That Report OES 19-07 of the Director, Operations & Emergency Services regarding a proposed amendment to the municipal traffic by-law 6604/05 be received; and 2. That the attached draft by-law be enacted to amend Schedule "2" to By-law 6604/05 to provide for the regulation of parking on Highways or parts of Highways under the jurisdiction of the Corporation of the City of Pickering and on private and municipal property. Executive Summary: In response to concerns with roadway traffic flow difficulties and poor sightlines due to vehicular on street parking along Sunbird Trail, the City was asked to implement parking restrictions through a "no parking" by-law in order to ensure a clear travel path and unobstructed visibility. As a component of the review, staff completed an extensive community consultation process resulting in various suggested alternatives from residents ranging from no on street parking restrictions, to extensive enforcement of the maximum 3 hour parking limit, to parking restrictions along the full limit of Sunbird Trail. Having completed the review, staff confirm the difficulties expressed by the area residents and, in support of the request, propose to amend the existing traffic by-law to incorporate partial on street parking restrictions on Sunbird Trail according to the sketches attached. Financial Implications: The acquisition and installation of "no parking" signs is estimated to cost approximately $1500 and can be accommodated within the Roads current budget account 2320.2409. Report OES 19-07 May 14, 2007 C:'; .J Page 2 Subject: No Parking By-law, Sunbird Trail Sustainability Implications: The concerns as presented to and the recommendations as generated by staff address traffic safety issues within the Corporate Healthy society objectives, and the social lens of sustainability. Background: In response to resident concerns as noted to the City's Customer Care Centre, municipal staff were requested to investigate traffic operational concerns and roadway safety as a result of vehicular parking on Sunbird Trail. The complaints noted visibility and dwelling driveway access difficulties caused by on street parking as well as vehicles parking in their respective driveways but within the boulevard (between the sidewalk and the road curb - see sketch attached). Having completed the review, staff confirmed the difficulties but recognized that the area parking demands exceeded the available off street (driveway) capacity as most of the area dwellings provided the minimum 2 parking spaces consisting of 1 garage and 1 driveway space. Understanding that Council was being briefed on a Parking Strategies Discussion Paper in February 2007, staff were reluctant to introduce restrictions prior to this which could possibly conflict with a potential on street parking permit program. Staff therefore initially recommended No Parking restrictions limited to the inside bends on Sunbird Trail. On January 4, 2007, a community consultation notice was issued to area residents. However, the majority of the replies received back from the community indicated a need and support for additional on street parking restrictions to address the vehicular conflicts and difficulties generated by the large number of vehicles parked on the road throughout the area. As the implementation of a permit parking program was not proceeding, a second community consultation notice was distributed on March 5, 2007 which identified parking restrictions on the full limit of the inside loop of Sunbird Trail. The notice provided to the 148 area residents generated 28 replies (a 19% community response) and their support/opposition for the following No Parking variations: Straightaway Alternate Inside Loop Outside Loop Bends Inside & No Only Sides Full Limit Full Limit Only Outside Loop Restrictions Full Limit 3 1 8 0 4 9 3 11% 4% 29% 0% 14% 32% 11% Although the majority of the respondents indicated support for a full on street parking ban, staff (in recognition of the community's need for additional parking) propose limited parking restrictions along alternating sides of Sunbird Trail. The proposed scheme (as illustrated on the attached By-law Appendix 2b), provides a clear visibility and travel zone, safeguards pedestrian generating areas (ie., fronting the community park) while accommodating some on street parking in non sensitive areas. Sunbird Trail ,-. .to. ,..1 Page 3 Also, as community comments indicate some area residents perceive that the area parking problems are a result of the Sunbird Trail development being designed and constructed to a reduced road width standard, this will advise that the project conforms to municipal development design standard P-704 (copy attached) which reflects a typical 8.5m (28ft.) municipal road within a 18.5m (60ft.) right of way accommodating a sidewalk on the exterior boulevard of the road. Although the area properties have narrow side yard setbacks which concentrates the proximity of adjacent dwellings, the large number of vehicles parked along Sunbird Trail reflects that demand exceeds capacity as numerous residents have multiple vehicles but the majority of the properties only have single car garages and therefore can only accommodate a maximum of two vehicles (one in the garage and one in the driveway). Consequently, area residents either park on the road and are subject to municipal by- law enforcement of the maximum 3 hour on street parking provision or initiate other means of accommodating vehicular parking. Due to minimum front yard setbacks and the narrow width of the properties, residents either park sideways within their driveways on the municipal boulevard (the portion of the municipal road allowance between the curb and the streetline or sidewalk if there is one) or construct a driveway expansion/widening which then generates an additional parking space but eliminates the majority of the front yard greenspace (sodded area). This report does not address the specifics nor the pros and cons of the corporate boulevard parking enforcement policy and/or driveway widening practices as they impact the Sunbird Trail community but recommends amendments to the municipal traffic by-law to regulate on street parking in response to resident requests. XXXX/07 Being a By-law to amend By-law 6604/05 providing for the regulating of parking, standing and stopping on highways or parts of highways under the jurisdiction of the City of Pickering and on private and municipal property. WHEREAS, By-law 6604/05, as amended, provides for the regulating of traffic and parking on highways, private property and municipal property within the City of Pickering; and WHEREAS, it is deemed expedient to amend By-law 6604/05 to establish "No Parking" zones along Sunbird Trail. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: 1.
