HomeMy WebLinkAboutBy-law 3844/91T RP TI N OF T T WN OF PICKERING BY-LAW NO. 3844/91 Being a by-law to authorize the execution of a Release and Discharge of the Subdivision Agreement respecting Plan 40M-1312, Picketing. WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predecessor thereof, The Corporation of the Town of Pickering and KSW Developments Incorporated entered into an Agreement dated January 16, 1984, Notice of which was registered on April 5, 1984 as Instrument No. LT200439, respecting the subdivision and development of Plan 40M-1312, Pickering; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form attached hereto as Schedule A, of the Agreement dated January 16, 1984, Notice of which was registered April 5, 1984 as Instrument No. LT200439, between KSW Developments Incorporated and The Corporation of the Town of Picketing, respecting the subdivision and development of Plan 40M- 1312, Picketing. 2. Schedule A hereto forms part of this By-law. BY-LAW read a first, second and third time and finally passed this 16th day of September, 1991. RELEASE AND DI$CI-kAR~E_ WHEREAS the Agreement dated January 16, 1984, Notice of which was registered April 5, 1984, in the Land Registry Office for the Land Titles Division of Durham (No. 40) as Instrument No. LT200439, between, KSW DEVELOPMENTS INCORPORATED hereinafter referred to as the "Company" THE CORPORATION OF THE TOWN OF PICKERING hereinafter referred to as the "Town", provided for the subdivision and development of lands affected hereby; and WHEREAS the terms and conditions of that Agreement have been complied with to the satisfaction of the Town with respect to the lands affected hereby; THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions of the Agreement. THIS RELEASE AND DISCHARGE affects the lands described as: Lots 1-116, inclusive, Blocks 117-125, inclusive, Amaretto Avenue, Benedictine Court, Cognac Crescent and Whisky Gate, Plan 40M-1312, Town of Picketing, Regional Municipality of Durham. IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly authorized officers. DATED at Pickering, Ontario this 16th day of September, 1991.
