HomeMy WebLinkAboutBy-law 3847/91THE C~TION OF THE TOWN OF PICKERING BY-LAW NO. 3847/91 Being a by-law to assume Dunn Crescent, Kimton Court and Nomad Road, Plan 40M-1366, Pickering, for public use as public highways under the jurisdiction of the Town. WHEREAS, Dunn Crescent, Kimton Cou~t and Nomad Road are highways shown on a plan of subdivision and are therefore deemed, pursuant to the Surveys Act, R.S.O. 1980, c.493, s.57, to be public highways; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, s.259, the Council of The Corporation of the Town of Picketing has jurisdiction over those highways (the Council of The Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipality of Durham Act, R.S.O. 1980, c.434, s.28, to add those highways to the regional road system); and WHEREAS pursuant to the Municipal Act, s.258, the soil and freehold of those highways is therefore vested in The Corporation of the Town of Picketing; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: The following highways are hereby assumed for public use as public highways under the jurisdiction of the Council of The Corporation of the Town of Pickering: Dann Crescent, Kimton Court and Nomad Road all according to Plan 40M-1366, Town of Picketing, Regional Municipality of Durham. The Town Solicitor is hereby authorized to apply to the Land Registrar pursuant to the Land Titles Act, R.S.O. 1980, c.230, s.151, to have the Corporation entered as the owner of the highways referred to in section 1. BY-LAW read a first, second and third time and fmally passed this 16th day of September, 1991.
