AMENDED BY ~/~~,//~ ~ , , AMENDS DISPOSITION THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 5]~29 Being a By-law to amend Restricted Area (Zoning) By-law 3037, as amended by By-law 3155/89, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham, in Part of Lots 13, 14, 15 and 16, Concession 7, in the Town of Pickering. (A 19/93 R) WHERE~ the Council of the Corporation of the Town of Pickering passed By-law 3037 and By-law 3155/89 amending By-law 3037, to establish an agricultural zone and appropriate golf course zoning for an existing golf course on the subject lands, being Part of Lots 13, 14, 15 and 16, Concession 7, in the Town of Pickering; ,M~ID WHEREAS the Council of the Corporation of the Town of Pickering now deems it desirable to amend By-law 3037, as amended, and By-law 3155/89 to permit the expansion of the existing golf course use on the subject lands; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. SCHEDULE ! Schedule I attached hereto with notations and references shown thereon is hereby declared to be part of this By-law. 2. AREA RESTRICTED The Provisions of this By-law shall apply to those lands in Part of Lots 13, 14, 15 and 16, Concession 7, in the Town of Pickering, designated "A/GC .... OS/HL" and "A" on Schedule I attached hereto. 3. GENERAL PROVISIONS No building, structure, land or part thereof shall hereafter be us~, occupied, erected, moved or structurally altered except in conformity with the provisions of this By-law. 4.DEFllNTrIONS tn this By-law, (1) (a) "Golf Course" shall mean an area of land, and any ancillary building, structure, or part thereof, operated for the purpose of playing golf and includes any associated recreational facility, such as a clubhouse, snack bar, dining room, lounge, swimming pool and racquet sport court, operated in conjunction therewith. (b) "Clubhouse ~Co~odatio.~!, shall mean a limited portion of a clubhouse accessory to a golf course use that is used for short term overnight accommodation also accessory to the golf course use; (c) "Golf Course Child Car~" shall mean a building or portion thereof accessory to a golf course use that i~ used for a baby-sitting service provided to golf course patrons while using the golf course. 5. PROVISIONS ("A/GC" Zone) (1) Uses Permitted ("A/GC" Zone) No person shall, within the lands designated "A/GC" on Schedule I attached hereto, use any lot or erect, alter or use any building or structure for any purpose except the following: (a) any use permitted by section 6.1 of By-law 3037; (b) a golf course; (c) clubhouse accommodation; (d) gnlfcourse child care. ii (2) Zone Requirements CA/GC" Zone) No person shall, within the lands designated "A/Ge" on Schedule I attached hereto, use any lot or erect, alter or use any building or structure except in accordance with the follovAng provisions: (a)for those uses permitted by section 5.(l)(a), above, the provisions of section 6.2 of By-law 3037; (b) for golf courses and associated uses, the provisions of section 6.2.4 of By-law 3037. (3) Special Regulations CMGC" Zone) (a) notwithstanding section 5 (1) (c) above, clubhouse ac,:omodation provided shall be limited to not more than 10 bedrooms. 6. PROVISIONS ("OS/HL" Zone) (1) Uses Permitted COS/HL" Zone) No peEon shall, within the lands designated "OS/HL" on Schedule I attached hereto, use any lot or erect, alter or use any building or structure for any purpose except the following: (a) conservation of the natural environment, soil, and wildlife; Co) resource management; (2) Zone Renuirem¢~a~S COS/HL" Zone) No buildings or structures shall be permitted to be erected nor any existing buildings or structures be modified or changed, nor shall the placing or removal of fill be permitted, except where buildings or structures are used for purposes of flood and erosion control, or resource management. (3) Special Regulations ("OS/IlL" Zone) (a) notwithstanding section 6.(1) and 6.(2) above, within the area diagonally hatched on Schedule I attached hereto, golf fairways, tees, and greens may be (b) notwithstanding section 6.(1) and 6.(2) above, within the area cross hatched on Schedule I attached hereto, facilities for the provision of water supplies to the golf course use identified in 5.(l)(b) may be permitted. PROVISIONS CA" Zone) (1) _Uses Permitted CA" Zone) No person shall, within the lands designated "A" on Schedule I attached hereto, use any lot or erect, alter or use any building or structure for any purpose except the following: (a) any use permitted by section 6.1 of By-law 3037; (2) Zone Requirements CA" Zone) No person shall, within the lands designat~i "A "on Schedule I attached hereto, use any lot or erect, alter or use any building or structure except in accordance with the following provisions: (a) the provisions of section 6.2 of By-law 3037. 8. BY-LAW 3037 By-law 3037, as amended, is hereby further amended and By-law 3155/89 is hereby repealed only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule I attached hereto. Definitions and subject matters not specifically dealt with in this By-law shall be governed by the relevant provisions of By-law 3037, as amended. This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required. READ A FIRST AND SECOND TIME THIS 14th DAY OF October , 1'997.
