BY-LAW NO. 5054/a7 Being a by-law to stop-up and close as public highway all or part of Appleview Road and to authorize its sale to an abutting owner where not required fbr olher municipal purposes. WHEREAS, pursuant to section 297(1)(a) of the Municipal Act, R.S.O. 1990, c. M.45, the Council of The Corpmmion of the Town of Picketing enacted a By-law dedicating, that part of Appleview Road, designated as Part 4, Plan 40R-10631, save and except Part 2, Plan 40R-11864 as public highway (to become part of Appleview Road); and WHEREAS, pursuant to sections 191(1), 297(1)(c), 297(I)(d) and 315 of that Act, the Council of the Town may pass by-laws to stop up a highway or part thereof and to authorize its sale or thc sale ora part thereof at a fixed price; NOW THEREFORE, the Council of thc Corporation of the Town of Pickering tlEREBY ENACTS AS FOLLOWS: 1. The following portions of highway are hereby stopped up and closed to both vehic.alar and pedestrian traffic: Part of Appleview Road, l'lan 11151, PickeTing, designated as Part 4, Plan 40R-10631, save and except Part 2, Plan 40R-11864. 2. The Corporation of the Town of PickeTing shall dispose of utility easements over any of the lands described in section !, above, fha! presently contain utility structures of any nature or sort, to the appropriate utility authority, including but not necessarily limited to, The Regional Municipality of Durham, Bell Canada, Consumers Gas, and Pickering Hydro, at a sale price of $2.00 each. 3. That part of Appleview Road, Plan 1051, Picketing, designated as Part 4, Plan 40R-10631, save and except Part 2, Plan 40R-11864, shall be offered for sale to the abutting owner at a sale price of $98,000 subject to any utility easement or easements previously granted or granted pursuant to section 2, above. 4. The Mayor and Clerk are hereby authorized to execute any documents approved by the Town Solicitor and required to effect the dispositions, offers and transfers provided for in this By-law.
