Paterson Director, Corporate Services & Treasurer DATE: September 17,2001 REPORT NUMBER: APT 03-01 SUBJECT: Ajax/Pickering Transit Authority - Subscription Policy RECOMMENDATION: It is recommended that Report APT 03-01 of the Director, Corporate Services & Treasurer, City of Pickering, be received and that be it hereby resolved that the Ajax Pickering Transit Authority accept the agreement of the Subscription Policy to insure the liability assumed by the Resolution as follows: The Ajax Pickering Transit Authority hereby 1. Assume the Liability for bodily injury to or death of any person or damage to or destruction of property of others, imposed by law upon: - a) Board Members, Employees or Volunteer Workers of the Ajax Pickering Transit Authority for Liability which arises out of the use or operation by such person of a licensed motor vehicle, or b) the owner of any licensed motor vehicle, for liability which arises out of the use or operation of such licensed motor vehicle by Board Members, Employees or Volunteer workers or the Ajax Pickering Transit Authority. 2. Declares that such assumption of liability be subject to the following limitations, exclusions and conditions: a) This assumption of liability applies only to the use or operation of a licenced motor vehicle in Canada or the United States of America by Board Members, Employees or Volunteer Workers on behalf of the Ajax Pickering Transit Authority including travel to and from work and attendance at meetings. b) This assumption of liability applies only in excess of existing insurance carried by the owner of the licensed motor vehicle which was being used or operated by Board Members, Employees or Volunteer Workers at the time of the accidence and does not apply unless the licensed motor vehicle which was being used or operated by such person at the time of the accident is insured for not less than the minimum Third Party Liability Limit required by The Insurance Act for the Province of Ontario. c) This assumption of liability is subject to the agreements, conditions, terms and limit of liability insured in the Non-Owned Automobile Policy issued by the Subscription Policy and shall terminate whenever such Non-Owned Automobile Policy is terminated. - ORIGIN: Director, Corporate Services & Treasurer Report to Ajax/Pickering Transit Authority Date: September 17, 2001 - Subject: Ajax/Pickering Transit Authority - Subscription Policy Page 2 AUTHORITY: The Municipal Act, R.S.O. 1990, as amended, and Regulations FINANCIAL IMPLICA nONS: The cost of this Contractual Liability Extension has been included in the premiums for the coverages previously purchased as contained in Report APT 02-01 ofthe Treasurer. EXECUTIVE SUMMARY: Not applicable. REPORT: In order for the Contractual Liability Extension (SEF #96) under the Non-Owned Automobile Policy the foregoing Resolution must be passed by the Board. - This extension provides coverage for Board Members and employees extended coverage while driving their own vehicles on Board business. It is recommended that this be approved as it offers Board Members and employees that same level of coverage, while driving their own vehicles on Board business, as that provided while driving Board vehicles on Board business. However, in any claims situation it is always the insurance of the owner of the vehicle that applies first. This coverage would be in excess of that should the need arise. General Manaqer - Meeting Minutes Ajax / Pickering Transit Board of Directors Tuesday, September 18, 2001 Page 2 1) Update on Implementation Matrix: Ted reported that the implementation schedule is now in phase 4. Ted reviewed the rank legend for the Board from complete to unacceptable. 205 of 319 identified issues have been dealt with. Ted reviewed the matrix for those in attendance. Ted noted recent bus fires and the models which have been pulled offthe road. Other issues included IT TV. Consideration will be given to the format of meetings in the future under the Municipal Act. Ted noted that the internal teams have been very busy since the last meeting. 2) Schedule fo Meetings - Year End 200 I - The last page ofthe implementation matrix outlined the meeting dates for the remainder of the year. 3) Regional Bench Agreement A report to the APT A Board was circulated for information. The report recommends that it be received and that the General Manager be authorized to execute agreements with the Region of Durham to license the installation of transit rental benches. Moved by: Mayor Parish Carried. 4) Resolution for Participants in OMERS - Ajax Pickering Transit Authority. Moved by Steve Parish Carried. - a) Ajax / Pickering Transit Authority Report to Board .- Meeting Minutes Ajax / Pickering Transit Board of Directors Tuesday, September 18, 2001 Page 3 The report outlined and recommended the acquisition ofliability insurance to the Board and all of it's employees. The premium would be for 12 months. Moved by: P. Brown. Carried. 1) Gil circulated a report to the Board entitled Ajax / Pickering Transit Authority dated September 17, 2001 Moved by: M. Correspondence a) Letter to Bev Reed, WSIB dated August 31, 2001 from William LeMay. 2) Letter to Ted Galinis dated September 11,2001 from Tobin Robbins, Media Out-of-Home Advertising 3) Media release dated September 11,2001 entitled "Transit Service Meeting GO Rush Hour Service". 4. Scheduling of Next Meeting The next meeting of the Ajax-Pickering Transit Board of Directors is scheduled for 4:30 p.m., Tuesday, November 27,2001 at Pickering. 5. Other Business and Direction Jim suggested a reporting strategy to both Councils. - 6.
