HomeMy WebLinkAboutBy-law 7128/11 The Corporation of the City of Pickering By-law No. 7128/11 Being a By-law to exempt Block' 18 on Plan 40M-1827, Pickering, from the part lot control provisions of-the Planning Act. Whereas Grossi Group Development Inc., the owner of Block 18, Plan 40M-1,827, intends` to obtain approval of and register a common elements condominium plan; And Whereas it is intended that the owner or owners of each of the 12 dwelling units will own the. parcel of tied land on which his, her or their dwelling is located in fee simple, and will also be a member or members of the common elements condominium corporation; And Whereas it is'intended that the parcels of tied lands on-which the 12 dwellings are to be constructed will be subdivided by means of an exemption from the part lot control provisions of the Planning Act, R.S..O. 1990, chapter P.13; Now therefore the Council of The Corporation of the City of Pickering enacts as follows: 1. Section 50(5) of the Planning Act, R.S.O. 1990, chapter P.13, shall cease to apply, to Block 18, Plan 40M-1827 upon: (a) registration of this By-law,in the Land Registry Office for the Land Titles Division of Durham (No. 40); and (b) registration of a restriction, pursuant to Section 118 of the Land Titles Act, R.S.O. 1990, chapter L.5, requiring the consent of the Solicitor for The Corporation of the City of Pickering-to the registration of any transfer or charge of Block 18, Plan 40M-1827 or any part or parts thereof in the Land Registry Office for the Land Titles Division of Durham '(No. 40). 2. This By-law shall remain in force and effect from the date of the passing of this By- law and shall expire on September 28, 2012.
