Carolyn Anderson, 1017 Mountcastle Cres., addressed Council stating her support of the proposed Tree By-law. She suggested that an amendment be made to the by-law to Section 2(b), Exemptions, with respect to activities or matters undertaken by the Toronto and Region Conservation Authority or the Central Lake Ontario Conservation Authority, to read the same as 2(a) and 2(c) - 1 - Council Meeting Minutes Monday, March 17, 2003 8:03 p.m. III RESOLUTIONS Resolution #28/03 - Appendix #1 Moved by Councillor Johnson Seconded by Councillor Holland That the Report of the Planning Committee dated March 17,2003, be adopted. CARRIED Resolution #32/03 Moved by Councillor Pickles Seconded by Councillor Johnson The Mayor Arthurs be authorized to make the following proclamations: "Rally for the Cure for Cystic Fibrosis" - May 10, 2003 CARRIED Resolution #33/03 Moved by Councillor McLean Seconded by Councillor Holland WHEREAS driving at excessive speeds on all roads in the City of Pickering poses a threat to the safety of all persons in the community; and WHEREAS persons are at particular risk when vehicles are driven at excessive speeds on City-controlled roads that serve the residential areas and are heavily traveled by children going to school or adults out for a recreational walk or bike ride; and WHEREAS the Council of the City of Pickering recognized this threat in 1996 when it passed Resolution #44/96 to request the Minister of Transport to initiate an amendment to the Highway Traffic Act to permit local municipalities to enforce those sections of the Act dealing with the enforcement of speed limits within its boundaries; and - 3- Council Meeting Minutes Monday, March 17, 2003 8:03 p.m. WHEREAS by Resolution #43/97 passed on February 10, 1997, Council authorized the retention of an additional Municipal Law Enforcement Officer and the training of all Officers in anticipation of the Province passing legislation that would allow municipalities to enforce speed limits; and WHEREAS by Resolution #204/97 passed on June 2, 1997, Council authorized the purchase of two laser radar units to be used by the Durham Regional Police Service to enhance the enforcement of speed limits in the City of Pickering; and WHEREAS the Durham Regional Police Service does have a Traffic Enforcement Branch that is required to enforce traffic issues throughout the entire Regional Municipality of Durham and is not able to undertake traffic enforcement problems on City-owned streets on a regular basis; and WHEREAS through the Traffic Management Study, residents expressed frustration of lack of enforcement of excessive speeding on residential streets; and WHEREAS photo radar was introduced by the Province of Ontario and used on major highways with great success in reducing speeding and accidents and has since been discontinued; and WHEREAS the technology is available for a non-police officer, such as a Municipal Law Enforcement Officer, to man, monitor and operate photo radar equipment without stopping the vehicle driver on residential streets where speeding is causing safety concerns; NOW THEREFORE the Council of the Corporation of the City of Pickering hereby requests the Minister of Transport to pass legislation that will permit municipalities to enforce speeding on roads within their jurisdiction through the use of photo radar; and FURTHER THAT copies of this resolution be forwarded to the Honourable Janet Ecker, MPP, Pickering-Ajax-Uxbridge, all Durham municipalities and the Association of Municipalities of Ontario. By-law Number 6109/03 Being a by-law to authorize the acquisition of that part of Lot 15, Concession 7, Pickering, designated as Part 1, Plan 40R-21669 for road purposes. By-law Number 6110/03 Being a by-law to dedicate that part of Lot 15, Concession 7, Pickering, designated as Part 1, Plan 40R-21669 as public highway and name it "Eighth Concession Road". By-law Number 6111/03 Being a by-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the City of Pickering District Planning Area, Region of Durham, in Part of Lot 26, Range 3, B.F.C., Lots 127,128 and 129, Plan 1051, in the City of Pickering. Councillor Brenner reported that various residents have commented on the inequity with respect to the Oak Ridges Morraine legislation. 2. Councillor Pickles questioned whether or not a response has been received from Transport Canada with respect to funding for the proposed airport study. 3. Councillor Pickles questioned the status with respect to a crossing guard at the Altona Forest Public School. 4. Councillor Pickles advised that he has received calls from residents in the Tridel Buildings requesting enforcement of speed limit on Valley Farm from Kingston Road to Pickering Parkway and he asked staff to report on signalization for thê intersection of Valley Farm Road and Pickering Parkway. 5. Councillor Johnson stated a concern with respect to the demolition of fifteen homes in North Pickering by Transport Canada. 6. Councillor Johnson commented on the work of residents assisting the poor in third world countries. 7. Councillor Johnson echoed the comments of Councillor Brenner with respect to the Oak Ridges Morraine legislation. Councilor McLean advised of the Big Brothers Bowl on Friday, March 21st. 8. 9. The following matters were discussed prior to the regular meeting: a. The Director, Planning & Development consulted with Council concerning a request by the Consultant to appear before Council to brief them on the presentation which will be made at a public meeting with respect to the Growth Management Study. b. Councillor Pickles advised of a presentation to be made by Gary Bowen of the Toronto and Region Conservation Authority with respect to Duffins and Carruthers Creeks. - 7- Council Meeting Minutes Monday, March 17,2003 8:03 p.m. VI CONFIRMATION BY-LAW By-law Number 6117/03 Councillor Holland, seconded by Councillor Johnson, moved for leave to introduce a By- law of the City of Pickering to confirm those proceedings of the Council of the Corporation of the City of Pickering at its Regular Meeting of March 17, 2003. OPERATIONS & EMERGENCY REPORT OES 08-03 TENDER FOR SPORTS FIELD LIGHTING, KINSMEN PARK TENDER T-5-2003 1. That Report OES 08-03 of the Director, Corporate Services & Treasurer and Director, Operations & Emergency Services, be received; and 2. That the expenditures and financing for Project 03-2718-001-00 in the amount of $400,000 for lighting and improvements at the Kinsmen Park and Project 03-2718-001-17 in the amount of $20,000 to upgrade the electrical service at Kinsmen Park, as included in the 2003 Capital Budget, be approved; and 3. That Tender No. T-5-2003 submitted by Loc-Pave Construction Limited in the amount of $183,398 (taxes included) for the configuration of an electrical distribution service upgrade, supply and installation of sports field lighting within Kinsmen Park, be accepted; and 4. That the optional price in Tender No. T-5-2003 submitted by Loc-Pave Construction Limited in the amount of $90,843 (taxes included) for the electrical work for the football field known as the Ajax-Pickering Dolphins Minor Football Club Field within Kinsmen Park, be accepted; and - 11 - Appendix II Committee of the Whole Report COW 2003-3 5. That contracted services in the amount of $28,913 be authorized for Veridian Connections, in order to undertake the necessary utility upgrade to facilitate sports field lighting projects; and 6. That Council approve the Financing Plan submitted February 17, 2003, by Mr. Jeff Priestman, President of the Ajax-Pickering Dolphins Minor Football Club for their contribution towards their portion of the shared costs of the partnership venture in the amount of $53,623 plus interest; and 7. That Council approve the Financing Plan submitted on March 14, 2003 by the Pickering Soccer Club for their contribution towards their portion of the shared costs of the partnership venture in the amount of $102,789 plus interest; and 8. That the balance of the work for the project, currently estimated at approximately $60,000, consisting of primarily irrigation requirements and field improvements and included in the projects approved under Recommendation 2 above, be approved; and 9. Council approve the City portion of the funding as follows: a) The Director, Corporate Services & Treasurer be authorized to finance the City's portion of the costs in the estimated amount of $230,000 (T-5-2003) project through the issuance of debt through the Region of Durham for a period not exceeding 5 years, at a rate to be determined, be approved and the balance of approximately $2,850 plus financing costs be financed from current funds; and b) That annual repayment charges in the amount of approximately $55,000 be included in the annual Current Budget for the City of Pickering commencing in 2004 and continuing thereafter until the loan is repaid; and c) That the Director, Corporate Services & Treasurer has certified that this loan and the repayment falls within the City's Debt and Financial Obligations approved Annual Repayment limit for debt and other financial obligations for 2002 as established by the Province for municipalities in Ontario; and d) That a temporary loan in the amount of approximately $102,789 less the initial deposit of $10,000 be extended to the Pickering Soccer Club; and, approximately $53,623 to the Ajax-Pickering Dolphins Football Club on terms and conditions satisfactory to the Treasurer; and - 12- ~'Ú¡ o~ I I I I Appendix II Committee of the Whole Report COW 2003-3 e) That the Director, Corporate Services & Treasurer be authorized to take any actions necessary in order to effect the foregoing; and 10.
