Approved See Recommendation #1 a) b) c) d) e) Dermot Walsh, representing Sean Regan, stated that this application meets the requirements. Mr. Sanders, 1981 Guild Road, expressed his concerns with respect to the compatibility and over development of this area, the increase in traffic, the location of the garbage dumpster and related noise. He raised these issues at the Planning meeting and requested that the area remain single family dwellings. Rob Rollings, 1974 Guild Road, stated his concern with respect to the inappropriateness of an apartment building in this area. Ross Binnel, 1990 Guild Road, expressed his concern with respect to the increased traffic, the garbage dumpster backing onto his property and the overdevelopment of the property. Walter Vander Knokke, 1980 Guild Road, stated his concern with neighbours having to look at three storey buildings. Mayor Ryan advised that February 5th is the United Way Award Ceremony and the City of Pickering have been nominated to receive a Campaign Achievement Award and a Public Sector Award. Councillor Johnson thanked Council and staff for the support over the past 17 years. Councillor McLean advised that the South Pickering Seniors Group raised $573.65 for the Tsunami Relief Fund, which was matched by the Association. He also advised that the Seniors raised $400.00 towards the fight against Alzheimer's. 4 Executive Committee Meeting Minutes Monday, January 24, 2004 7:30 PM Chair: Councillor Brenner 10. Councillor McLean requested the Clerk to bring the letter from the Municipality of Clarington to the next Executive Committee Meeting wherein Council is being asked to endorse the resolution of Clarington Council requesting the Province to implement a four year Council term. Councillor Dickerson gave notice, seconded by Councillor Ashe, concerning public transportation. Councillor Dickerson requested consideration be given to using plows with two blades for better snow clearance. Councillor Brenner congratulated Valley View School for raising $1,000 towards the Tsunami Relief effort. Councillor Brenner requested the Clerk look into the concerns voiced by the Boxgrove Community Association respecting the Environment Assessment of Seaton Lands recommended by Ontario Realty Corporation. Moved by Mayor Ryan Seconded by Councillor Ashe That Members of Council meet in a Closed Session to discuss a matter of potential litigation. PLANNING & DEVELOPMENT REPORT PD 06-05 DURHAM REGIONAL OFFICIAL PLAN REVIEW "RECOMMENDED DIRECTIONS REPORT, OCTOBER 2004" RESPECTING THE NATURAL ENVIRONMENT, COMMERCIAL POLICY AND RURAL RESOURCES That Report PD 06-05 of the Director, Planning & Development be RECEIVED as the City's comments on the "Recommended Directions Report, October 2004" dealing with environment, commercial and rural policy components of the Durham Regional Official Plan Review; and That Regional Planning staff INCORPORATE the results of the City's Growth Management Study and related amendment to the Pickering Official Plan (Amendment 13) in the Durham Regional Official Plan in finalizing the "Recommended Directions Report" for Population, Employment and Land Supply; and That in formulating agricultural designations, a vibrant and economically productive "countryside" vision is more appropriate for Pickering's rural area than the strict agricultural vision proposed in the "Recommended Directions Report, October 2004", and accordingly: a) That the Region ESTABLISH a new designation to permit agricultural and countryside uses (including retail agricultural operations, agri-tourism and non-agricultural countryside uses) that would apply to agricultural lands in 7 OO8 Appendix I Executive Committee Report EC 2005-02 Pickering and other agricultural areas in the Region that are in similar proximity to urban areas; and b) That in addition to the above-noted agricultural and countryside uses, to also INCLUDE the following: · continue to permit severances for a surplus dwelling from a non- abutting farm by amendment to the DROP; and · continue to permit severance of a farm retirement lot; and · permit as-of-right stand-alone farm-related commercial uses (such as farm markets, auction barns) and associated lot-creation; and · continue to permit consideration of new country residential subdivisions, by amendment to the Regional Official Plan; and · continue to permit golf courses by amendment to the Regional or local official plan on agricultural lands of lower agricultural capability or on open space lands; and · continue to permit cemeteries by amendment to the Regional or local official plan on agricultural lands of lower agricultural capability or on open space lands; and · continue to permit cemeteries by amendment to the Regional or local official plan; and · establish provisions to restrict intensive livestock operations from locating in proximity to urban areas. 4. OPERATIONS &'EMERGENCY SERVICES REPORT OES 02-05 FUTURESIGN MULTIMEDIA DISPLAYS AMENDING ADVERTISING AGREEMENT That Report OES 02-05 regarding the Futuresign Multimedia Displays Advertising Agreement, be received; and That the attached by-law authorizing the execution of an Amending Advertising Agreement to which Futuresign Multimedia Displays will be permitted to continue to sell advertising space on the dnk boards and other devices at the Pickering Recreation Complex and Don Beer Arenas until May 30, 2008 be read three times and passed by Council; and That the appropriate City of Pickering officials be authorized to take the necessary actions to give effect thereto. OPERATIONS & EMERGENCY SERVICES REPORT OES 05-05 GREEN RIVER COMMUNITY CENTRE LEASE RENEWAL -HORIZON HOUSE WHERE HEAVEN AND EARTH MEET That Report OES 05-05 regarding the Horizon House Where Heaven and Earth Meet Lease Renewal, be received; and That the attached by-law, authorizing the execution of a renewal lease agreement pursuant to which Horizon House Where Heaven and Earth Meet, will be permitted to continue their use for church purposes of the Green River Community Centre from February 1, 2005 to January 31, 2006, be read three times and passed by Council; and That the appropriate City of Pickering officials be authorized to take the necessary actions to give effect thereto. -9- Appendix I Executive Committee Report EC 2005-02 CHIEF ADMINISTRATIVE OFFICE REPORT OES 01-05 NWMO DISCUSSION DOCUMENT 2, UNDERSTANDING THE CHOICES CITY OF PICKERING'S COMMENTS TO NWMO That Council receive Report CAO 01-05 concerning the Management Organization's (NWMO) Discussion Understanding the Choices; and Nuclear Waste Document 2, That Council confirm as the City's comments on Discussion Document 2, the Acting CAO's letter of December 20, 2004, including the peer review comments provided by Acres - Sargent & Lundy (see Attachments 1 and 2 to this Report), and that the NWMO make particular note of the following concerns in completing its work: The need to ensure a full and thorough assessment of the social, economic, and environmental impacts of on-site storage on host communities; and b. The need to explicitly address issues related to community compensation and host community benefits; and c. The need to ensure adequate and effective community dialogue in the remaining phases of the work; and That Council acknowledge receipt of the NWMO's letters dated January 10, 2005, to the Acting CAO and to the Canadian Association of Nuclear Host Communities (CANHC), responding to comments submitted on Discussion Document 2 (see Attachments 3 and 4). That Council request NWMO to provide continued peer review funding assistance to the CANHC to ensure the effective and ongoing participation of CANHC and its member municipalities in NWMO's remaining process; and That a copy of this Report be forwarded to the NWMO, the Federal Minister of Natural Resources, the Ontario Power Generation, member municipalities of CANHC, M.P. Smith, on lands being Part of Lot 2, Plan 12, City of Pickering. That the amending zoning by-law to implement Zoning By-law Amendment Application A 6/04, as set out in Appendix I to Report PD 08-05, be FORWARDED to City Council for enactment. Executive Summary: The subject property is located on the east side of Brock Road, north of Central Street in the Hamlet of Claremont. Currently, this property supports two offices and four illegal dwelling units (four bachelor apartment units - see Location Map and Applicant's Submitted Plans, Attachments #1 and #2). Due to its contravention with the Ontario Fire Code, the owner has applied for a building permit in order to bring the structure into compliance. However, zoning clearance for the building permit cannot be granted unless the property is rezoned to permit the apartment use. The applicant requests to amend the existing 'C2'- General Commercial Zone to legalize the use of four dwelling units in addition to permitted commercial uses. The proposal represents appropriate development that is compatible with the character of the Hamlet. It is recommended that this application be approved and the draft by-law be forwarded to Council for enactment. Financial Implications: proposed development. No direct costs to the City are anticipated as a result of the Report PD 08-05 Subject: Karsten Smith in Trust (A 6/04) Date: Januaw 18,2005 Page 2 0i5 Background: 1.0 Comments Received 1.1 At the August 5, 2004 Information Meeting (see text of Information Report and Meeting Minutes, Attachments #3 and #4) the applicant advised that he concurred fully with the staff comments; no other resident was present at the meeting; 1.2 Following the Information Meeting - no resident comments have been received; 1.3 City Department and Agency Comments Fire Services in support of this application; Veridian Connections no objection; Regional Municipality of Durham 2.0 Discussion letter dated July 20, 2004, stated no objections but a Noise Study is required; letter dated December 16, 2004, stated no concerns after reviewing the Noise Impact Study (see Attachment #5). 2.1 2.2 The proposed development is compatible with surrounding uses The subject property is surrounded by a mixture of commercial and residential land uses. The City's Official Plan encourages the establishment of a wider variety of housing forms to accommodate the needs of young people and senior citizens in the Claremont and Area Settlement. The subject property is designated Hamlet Commercial which permits residential uses. Well and sewage system is sufficient to support the apartment units The applicant submitted a letter and Well Record indicating that the capacity of the current well system exceeds what is required. Further, a Report titled "Existing Sewage System Assessment," by Jagger Hims Limited, indicates that the capacity of the exiting sewage system is sufficient to handle the existing two offices plus four bachelor apartments. The Region of Durham Health Department expressed no concern regarding the well or the sewage system. Report PD 08-05 Subject: Karsten Smith in Trust (A 6~04) Date: January 18, 2005 Page 3 2.3 2.4 2.5 2.6 Noise impact is not a concern Noise from Durham Road No. 5 (Central Street) and Old Brock Road A Noise Impact Study compiled by Sernas Associates indicates that the noise from Durham Road No. 5 and Old Brock Road is acoustically insignificant and therefore no noise control measures were recommended. The Region of Durham reviewed the Study and has no concern regarding the noise impact. Noise from the possible future airport The location of the subject property is beyond the existing and proposed Noise Exposure Forecast 25 Isoline (noise contour) published by Transport Canada, which means that it is outside of the area anticipated to be affected by aircraft noise. Therefore, the potential noise impact of a possible future airport would not appear to have any negative implication on this application. The number of parking spaces provided on site is adequate The subject property currently supports ten parking spaces on site. It is expected that the parking demand generated from the commercial activities will occur mainly during business hours, while the parking demand generated from the residents and their visitors will occur mostly during after-business hours. It is recommended to include a parking provision in the amending by-law requiring 1.25 parking spaces per bachelor or one bedroom dwelling unit and 1.75 parking spaces per dwelling unit with more than one bedroom. Applying the above parking standards, the number of parking spaces existing on the site appears sufficient. However, one parking space should be designated for handicapped parking as per the requirements under Municipal Parking By-law 2359/87. The handicapped parking space should be designed to have proper signage, location, accessibility, etc. The number of dwelling units to be limited to ensure compatibility The City's Official Plan encourages retail, shopping, office and other business uses to locate in the hamlet commercial area surrounding Central Street and Brock Road. As an attempt to preserve the commercial floor space in the building and to control residential density, a by-law provision to limit the number of dwelling units on the subject property to a maximum of four is recommended. A revision to the site plan is not necessary The subject property is currently subject to an approved site plan (S 32/87) with a site plan agreement registered on title. Given that no external changes to the structure are being proposed, and that no additional parking spaces are required for the approval of this application, a revision to the originally approved site plan is not necessary. Report PD 08~05 Subject: Karsten Smith in Trust (A 6/04) Date: January 18, 2005 Page 4 0i7 2.7 3.0 By-law to be forwarded to Council The attached by-law, included as Appendix I to this report, implements staff's recommendation to approve the proposed residential use (four dwelling units) in addition to the permitted commercial uses, subject to a limit on the number of dwelling units and a requirement for off-street parking. It is recommended that the attached by-law be forwarded to Council for enactment. Applicant's Comments The applicant concurs with the recommendations of this report. DR FT Being a By-law to amend Restricted Area (Zoning) By-law 3037, as amended, to implement the Official Plan of the City of Pickering, Region of Durham in Part of Lot 2, Plan 12, in the City of Pickering. (A 6/04) WHEREAS the Council of The Corporation of the City of Pickering deems it desirable to permit the development of four dwelling units on the subject lands, being Part of Lot 2, Plan 12; AND WHEREAS an amendment to By-law 3037, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE cORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: TEXT AMENDMENT Section 9 - General Commercial Zone - C2 is hereby amended by adding the following subsection after subsection 9.3.2: 9.3.3 Part of Lot 2, Plan 12 (5019 ' 5023 Brock Road) Notwithstanding subsection 9.1 or any other provision of this By-law, a maximum of four (4) dwelling units are permitted within a single building on lands known as Part of Lot 2, Plan 12, in the City of Pickering, subject to the following provisions: (1) Where the building on Part of Lot 2, Plan 12, cOntains any dwelling units, the following provisions shall apply: (a) Parking requirements: (i) A minimum of 1.25 parking spaces shall be provided for each of the dwelling units which contains one or less than one bedroom. (ii) A minimum of 1.75 parking spaces shall be provided for each of the dwelling units which contains more than one bedroom. BY-LAW 3037 By-law 3037 is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as set out in Section 1 above. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3037, as amended. 3. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required. O24 Information Report No. 13-04 ATTACHMENT ~ '~ ,, TO Page 2 3.0 3.1 3,2 3.3 3,4 4.0 4.1 4.2 OFFICIAL PLAN AND ZONING Durham Regional Official Plan the Durham Regional Official Plan identifies the subject land as being within a 'Rural Settlement- Hamlet' designation, which permits a variety of housing types and commercial uses; the applicant's proposal appears to comply with this designation; Pickering Official Plan the subject property is designated 'Rural Settlements- Rural Hamlets- Hamlet Commercial' within the Claremont and Area Settlement; the 'Hamlet Commercial' designation permits, among other uses, residential uses; the Claremont and Area Settlement policies encourage the establishment of a wider variety of housing forms to accommodate the needs of young people and senior citizens; the applicant's proposal appears to conform to the applicable Official Plan policies; Zoning By-law 3037 - the subject property is currently zoned "C2" - General Commercial Zone by By-law 3037, which allows the existing office uses; - an amendment to the zoning by-law is required to permit the establishment of four residential apartment units within the existing building; Oak Ridges Moraine Conservation Plan Oak Ridges Moraine Conservation Plan designates the subject property as 'Countryside Area- Rural Settlement.' There are outstanding "Inspection Orders" against the property because the building is presently in contravention of the Ontario Fire Code. in reviewing the application to date, planning staff has identified the following matters for further review and considerations: · compatibility with the surrounding lands and uses; · acceptability of the existing well to service additional residential uses; · examination of the existing building and any zoning non-compliances that may require technical amendments to the zoning by-law; · adequacy of parking provided on site (a minor revision to Site Plan S32/87 may be required); · assessment of the noise impact from Regional Road No. 5 (Central Street). A Noise Impact Study' prepared by Sernas Associates, dated December 3, 2004, concluded that due to the Iow traffic volume on Old Brock Road adjacent to the site, the'distance separation from Regional Road No; 5 and shielding from adjacent developments, noise impacts, from these sources are considered acoustically insignificant. As both policies have now become outdated due to changes made within the City's corporate structure and minor technical amendments made to the Municipal Act, the Chief Administrative Officer directed that the current Acquisition of Land Policy (governed by Resolution 180/94) and the Sale of Land Policy (governed by By-law 5627/00) be amended, streamlined and consolidated to reflect our current corporate structure and the Municipal Act, 2003, edition. The attached consolidated Policy/Procedure was tested during 2004 to ensure its suitability. Financial Implications: None. WHEREAS section 6(1) of the Municipal Act, 2001, gives a municipality the authority to acquire land, including the power to expropriate land in accordance with the Expropriations Act, 2001; AND WHEREAS The Corporation of the City of Pickering is desirous of establishing a Policy to regulate such acquisitions and/or expropriations; AND WHEREAS section 268(1) of the Municipal Act, 2001, gives a municipality the authority to sell land and requires the municipality to pass a By-law establishing procedures governing the sale of land, including the giving of notice to the public; AND WHEREAS, a consolidated Policy has been developed establishing procedures for both the acquisition and disposal of municipal lands, which Policy supercedes the procedures respecting the acquisition of land described in Resolution #180/94 and those respecting the disposal of land described in By-law 5627100. NOW THEREFORE, the Council of The Corporation of the City of Pickering HEREBY ENACTS AS FOLLOWS: Schedule A attached to this By-law shall be deemed to be the Policy governing the Acquisition and Disposal of Land by The Corporation of the City of Pickering. POLICY OBJECTIVE: The objective of this policy is to: 1. Acquire and dispose of land in accordance with the principles stated above. 2. GOVERNING LEGISLATION: Section 268 of the Municipal Act, 2001 sets out the City's obligations relating to the disposal of land and required public notice. These obligations include the passing of a By-law establishing land disposal procedures and the maintaining of'a public register identifying certain lands owned by the City. Surplus Land - Land which is no longer required by the municipality and which has been declared surplus through By-law or Resolution passed at a meeting of Council. Surplus Land may include buildings. Vendor - The City, any individual or company who enters into an agreement to sell land. This policy is limited to the acquisition and disposal of land not otherwise governed by the land development process as specifically described herein and is not applicable to the procurement and sale of any other goods, services or assets. Land shall be acqUired free of encumbrances, except for any easements required by provincial or federal governments or their assigned agencies, the Region of Durham (hereinafter referred to as the "Region"), a public utility, a conservation authority or other public body. In the event that a provision within this policy is inconsistent with any Act or regulation that applies to the acquisition or disposal of land by the municipality, the Act or regulation shall take precedence over the provisions of this policy to the extent necessary to comply with the law. Where such a contradiction is determined, this Policy shall be amended as required. (h) Receive requests from City staff, outside agencies or private individuals concerning the possible acquisition or disposal of land. Consider proposals for the acquisition or disposal of land and determine, in consultation with public agencies and City Department Heads, the general terms and conditions of the acquisition or disposal. Negotiating and Completing the Sale: 11.01 Conveyance to Specific Party (Individual or Corporation) If the land is being sold to a specific party, the Coordinator, Property & Development Services shall prepare the Agreement of Purchase and Sale, if applicable, under direction of the Solicitor acting for the City and in accordance with the terms specified by the CAO and established in the Council Resolution or By-law, and make arrangements for the final conveyance of land. 11.02 If a satisfactory Agreement of Purchase & Sale or arrangement cannot be concluded with a specific individual/corporation within the terms specified, the Coordinator, Property & Development Services shall consult with the CAO prior to proceeding with the conveyance through any other means. Report PD 04-05 Subject: Final Assumption of Plans of Subdivision 40M-1561,40M-1562 and 40M-1563 Date: January 25, 2005 Page 2 Background: The City entered into Subdivision Agreements with the above-noted developers for the development of Plans 40M-1561, 40M-1562 and 40M-1563. As the developers have now completed all works and services within these Plans to the satisfaction of City staff, it is now appropriate to assume the M-Plans under the jurisdiction of the City and release the developers from the provisions of the respective Subdivision Agreements. The assumption of Plans 40M-1561, 40M-1562 (save and except Block 25) and Plan 40M-1563 and the release of the Subdivision Agreements must be acknowledged by the enactment of various By-laws assuming the roads and/or services within the Plans, amending By-law 1416/82 relating to Places of Amusement, and authorizing the release and removal of the Subdivision Agreements from title. It should be noted that the roads fronting the lots and blocks within Plans 40M-1561 and 40M-1563 lie within adjacent Plans of Subdivision. Accordingly, those roads will be assumed by the assumption of thoSe Plans. Accordingly, it is recommended that the following By-laws be enacted to: assume roads and/or services within Plans 40M-1561, 40M-1562 (save and except Block 25) and Plan 40M-1563; amend By-law 1416/82 (Places of Amusement) to include the roads within Plan 40M-1562; and authorize the release and removal of the Subdivision Agreements from title relating to Plans 40M-1561, 40M-1562 and 40M-1563. That Report OES 06-05 respecting the reduced load period by-law be received; and That a by-law be enacted to designate highways under the jurisdiction of the City of Pickering to which a reduced load period applies; and That By-law 6300/04 be repealed Executive Summary: Not Applicable Financial Implications: There are no financial implications of the passing of the By- law, as the City has sufficient signs in stock. Background: The authority for the enactment of a reduced load period by-law is derived from the Highway Traffic Act, R.S.O. 1990 Chap. H.8 section 122 (7), which states that a municipality may designate the date on which a reduced load period shall start or end and the highway or portion thereof under its jurisdiction to which the designation applies. This report includes an annual update of municipal highways that are affected by a reduced load period as compiled by the Municipal Property & Engineering Division of the Operations & Emergency Services Department. The update is required to capture new streets that have been created since the last by-law was enacted. Enactment of the attached by-law will provide an accurate compilation of the highways within the City that are subject to the reduced load period designation, and will repeal By-law 6300/04. AND WHEREAS, new streets have been created which require the designation of a reduced load period; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF PICKERING HEREBY ENACTS AS FOLLOWS: For the purpose of subsections (1), (2) and (3) of section 122 of the Highway Traffic Act, R.S.O. 1990, Chap. Background In '1985 Ajax, Picketing and Whitby collaborated to assume joint responsibility for animal services. The services had previously been provided under contract by the Ontario Humane Society. By agreement, the Town of Whitby assumed responsibility for the provision of pound-keeper and animal control officer services for the three municipalities. In return, Ajax and Pickering agreed to pay their per capita share of the operating costs. It was agreed that capital costs would be shared equally. Also, a joint board of management known as the Pickering-Ajax-Whitby .loint Animal Services Committee, composed of a councillor from each of the three municipalities, was established to manage the operation of the joint service, including the maintenance and operation of the animal services centre in Whitby and the administraUon of the service contract. The agreement was based on the premise that by acting together in a collaborative way, the three municipalities would be best positioned to offer animal serviceSof the highest qualityandthe most effective delivery possible within the resoUrces that were available, Over the years, the economies of scale have benefited each of the municipalities. The reciprocal animal services arrangement has served the municipalities well. Corporate Services Director's Report, Item 22-04 (Con't) · Current Situation It is timely to review the terms and conditions of the animal services agreements to ensure the three mumcipalities are well positioned to continue to provide cost effective services to an ever increasing urban population, There are a number of areas that should be reviewed. For example, under the current arrangements neither Ajax nor Pickering share any of the associated overhead costs of running the animal services operation. In the early days, PAW's mandate was simple and straight forward i.e. to control domestic animals and wildlife. Over the years, PAW's mandate has developed into a multi-faceted animal service providing everything from cat and dog control to public education in dealing with wildlife, the regulation and control of exotic animals, and the promotion of responsible pet ownership. Ajax and Pickering have increasingly relied on Whitby to take the lead in the development, delivery and administration of animal services programs and operations. While Ajax and Pickering have played an important contributing role in the area of policy development, it has been left to Whitby to administer and manage the day to day animal services operations and programs. While there is general agreement that each of the municipalities is better served by having the responsibility for the delivery and administration of animal services vested in one municipality, Whitby is finding it necessary to devote an ever increasing amount of time and effort in providing the necessary administrative support services in areas such as finance, human resources, information technology, administration, marketing and promotion, legal, and technical services. The overhead costs associated with these administrative services are significant. Conservatively speaking, it is estimated that they amount to between six and eight percent of PAW's operating budget, or, in other words, between $45,000.00 and $60,000.00 annually. Under the current contractual arrangements, Ajax and Picketing do not share these costs. They are borne solely by the Town of Whitby. Another contractual area that needs to be addressed is the termination provisions contained in the current animal services agreements. The agreements simply provide that the animal services contract may be terminated on December 37t in any year by any one of the municipalities upon six months written notice. On termination, Whitby is required to pay to each of Ajax and Pickering one third of the value of the animal services premises including buildings, equ!pment and related appurtenances. There is no requirement on the part of either Ajax or Pickering to assist Whitby in the placement of animal services employees that might be displaced as a result of the termination of the contract. As the municipalities continue to grow in population and as PAW continues to provide ever increasing levels of service, there will be a need for Whitby to hire additional staff. The termination provisions of the current agreements need to be revisited to better protect Whitby's interests and the interests of its employees. Also, the whole concept of the management and control of the animal service and what particular role the Pickering-Ajax-Whitby _~oint Animal Services Committee should play in the future requires examination. Financial Implications: Not applicable Background: Please be advised that Council passed the following resolution at its meeting of July 26, 2004: Report CS 05-05 Accessibility Maintenance Standards for Persons with Disabilities February 1,2005 Page 2 WHEREAS the accessibility of buildings and facilities to all residents of Pickering, including those with disabilities, is important to the residents and City of Pickering; and WHEREAS the Ontarians with Disabilities Act, 2001 was enacted to enable persons with disabilities to participate fully and equally in all aspects of Ontario life by creating a barrier-free society through the elimination of all existing barriers and the prevention of new ones; and WHEREAS the Ontario Building Code requires all new buildings to meet barrier free accessibility standards; and WHEREAS the Ontario Building Code does not address existing buildings or the ongoing maintenance of accessibility standards such as automatic door openers and washroom facilities to accommodate accessibility by persons with disabilities; NOW THEREFORE the Council of the Corporation of the City of Pickering hereby directs City staff to investigate amendments to the City's Property Standards By-law which will prescribe barrier free requirements and accessibility maintenance standards for existing buildings, in order to accommodate accessibility by persons with disabilities; and FURTHER THAT in investigating proposed by-law amendments, City staff consult with the City of Pickering's Accessibility Advisory Committee and prepare a report describing recommended amendments for Council's consideration before the end of 2004. Presently, the Ontarians with Disabilities Act, 2001 requires the municipality to prepare an accessibility plan that addresses the identification, removal and prevention of barriers to persons with disabilities in the municipality's by-laws and in its policies, programs, practices and services. The Act also requires that Council establish an Accessibility Advisory Committee whose duty it is to advise Council about the preparation, implementation and effectiveness of its Accessibility Plan. The Committee is also mandated to advise Council on the accessibility for persons with disabilities to municipal facilities and to review site plans. One of the shortfalls of the Ontarians with Disabilities Act, 2001 is that it does not address maintenance standards as they affect persons with disabilities in privately owned buildings that are open to the public. On October 12, 2004, the Province gave first reading to Bill 118 known as the Accessibility for Ontarians with Disabilities Act, 2004, that is much broader in scope than the previous legislation and would include the private sector for the first time. Also, Bill 118 will require demonstrated action, not just planning and includes tangible standards to measure results. Report CS 05-05 Accessibility Maintenance Standards for Persons with Disabilities February 1, 2005 Page 3 Under Bill 118, people with disabilities, stakeholders and the Provincial Government would develop standards that could deal with such measures as the width of aisles in buildings, staff training in serving customers with disabilities, large print menus or adaptive technology in the workplace. These standards would also address the full range of disabilities and barriers including physical, mental, sensory, developmental and learning disabilities. Until Bill 118 is finally enacted and given Royal Assent, there is very little proactive measures that the municipality can take with respect to maintenance standards as they affect persons with disabilities in privately owned buildings that are open to the public. The City can ensure that its Property Standards By-law is enforced with regard to how it affects persons with disabilities. For example, Section 67 of the Property Standards By- law states: "Electrical wiring, cords, circuits, fuses, circuit breakers, electrical equipment and electrical heating systems shall be installed and kept in good repair and free from any unsafe condition." With respect to the automatic doors that are found at most commercial buildings, the City could take proactive enforcement actions under the above Section to inspect such doors and if they are not working, an Order could be issued to the property owner to have the doors repaired in a timely manner so that the building would be easily accessible for persons with disabilities. Attached to this Report is a draft by-law that would amend the Administration and Enforcement provisions of the Property Standards By-law to state that the By-law shall be enforced with particular regard to the Ontarians with Disabilities Act, 2001, to ensure that accessibility standards are maintained for existing buildings in order to accommodate accessibility by persons with disabilities. Executive Summary: This Report implements the Notice of Motion passed on January 17, 2005 to restrict the use of searchlights. Financial Implications: Not applicable Background: Please be advised that Council passed the following resolution at its regular meeting of January 17, 2005: WHEREAS various businesses have been using searchlights as an advertising method to attract customers; and WHEREAS searchlights tend to cause a nuisance to residents that live close to such search lights; and Report CS 14-05 Restrict the Use of Searchlights February 8, 2005 Page 2 165 WHEREAS other forms of advertising through illuminated pylon signs, billboard signs and wall signs are strictly regulated through the City's Sign By-law; NOW THEREFORE the Council of the Corporation of the City of Pickering hereby directs staff to prepare a by-law that will restrict the use of searchlights in a manner that they will not cause a nuisance to residents or local businesses. Attached to this Report is a draft by-law to strict the use of searchlights in conformity with the intent of the Resolution passed on January 17, 2005. In developing the attached draft by-law, it was felt that a searchlight could not be considered a sign because in many instances, searchlights are used for entertainment purposes as well as advertising devices and therefore I could not rely on the provisions in the Municipal Act respecting signs. Also, I could not rely on the provisions of the Act respecting the licensing of businesses because again, searchlights are often used by community groups for entertainment purposes as well as by businesses to advertise a location. The enabling legislation for the attached draft by-law comes from Sections 128(1) and 128(2) of the Municipal Act that states: A local municipality may prohibit and regulate with respect to public nuisances, including matters that, in the opinion of Council, are or could become or cause public nuisances. The opinion of Council under this section, if arrived at in good faith, is not subject to review by any court. The resolution passed by Council on January 17, 2005 does indicate that searchlights operated close to a residential area does cause a nuisance from the ambient light that shines from such equipment. The resolution goes on to state that searchlights may be allowed but only in such a manner that they will not cause a nuisance to residents or local businesses. Under Section 2.7 of those Minutes, you will note that the Committee has asked that a Member of Council be appointed to sit on the Heritage Pickering COmmittee. I have attached a copy of the Heritage Pickering's 2004 Annual Report because some of their recommendations are discussed in the Annual Report. One of the more important recommendations made by Heritage Pickering is for Council to urge the Federal Government to reinstate its local heritage committee and appoint a representative to sit on that committee. I have been in contact with a representative of Transport Canada who indicated that the Federal Government will reinstate its local heritage committee but not in the near future. Once the Federal Government does reinstate its local heritage committee, it would be appropriate for an employee of the City of Pickering who has an expertise and interest in architectural and historical conservation to be appointed to sit on this committee.
