(II) DELEGA TIONS 1. David Milton introduced Pat O'Brien, Public Affairs and John Murphy from the Power Workers Union of Pickering Nuclear Generating Station. Councillor Dickerson was thanked for bringing this project to their attention and Mayor Arthurs and Members of Council were congratulated for their support of this initiative. A cheque for $15,000 was presented to the Millennium Committee from the Power Workers Union as a sponsor of the Pickering 2000 Millennium Project. .~ 19 (III) MATTERS FOR CONSIDERATION 1. AJAX AND PICKERING JOINT SERVICES STUDY FILE NUMBER -A 2310.26 In a memorandum fTom the Chief Administrative Officer dated February 25, 1999. it is recommended that the Ajax and Pickering Joint Services Study dated February, 1999 which sets out a work program to study and review service areas that may be partnered, be endorsed. NUCLEAR AND NON-NUCLEAR EMERGENCY PREPAREDNESS STATUS REPORT AND REVISED EMERGENCY MEASURES BY-LAW FILE NUMBER -A 2510.01 In a report fTom the Chief Administrative Officer CAO 02-99, it is recommended that the status of Nuclear and Non-Nuclear Emergency Preparedness at the Town, be received and that a new Emergency Measures By-law be adopted by Council. Approved See Recommendation #2 3. PICKERING RECREATION COMPLEX POTTERY STUDIO - LICENCE AGREEMENT FILE NUMBER -D 3310 - In a report fTom the Director of Culture and Recreation CR 01-99, it is recommended that a draft by-law to authorize the execution of a Licence Agreement, for a two year term between Jean Timms and Brian Joseph to permit the continuation of the private operation of instructional pottery programs presently being provided to the public at the Pickering Recreation Complex, be forwarded to Council for enactment. By-law forwarded to Council 4. THROUGH HIGHWAY DESIGNATION SOMERGROVE CRESCENT FILE NUMBER - E 4000 In Public Works Report PW 06-99, it is recommended that a draft by-law to amend By-law 2366/87 to designate Somergrove Crescent as a through highway, be forwarded to Council for enactment. By-law forwarded to Council 5. ROAD DEDICA nON P ART OF LOT 33. CONCESSION 2 (ROAD ALLOWANCE BETWEEN LOTS 2 AND 3) THIRD CONCESSION ROAD FILE NUMBER - E 4000 In Legal Services Report L 12/99, it is recommended that a draft by-law to dedicate Part of Lot 33, Concession 2 (Road allowance between Lots 2 and 3) Third Concession Road as public highway, be forwarded to Council for enactment. APPOINTMENT OF PROCESS SERVERS AS SPECIAL BY-LAW ENFORCEMENT OFFICER FILE NUMBER -A 2111 In Clerk's Report CL 10-99, it is recommended that a draft by-law to appoint three persons as Special By-law Enforcement Officers in order to legally serve documents on defendants be torwarded to Council for enactment. STREET NAMING/ ROAD DEDICAnON 734 KINGSTON ROAD FILE NUMBER - E 4000 In Legal Services Report L 009/99, it is recommended that draft by-laws to name as Delta Boulevard parts of Lot 28, Range 3, B.F.C., and to dedicate parts of Lot 28, Range 3, B.F.C., and parts of Lot 6, Plan 456, as public highway, be forwarded to Council for enactment. By-law forwarded to Council 8. DRAFT PLAN OF SUBDIVISION 18T-98009 ZONING BY-LAW AMENDMENT APPLICAnON A 15/98 CARRA V AGGIO & GAMISCH PART OF LOTS 3 AND 4. PLAN 819 (WEST SIDE OF FAIRPORT ROAD, OPPOSITE BONITA AVENUE) FILE NUMBER - B 2310 ,- In Planning Recommendation Report #2-99, it is recommended that Council recommend to the Region of Durham, that Draft Plan of Subdivision 18T -98009 submitted by Tunney Planning Inc., on behalf of the owners, on lands known as Part of Lots 3 and 4, Plan 819, be APPROVED AS REVISED and that Zoning By-law Amendment Application A 15/98, to implement Draft Plan of Subdivision 18T -98009 as revised. be APPROVED. Approved as amended See Recommendation #3 Gord Hayford, 925 Duncannon Dr., advised that he is attempting to purchase the property adjacent to the subject land and if this occurs five backyards will back onto his new property. He is concerned with the amount of construction material, dust, dirt and garbage that may end up on his property and requested the developer be responsible for fencing these lots to prevent this occurring. Diana Tomlinson, 1901 Spruce Hill Road, speaking on behalf of a number of residents requested that the wording concerning the turning circle under Section 4.1.2 be changed fTom permanent to temporary. This would allow them time to hire an independent environmental planner to study lands to the north. She also requested a further analysis of the trees to the north. Kevin Tunney, Tunney Planning Inc., representing the applicant, requested that the plan submitted by the developer on October 1998 be the one considered. He also stated that his client would be willing to meet with the property owner of 1838 Fairport Road concerning fencing. 21 Scott Staples, 1906 Fairport Road, stated that he wants to ensure this development does not affect the creek. All lots should adhere to the 10 metre setback fTom the top-of-bank and Street A should not be allowed to go over the top-of-bank but should be moved south by approximately fifty feet. He requested that 18 lots be approved rather than 24 for better road layout and protection of the creek. Ivo Rasic, 1874 Fairport Road, stated his support of the staff recommended plan and advised that he feels the second road as proposed is necessary. Tom Hildich, resident, stated that more time and dialogue with the Toronto Region Conservation Authority would assist and residents with their concerns. Brian Freund, 1915 Spruce Hill Road, advised that there are highly sensitive areas within the lands to the north. He stated his support of his neighbours and the Town to collect sufiicient information. Chris Bell, 1911 Spruce Hill Road, stated his vehement opposition to Street B going to the north. He requested Council to reject further development and stop Street B at the cul-de-sac. Andrea Baillargeon, 1906 Fairport Road. stated that this development should not be allowed to encroach on the 10 metre setback. The staff recommended plan removes the parkette, replaces it with a lot and decreases protection of the foxes. She urged that Street B not be extended to the north. 9. DRAFT PLAN OF SUBDIVISION 18T-98005 ZONING BY -LA W AMENDMENT APPLICATION A 10/98 BRODER DEVCO INC. PART OF LOTS 127 AND 128, PLAN 350 (NORTH SIDE OF TOYNEV ALE ROAD, EAST OF ROUGEMOUNT DRIVE) FILE NUMBER - B 2310 - In Planning Recommendation Report #1-99, it is recommended that Council recommend to the Region of Durham, that Draft Plan of Subdivision 18T -98005 submitted by Broder Devo Inc., on lands known as Part of Lots 127 and 128, Plan 350, be APPROVED AS REVISED and that Zoning By-law Amendment Application A 10/98, to implement Draft Plan of Subdivision 18T -98005 as revised. be APPROVED. Approved as amended See Recommendation #4 Dan Coughlan, 433 Toynevale Road, advised that he is not opposed to this development but does have some concerns. The proposed roadway would enter Toynevale immediately east of the Montessori School. Traffic flow and children's safety should be considered. He stated his ongoing concern with trafiic speed on Toynevale and advised that the traffic technician has not addressed issues totally. He requested cooperation fTom the Town and/or the developer on property access. He also advised that the proposed road would create headlights into the bedrooms of the homes presently there. - Myna Walker, 412 Toynevale Road, stated her complete agreement with Mr. Coughlan concerning the street exiting onto Toynevale and suggested that more traffic issues need to be addressed. Noise attenuation needs to be addressed and homes should be restricted to bungalows on Lots 5, 6 & 7. She questioned the status of the fence which was to be erected along the westerly boundary. Scott Kapuscinski, Plantastics Group, advised that his client is in favour of the amendments put forward by Planning staff. 10. 22 ZONING BY-LAW AMENDMENT APPLICAnON A 9/98 PUBLIC WORKS CANADA LAND SEVERANCE APPLICAnONS LD 123/98 - LD 126/98 PART OF LOT 20, CONCESSION 8 (SOUTHEAST CORNER OF CENTRAL STREET AND SIDELINE 20) HAMLET OF CLAREMONT FILE NUMBER - B 2310 - A 9/98 In Planning Recommendation Report #4-99, it is recommended that Zoning By- law Amendment Application A 9/98, submitted by Public Works Canada, on lands being Part of Lot 20, Concession 8. to change the zoning on the subject lands be APPROVED and the by-law forwarded to Council for enactment, and that the request by Claremont Estates Ontario Inc. to permit the creation of residential lots within the lands subject of Zoning By-law Amendment Application A 9/98 through land severance applications to the Durham Land Division Committee, rather than by Draft Plan of Subdivision, be APPROVED. Approved as amended See Recommendation #5 Don Bennett, 5258 Old Brock Rd, stated that they are very pleased about the development of these lands and with the garden suites being allowed. Richard Ward, 3709 Regional Road, Orono, advised that he is opposed to this development. (IV) OTHER BUSINESS 1. Councillor Ryan gave notice that a motion would be coming forward concerning the deposits on spirits and wine bottles. - 2. Councillor Ryan gave notice that a motion would also be commg forward concerning providing improved costs on capital projects. 3. Councillor Dickerson advised that he and Councillor Holland had met with residents in the Maple Ridge Subdivision who back onto Hydro lands. They are questioning when the issue concerning hydro towers will be again discussed by the Hydro Commission. 4. Councillor Dickerson advised that a media representative will be coming to the Town on March 15 to discuss the Millennium Project. 5. Councillor Johnson advised that he had received and would pass on to staff correspondence fÌom a Claremont resident concerning snow removal. 6. Councillor Johnson commented on the memo received fÌom the c.A.O. concerning the meeting in Ottawa scheduled for March 9th. 7. Councillor Johnson apologized to the seniors for not attending the sod turning ceremony on Thursday morning. He questioned if a policy could be put in place to advise all Council members of upcoming events. - 8. Councillor Brenner distributed copies of correspondence concerning the delivery of 8 Orion buses. 9. Councillor Brenner advised of the opportunity being offered by Molson's for a local hero grant. AJAX AND PICKERING JOINT SERVICES STUDY FILE NUMBER -A 2310.26 That the Ajax and Pickering Joint Services Study dated February, 1999 which set out a work program to study and review service areas that may be partnered, be endorsed; and That a committee comprised of Mayor Arthurs and Councillor Brenner along with representatives of the Town of Ajax be established to study and review service areas. 2. NUCLEAR AND NON-NUCLEAR EMERGENCY PREPAREDNESS ST ATUS REPORT AND REVISED EMERGENCY MEASURES BY-LAW FILE NUMBER -A 2510.01 1. That Report to Council, CAD 02-99, regarding the status of Nuclear and Non-Nuclear Emergency Preparedness at the Town, be received. 2. That a new Emergency Measures By-law be adopted by Council as set out in Attachment #1 of this Report. ,-. 3. That a copy of this Report and the Town's Emergency Response Manual be forwarded to the Ministry of the Solicitor General and Correctional Services, Region of Durham, Durham Emergency Measures Office, and the municipalities of Ajax, Whitby, Oshawa, Clarington, Brock, Scugog, Uxbridge and the City of Toronto. 3. DRAFT PLAN OF SUBDIVISION 18T -98009 ZONING BY-LAW AMENDMENT APPLICATION A 15/98 CARRA V AGGIO & GAMISCH PART OF LOTS 3 AND 4, PLAN 819 (WEST SIDE OF FAIRPORT ROAD, OPPOSITE BONITA AVENUE) FILE NUMBER - B 2310 1. That Town Council recommend to the Region of Durham, that Draft Plan of Subdivision 18T -98009 submitted by Tunney Planning Inc., on behalf of the owners, on lands known as Part of Lots 3 and 4, Plan 819, Town of Pickering, be APPROVED AS REVISED, subject to the conditions outlined in Appendix I to Recommendation Report Number 2-99; 2. That Zoning By-law Amendment Application A 15/98, to implement Draft Plan of Subdivision 18T -98009 as revised, be APPROVED, subject to the conditions outlined in Appendix II to Recommendation Report Number 2- 99. ....... 3. That interested residents be provided until May 14, 1999, to conduct an independent review of the potential future northward extension of Street B and that such review be submitted to the Town Planning Department and the TRCA. The review shall examine the environmental impact of extending Street B northerly beyond the boundary of Draft Plan 18T- 98009. 4. a) 2 That any conditions referencing a specific Lot or Block in the Conditions of Approval in Appendix No. I and No. II to Recommendation Report No. 2-99, be amended to reflect the lotting and blocking numbering of the Council Recommended Plan dated March 9, 1999. b) That the following Condition be added: - 2.1.15 That the Region of Durham not give final draft approval to the portion of the plan north of Lot 21, including the turning circle at the end of Street B, until the Town of Pickering confirms that Street B will end in a permanent turning circle as currently illustrated on the Council Recommended Plan, or, alternatively, until the Town forwards a revised recommended plan to the Region of Durham which redesigns this portion of Street B to a temporary turning circle which may accommodate northward extension in the future. c) That Condition 2.3.11 (Fencing) be amended to require the installation of a 1.5 metre wood privacy along the rear lot line of proposed Lots #3 to #7, inclusive, prior to the initiation of any building construction within the draft plan and along the rear of Lots #8 to # 14 inclusive prior to occupancy of any unit erected on Lots #8 to #14. 4. DRAFT PLAN OF SUBDIVISION 18T-98005 ZONING BY-LAW AMENDMENT APPLICAnON A 10/98 BRODER DEVCO INC. PART OF LOTS 127 AND 128, PLAN 350 (NORTH SIDE OF TOYNEV ALE ROAD, EAST OF ROUGEMOUNT DRIVE) FILE NUMBER - B 23 10 - 1. That Town Council recommend to the Region of Durham, that Draft Plan of Subdivision 18T -98005 submitted by Broder Devco Inc., on lands known as Part of Lots 127 and 128, Plan 350, Town of Pickering, be APPROVED AS REVISED, subject to the conditions outlined in Appendix I to Recommendation Report Number 1-99; and subject to the following conditions: 2.3.6 (b) the planting program must include the planting of trees and shrubs adjacent to the west terminus of Street B for privacy and visual enhancement purposes to the satisfaction of the Town: and 2.3.11 (b) the developer shall install a 1.8 metre high chain link fence along the west boundary of the subject lands, to be preceded by temporary protective fencing during initial construction phases; 2. That Zoning By-law Amendment Application A 10/98, to implement Draft Plan of Subdivision 18T -98005 as revised, be APPROVED, subject to the conditions outlined in Appendix II to Recommendation Report Number 1- 99; and subject to the following revisions to 2.0 vii): ~ vii) maximum building height 9.0 metres, except that on Lots 5, 6 and 7 on the Council Recommended Plan, building height will be further restricted to ensure that only bungalow style dwellings may be established; 3 5. ZONING BY-LAW AMENDMENT APPLICATION A 9/98 PUBLIC WORKS CANADA LAND SEVERANCE APPLICATIONS LD 123/98 - LD 126/98 PART OF LOT 20, CONCESSION 8 (SOUTHEAST CORNER OF CENTRAL STREET AND SIDELINE 20) HAMLET OF CLAREMONT FILE NUMBER - B 23 10 - A 9/98 1. That Zoning By-law Amendment Application A 9/98, submitted by Public Works Canada, on lands being Part of Lot 20, Concession 8, Town of Pickering, to change the zoning on the subject lands from "A" - Rural Agricultural Zone to "R6-3" - Detached Dwelling Residential Zone and "OS-HL" - Open Space-Hazard Land Zone in order to permit the development of residential lots for detached dwellings and optional garden suites, on Sideline 20 and a new road extending from Acorn Lane be APPROVED, as set out in the draft amending by-law included as Appendix I to Recommendation Report 4-99; 2. That the amending zoning by-law to implement Zoning By-law Amendment Application A 9/98, as set out in draft in Appendix I to Recommendation Report 4-99, be forwarded to Town Council for enactment with the following revisions to the provisions governing garden suites: I Floor Area (maximum) 65 square metres II Ground Floor Area (maximum) 65 square metres for any structure containing a garden suite III Height (maximum) 5.0 metres, except where a garden suite is constructed as a second floor of a detached garage, in which case the maximum height of the entire structure shall be 6.0 metres. ,- 3. That the request by Claremont Estates Ontario Inc. to permit the creation of residential lots within the lands subject of Zoning By-law Amendment Application A 9/98 through land severance applications so the Durham Land Division Committee, rather than by Draft Plan of Subdivision, be APPROVED. -
