The i':unicipal Corporation of the
SHIP 0 PICK: ;RING, in the County and
Province of Gntnrio, herein called the
"C ,?HP ORA'T' I ON" .
WHEREAS by Petition the Owners have requested this Corporation to create
certain improvements upon the following roads and assume same as Township
of Pickering; Public Roads:
Nest Point Crescent Road from Pine Ridge Road to of
P 2B3, Lot 71.
AND WHEREAS the said Corporation has a-reed to make such improvements
upon the terms hereinafter set out:
NOW THIS AC-REEPIENT WITNESSETH THAT the said Corporation will extend on its
own authority and in its own manner, and s,, as not to exceed One Thousand,
Two Hundred and Fifty Dollars (j?1,250.00) upon rebuildin„ the road found-
ation and culverts upon the s:Aid roads, and providing suitable drainage; the
said Corporation will levy upon its general rate FORTY PtERCENT ( O-o) of
such expenditure and the Owners will pay on levy thereof in the year 1954
1955 and 1956 inclusive the other SIXTY PERCEXT (60;%) of the said total cost,
or 'T'NE??TY PERCENT (20J) of the said total cost in each of the said three
years; eac',, of the Owners whose pronert; abuts directly on the work pavinc7
three annual levies, based on a foot frontage for each lot; that each of
the said owners covenant that he, she or they are owners in fee sim le of
their respective lands, and that the said G rporation may, if they nish,
register this Agreembnt, or a copy of same, in the Registry Office for the
Registry Division of the County of Ontario at hitby, as notice to sub-
sequent purchasers that the lands of the Owners are charged with the afore-
said three levies, it is also a-reed by ana between the said parties hereto
that the manner and method of carryinsr, out the aforesaid improvements on
the said roads will be in the absolute discretion of the Corporation, tIe
officers, servants or a--ants of the Corporation; and that the said owners
shall have no right of action Against the said Corporation resultin, from
nonfeasance or malfeasance.
AND THE SAID OWNERS AGREE to the installation by the said Corporation of a
Johns-Manville cu vert to be placed on the road, in the ditch, at the
driveway of each Owner, and at a place agreed to between the Owner and the
Corporation immediately on completion of the work. 1'he Corporation ac,,rees
to instal said culvert at a price of $25.00 for eadh culvert and to gravel
put thereon, and the same will be added to the Owners' tax bills in the
year 1954-
AND THE SAID OtiNERS, for tnemselves, their respective heirs, executors,
administrators, successors or assigns, covenant to carry out and put into
effect the terms of this Agreement.
