THE CORPORATION OF THE TOV~/N OF PICKERING
BY-LAW NUMBER ~ ! 20/97
Being a By-law to amend Restricted Area (Zoning) By-law 3037, as ~anended, to
implement the Official Plan of the Town of Picketing District Plam,~ing Area, Region
of Durham. (A 14/97)
WHEREAS the Council of the Corporation of the Town of 9ickering d~ems it desirable to replace
the definition of"eating establishment" with a "restaurant - Type A" definition and use.
AND WHEREAS an amendment to By-law 3037, as amended, is therefore deemed necessary;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
PICKERING HEREBY ENACTS AS FOLLOWS:
1. TEXT AMENDMENTS
I (1) Section 2, DEFINITIONS, of By-law 3037 is hereby amended by deleting
Section 2,23.
(2) Section 2, DEFINITIONS, of fly-law 3037 is hereby amended by adding thereto the
following definition:
Section 2.52.2 restauront - Type A
"a building or part ora building where food is prepared or kept for retail sale
to the public for immediate consumption on or offthc premises, or both on an
off the premises"
(3) Section 7.1.2, USES PERMITTED Commercial - (Village Zone - "V"), Section 9.1,
USES PERMITTED (General Commercial Zone - "C2') and Section 10.1.1 USES
PERMITTED Commercial - (Highway Commercial Zone - "C3") of By-law 3037
are hereby amended by replacing "eating establishment" with "restaurant - Type A'.
2. BY-LAW 3037
By-law 3037, as amended, is hereby further amended only to t~c extent necessary to give
effect to the provisions of this By-law. Definitions and subject matters not specifically dealt
with in this By-law shall be governed by relevant provisions of By-law 3037, as amended.
3. EFFECTIVE DATE
This By-law shall take effect from the day of passing hereof subject to the approval of the
Ontario Municipal Board, if required.
