THE CORPORATION OF THE TOWN OF PICKERING

Being a by.law to assume Burnside Drive, Bainbridge
Drive. Marshcourt Drive, Banbury Court, Fairfield
{?escent, Beechlawn Drive, and dsh/brd Drive,, Plan
40M. 1499, 1 ickering, ]hr public use as public highway
under the jurisdiction of the 7bwn.
WHEREAS, Burnside Drive, Bainbridge Drive, Marshcourt Drive, Banbury Court, Fairfield Crescent,
Beechlawn Drive, and Ashfbrd Drive are highways shown on a plan of subdivision and is therefore
deems, d, pursuant to the Surveys ,~ct, R.S.O. 1990, chapter S.30, section 57, to be public highway; and
WHEREAS, pursuant to the Municipal Act, R.S.O. 1990, chapter M.45, section 263, the Council of The
Corporation of the Town of Picketing has jurisdiction over that highway (the Council of The Regional
Municipality of Durham not having enacted a by-law pursuant to the Regional Municipalities Act,
R.S.O. 1990, chapter R.8, section 23, to add that highway to the regional road system): and
WItEREAS, pursuant to the .~fimicipal Act. section 262~ the soil and t?eehold of that highway is
theretBre vested in The Corporation of the Town of Picketing:
NOW THEREFORE, the Council of The Corporation of the Town of Picketing }IEREBY ENACTS AS
FOLLOWS:
!. The following highway is hereby assumed lbr public usc as public highway under the
jurisdiction of the Council of The Corporation of the Town of Pickering:
Burnside Drive, Bainbridge [)rive, Marshcourt Drive, Banbury Court, }:airfield Crescent,
Beechlawn Drive and Ashford Drive.
according to Plan 40M-1499, Town of Picketing. Regional Municipality of Durham.
2. The Town Solicitor is hereby authorized to apply to the Land Registrar pursuant to the Land
Titles Act, R.S.O. 1990, chapter L.5, section 152, to have the Corporation entered as the owner of
the highway referred to in section 1.
