BY-LAW NUMBER 5 ~ ~? ~
being a By-law for the licensing
and regulation of Restaurants and
Lunch Counters.
WHEREAS the Corporation of the Township of Pickering
may pass By-laws pursuant to The Municipal Act, R.$.0. 1960,
Chapter 2~9, Section 399 (1} for limiting the number of ana
licensing victualling houses and ordinaries.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF
THE TOWNSHIP OF PICKERING ENACTS AS FOLLOWS:
1. (a) From and after the final passing of this By-
Law, a licence shall be required to enable any person or
persons, within the limits of the Township of Picketing to
conduct, maintain and carry on a Restaurant or Lunch Counter.
(b) For the purposes of this By-law a Snack Bar
shall be any esting establishment where meals and refreshments
may be had by the public having 15 seats or less and a Restaur-
ant shall be any eating establishment where meals and refresh-
ments may be had by the public having 16 seats or over.
(c} Licences for the keeping and carrying on
of a Restaurant or Snack Bar shall be issued and signed by
the Municipal Law Enforcement Officer of the Township of
Picketing.
(d) The fees for licences issued under this By-
law are as follows:
For a Snack Bar . $10.00 per year,
For a Restaurant . .$20.00 per year.
(e} A Snack Bar oz. Restaurant Licence issued under
this By-law shall be in force for a period of one year commenc-
ing on the let day of January.
2. The licence holder, under such licence, shall
observe, keep and obey all provisions of the Ontario Liquor

Control Act, as to the sale of intoxicating liquors, and
of this By-law, and of any amendments thereto, which shall
h~after be passed by By-law or resolution of this Council.
3. All wurlitzers, nickelodeons and juke boxes
operated on the premises of any person holding a licence
under this By-law, shall be disconnected promptly at 12 o'clock
midnight and shall not be played between said hour and
? o'clock in the morning.
4. (a) Any person convicted of a violation of the
terms of this By-law shall be liable to a fine of not less
than $25.00 for the first offence and not less than $50.00
for each subsequent offence.
(b) The Restaurant or Lunch Counter licence so
issued to that person may be cancelled by resolution of the
Council of the Township of Picketing for this purpose.
THAT By-law Number 1665 be and the same is hereby
repealed.
