HomeMy WebLinkAboutBy-law 7126/11 The Corporation of the City of Pickering By-Law No. 7126/11 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the City of Pickering, Region of Durham in Part of Lot 16, Plan 228, in the City of Pickering. (A 8/10) Whereas the Council, of The Corporation of the City of Pickering deems it desirable to rezone the subject property, being Part of Lot 16, Plan 228, in order to permit the creation of two lots for detached dwellings; And whereas an amendment to By-law 3036, as amended, is therefore deemed necessary; Now therefore the Council of The Corporation of the. City of Pickering hereby enacts as follows: 1. Schedule "I" Amendment -Schedule I" to By-law 2912/88 amending By-law 3036, is, hereby amended by changing the current 'R3' zoning designation to 'R4' as shown on Schedule "I" attached hereto. 2: Text Amendment Section 10 - Residential Detached Dwelling Zone - R4 is hereby amended by adding the following paragraph after subclause 10.3.6(i): 10.3.6(i)A Part of Lot 16, Plan 228 Despite the obstruction of yards requirement of 5.7(b) and front yard requirement of 10.3.6(i), the minimum front yard requirement to the southerly building existing at the time of.the passing of the by-law shall be 13.0 metres and the existing uncovered platform attached to the southerly existing building may project a maximum of 1.0 metre into the front yard. 3. By-Law 3036 By-law 3036 is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as set out in Section 1 and -2 above. Definitions and subject matters'not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3036, as amended. By-law No. 7126/11 Page 2 4. ':Effective Date This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
