planner 2 D. Kearns - Committee Co-ordinator The Manager, Policy Division, provided an overview of the requirements of the Planning Act and the Ontario Municipal Board ,respecting this meeting and matters under consideration thereat. (I) DURHAM REGIONAL OFFICIAL PLAN AMENDMENT APPLICATION 99-004/D, PICKERING OFFICIAL PLAN AMENDMENT APPLICATION 99-003/P, ZONING BY-LAW AMENDMENT APPLICATION A 1/99 M. AND R. GUY - PART OF LOTS A & 1, CONCESSION 9 (5240 LAKE RIDGE ROAD,NORTH OF REGIONAL ROAD 5) 1. Valerie Rodrigues, Senior Planner, provided an explanation of the application, as outlined in Information Report#13-99. 2. Bob Martindale, Planning Consultant representing the applicant, commented that the overall tenure of the report appears to be quite negative. All residents approached concerning the application were in support. He advised that he will be contacting the MOE questioning what is missing in the hydrogeological report. An Environmental Impact Study has already been undertaken. The Central Lake Ontario Conservation Authority will be participating in the environmental study. An archaeological study will be undertaken. 3. Lois James, 2270 Meadowvale Road, Scarborough, member of Save the Rouge and Save the Oak Ridges Moraine Conservation, stated her opposition to this application. She questioned if a statement has been received from either of these organizations concerning this item. 4. Richard Ward, 3709 Regional Road 9, Orono, stated his concern with respect to process and procedure. He questioned when the Town received this application and why it was heard at the Region of Durham first. 5. Bob Martindale, Planning Consultant representing the applicant, stated that the applications were complete when submitted, but were submitted out of order. (II) OFFICIAL PLAN AMENDMENT 99-002/P ZONING BY-LAW AMENDMENT APPLICATION A 9/99 BEARE ESTATE PART OF LOT 34, CONCESSION 2 (PART 1, 40R-11934) (NORTH SIDE OF FINCH AVENUE OPPOSITE WOODVIEW AVENUE) 1. Geoff McKnight, Planner 2, provided an explanation of the application, as outlined in Information Report#11-99. 2 2. Pierre Boiron, representing the applicant, advised that Minutes of Settlement had been signed which allowed the boundary between Open Space and Residential Community altered. The TRCA have stated that wetlands cannot be touched. The two buildings will be lowered to provide for wider green area. They disagree that they are over density in their application. 3. Richard Ward, 3709 Regional Road 9, Orono, stated his opposition to anything happening on this property as it is situated in the middle of the Rouge Duffins Corridor. 4. Pam Fulford, Rouge Park Alliance, has spoken with the biologists and planners of TRCA and support their comments concerning this application. This property is Provincially significant wetland which houses numerous wildlife and fowl. The Region of Durham has requested that the TRCA and the Ministry of Natural Resources participate in this process. The environmental study should include adjacent lands of a radius of 120 metres which has been recommended by the Ministry of Natural Resources. 5. John McKenzie, Save The Rouge Valley System, stated that this is not a good proposal and a settlement must be worked towards which would see no development on the property. 6. Dan Casselman, Rouge River Restoration Committee, stated his strong opposition to this application. He advised that he is involved in a study of Amos Pond and outlined the number of species and population present at the pond and the detrimental affect this application would have on this area. This area should be designated as Environmentally Sensitive Area and Provincially Designated Wetland. Amos Pond is part of the Townline Swamp Chain and a crucial wildlife corridor. 7. Sarah, involved in the study of Amos Pond, commented on the number of frogs, turtles and Canada Geese she sees at the pond. She requested that this area not be developed. 8. Laurie Humphries, 2026 Altona Road, stated her discouragement of the whole process. She advised that this is a migratory property on which she has seen snapping turtles and deer. She does not understand why the application is being considered. 9. Maxine Crook, Toronto, stated her opposition to the proposal, advising that it would have a negative impact on the wetland. 10. Glen deBaemaker, Save The Rouge Valley System, stated his total opposition to the application. He stated that his organization will be sending out letters, flyers, making calls and knocking doors to advise everyone of this application. He made the following points: a) request comments from the Ministry of Natural Resources and Ministry of Municipal Affairs. b) examine impact of ground water, recharge functions. c) examine area in light of Rouge Duffins Corridor. d) request that the Ministry of Natural Resources and Planners look at policies concerning significant wetlands. e) hire an independent consultant to review environmental study, species, forest and wetland restoration. 1) plan for next 1,000 years. g) thought building was not permitted within so many metres of dump. h) consider what will happen to ability of pond to sustain life and provide recreation for residents. 3 11. Chris Warden, 512 Charnwood Crt., stated that he is a member of the study team and his son is an avid frog watcher. He advised that wetlands are becoming increasingly rare. 12. A gentleman questioned how people will get to the development and how kids will be kept away from the wetland. Roads will need to be built which will affect the park. 13. A resident of 28 Birmingham Cres., stated his concurrence with all previously stated concerns respecting wetlands and habitat. This development would negatively impact Amos Pond. He stated his opposition to the application. 14. Gerald McKeown, stated his strong opposition to the amendment and application. He advised that this is an environmentally significant area. 15. A resident of Peterborough, commented on the human impact on the development, increased garbage, traffic, activities, all of which will have a negative impact on the wildlife. He stated his opposition to this application. 16. Joe Pascoe, 1862 Woodview Ave., advised of his opposition to development in this area. He stated his concern with increased traffic, commenting on the traffic problems already encountered on this road. 17. Bill Neil, 1897 Woodview Ave., stated his opposition to the application. He questioned how units can be built on a swamp. He commented on the western boundary and asked how you build halfway through a pond. 18. Lois James, 2270 Meadowvale Road, questioned why more area was not notified of this application, which is inappropriate for the site. She stated that the Planning Department has an obligation to change the process. 19. Pierre Boiron, representing the applicant, stated that this application will have no impact on Amos Pond. All residents of this development must be over 55 years of age, so children would not impact the wetlands. This is not a flood plain, therefore, there would not be flooding on the site. Little traffic will be generated from the site. 20. Tom Young, Senior Biologist with the applicant, advised that development will not occur in the wetland marsh or in the red maple swamp. The area was quarried approximately 80 years ago, therefore, there is no nutrition for the trees. If the Town, residents and applicant work together, this could be a win/win situation. 21. Ross Norris, Planner for the applicant, requested that a meeting be held with the various organizations represented to discuss the application. He advised that the ditch was created long before they became involved with the site. A residents meeting was held on June 7th at E.B Phin Public School to discuss this application. They intend to work closely with the TRCA. 22. Cathy Rose, Manager, Policy Division, outlined the areas which are still under review. She advised that each application starts it's own process and that notification is given within a 120 metre radius of the subject lands. 4 (III) ZONING BY-LAW AMENDMENT APPLICATION A 4/99 STEELE VALLEY DEVELOPMENTS LIMITED (CANADIAN TIRE) PART OF LOT 18, CONCESSION 1 (40R-10331, PARTS 1 TO 6) (SOUTHEAST CORNER OF BROCK ROAD AND PICKERING PKWY) 1. Lynda Taylor, Manager, Current Operations Division, provided an explanation of the application, as outlined in Information Report#9-99. 2. The Planning Consultant, representing Canadian Tire, was present to answer any questions. 3. Terry White, Chairman, Brock East Community Assoc., stated that their major concern is with respect to vehicular traffic. Intensification will increase the problem already being experienced with traffic as well as the termination of Hwy. 407 at Brock Road. Propane tower, gas bar and carwash does not fit urban image. He stated their opposition to this application. 4. Richard Ward, 3709 Regional Road•9, Orono, advised that he shares the concerns of the Brock East Community Assoc. He also advised that the most northerly entrance to this site should be eliminated due to the congestion on Brock Road which could occur. 5. The Planning Consultant, representing Canadian Tire, stated that this application is simply for the gas bar. •Traffic studies of the area have been undertaken and ongoing discussions are taking place for the realignment of Pickering Parkway. 6. Lynda Taylor, Manager, Current Operations Division, advised that traffic flow is being reviewed and polices will be looked at. (IV) ZONING BY-LAW AMENDMENT APPLICATION A 7/99 R. GOSLING PART OF LOT 24, AND LOTS 25 - 27,PLAN 21 (WHITEVALE MILL, SOUTH SIDE OF WHITEVALE ROAD) 1. Lynda Taylor, Manager, Current Operations Division, provided an explanation of the application, as outlined in Information Report#12-99. 2. R. Gosling, applicant, advised that he wishes to utilize the existing building and the present septic tank and no grading changes are planned. The pesticides on the property were stored in the transport truck which has been removed. 3. •Jim Thompson, 437 Churchwin Street, questioned if the current zoning is lifted are there any restrictions on usage of the mill, would the applicant be required to apply to the Town for a change in usage. He also questioned what the capacity is of the sewage and septic systems, how the creek will be protected from run-off and what is considered a small engine. 4. Gord Willson, 455 Whitevale Road, advised that he has no objection to the application but outlined his concerns with respect to: vagueness of the application, how much honey, what is concerned a small engine and the noise and traffic impact. 5 (V) OFFICIAL PLAN AMENDMENT APPLICATION 99-001/P DRAFT PLAN OF SUBDIVISION 18T-98018 ZONING BY-LAW AMENDMENT APPLICATION A 6/99 BOPA DEVELOPMENTS INC. PART OF LOT 33, CONCESSION 1 (SOUTHWEST CORNER OF FINCH AVENUE AND ALTONA ROAD) 1. Geoff McKnight, Planner 2, provided an explanation of the application, as outlined in Information Report #10-99. • 2. Vijay Gupta, representing Bopa Developments, advised that the creek will be left as open space and the top-of-bank has been set by a surveyor. The road pattern has been developed based on talks with the Town of Pickering and the Region of Durham. 3. Richard Ward, 3709 Regional Road 9, Orono, advised that he has no objection to this property being developed. The Environmental Statement is only a page, an Environmental Impact Study is required. Leachate run-off from the Beare Dump Site should be included in the study. 4. Patrick Mealiffe, 220 Finch Avenue, stated his opposition to this application advising that there are too many subdivisions of this calibre. He questioned if the proposed park will be created or is it just being considered. 5. Bill Neil, 1857 Woodview Ave., questioned why this application is being considered if the study still must be undertaken and does this application meet guidelines. 6. Cathy Rose, Manager, Policy Division, advised that the area proposed for the park may be wetlands and may not fit the criteria, also a school•may be required. The Rouge Duffin Wildlife Corridor was expanded to include all lands designated as Open Space in Official Plan. (III:) ADJOURNMENT . The meeting adjourned at 10:15 p.m. • Dated J U N E / 4 9 5" Clerk
