THE CORPORATION OF THE TOWN OF PICK~[~
BY-LAW NO. 5089/97
Being a bydaw to exempt Lot 26, Plan 40Mo!877
Pickerlng, from part lot control.
WHEREAS pursuant to the provisions of section 50 of the Planning .,ich R.S.O. 1990, chapter P. 13, the
cGuncil of the municipality may by by-law provide that section 50(5) of the Act does not apply to certain
lands within a plan of subdivision designated in the by-law;
NOW THEREFORE, the Council of the Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
1. Section 50(5) of the Planning Act, R.S.O. 1990, chapter P.13, dOes not apply to the lands
described as follows:
Lot 26, Plan 40M-1877, Picketing.
BY-LAW read a first, second and third time and finally passed this 5th day of Augu:t, 1997.

RECOMMENDATION:
A Part Lot Control By-Law should be enacted to exempt Lot 26, Plan 40M-1877, Pickering,
from t~e subdivision control provisions of the Planning ,~ct.
ORIGIN: Request from Craig Marshall July 30, 1997
AUTHORITY: Planning,4ct, R.S.O. 1990, chapter P. 13, section 50.
BACKGROUND:
The above-mentioned land was developed in accordance ~th the appropriate Zoning By-Law
and Subdivision Agreement, in such a manner to allow more than one dwelling unit to be
constructed on the Lot referred to.
Attached hereto is a draft by-law, enactment of which will exempt the land from the part lot
control provisions of the Planning ,qct, thus permitting transfers of those units into separate
ownerships. This by-law is in the form usually employed in such cases.
