<br /> <br /> <br /> <br /> <br /> THE CORPORATION OF THE CITY OF PICKERING <br /> <br /> BY-LAW NO. 7110/11 <br /> <br /> A by-law to prohibit or regulate livestock/exotic animals. <br /> <br /> WHEREAS Section 11(3) of the Municipal Act, 2001 authorizes the City to pass by-laws <br /> respecting animals; and <br /> <br /> WHEREAS Section 151 of the Municipal Act, 2001 authorizes the City to provide fora <br /> system of licences with respect to any business wholly or partly carried on within the <br /> City; and <br /> <br /> WHEREAS. Section 103 of the Municipal Act, 2001 authorizes the City to pass a by-law to <br /> provide for the seizure and impounding of animals and the sale of impounded animals <br /> under certain conditions. <br /> I <br /> NOW THEREFORE'THE COUNC)L OF THE CORPORATION OF THE CITY OF <br /> PICKERING HEREBY ENACTS AS FOLLOWS: <br /> <br /> <br /> PART I - INTERPRETATION <br /> <br /> Definitions <br /> <br /> 1. In this by-law,. <br /> <br /> "agricultural zone" means a property defined as agricultural under the City's <br /> Zoning By-laws and of a minimum size of five (5) acres; <br /> <br /> "animal" means any member of the animal kingdom, other than a human, dog or <br /> cat; <br /> <br /> "Animal Services Officer" means a municipal law enforcement officer employed by <br /> the City to enforce municipal by-laws; <br /> <br /> "at large" means when an animal is found.in anyplace other than the premises of <br /> the owner, and not `under the physical control of any person, unless prior consent <br /> is given by the person owning the premises on which the animal is found; <br /> <br /> "City" means The Corporation of the City of Pickering or the geographic area of the <br /> Cityof;Pickering, as the context requires; <br /> <br /> "domestic" describes an animal that has been tamed by humans and has, through <br /> selective breeding, become notably different from its wild ancestors, and includes <br /> an animal derived from self-sustaining captive populations; <br />
