AMENDED BY ~ , AMENDS DISPOSITION Being a by-~w w stop-up a~ close as public highway that part of the Road Allowance be~een Lots 24 a~ 25, ~nge 3, B.F.C., Pickering designated as Pan 4, Plan 40R-17O03 and to authorize the sale of that land to the abutting owner, as those la~s are not required for other municipal purposes. WHEREAS, pursuant to section 297(1)(a) of the Municipal Act, R.S.O. 1990, chapter M.45, the Council of The Corporation of the Town of Picketing etmcted a by-law dedicating as public highway part of the Road Allowance between Lots 24 and 25, Range 3, B.F.C., Picketing, being Pan 4, Plan 40R-17903; and WHEREAS, pursuant to sections 191(1), 297(1)(c), 297(1)(d) and 315 of that Act, the Council of the Town may pass by-laws to stop-up a highway or part thereof and to authorize its sale or the sale ora part thereof at a fixed price; NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: !. The following portions of highway are hereby stopped up and closed to both vehicle and pedestrian traffic: (a) That part of the Road Allowance between Lots 24 and 25, Range 3, B.F.C, Pickering, being Part 4, Plan 40R-17903. 2. The Corporation of thc Town of Pickering shall dispose of utility casements over any of the lands described in section 1 above that grcscntly contain utility structures of any nature or sort, to the appropriate utility authority including, but not necessarily limited to, The Regional Municipality of Durham, Bcl! Canada, Consumers Gas, and Picketing Hydro, at a sale pticc of $2.00 each. 3. That part of the Road Allowance between Lots 24 and 25, Range 3, B.F.C., Pickering, designated as Part 4, Plan 40R-17903, shall be Gffcrcd for sale to the abutting owner, subject to any utility easement or easements previously granted or granted pursuant to section 2, above. 4. The Mayor and Clerk arc hereby authorized to execute any documents approved by the Town Solicitor required to effect the dispositions, effers and transfers provided for in this By-law.
