BY-LAW NUMBER 1002/79
Being a Restricted Area By-law to amend Restricted
Area By-law 3036, as amended, and to implement the
official Plan of the Town of Pickering District
Planning Area, Region of Durham, on Block Z, Plan
M-1058, in the Town of Pickering.
HEREAS the Council of the Corporation of the Town of Pickering
eems it expedient to permit the development of single detached
wellings to occur on the subject lands;
ND WHEREAS an amendment to By-law 3036 is therefore deemed
ecessary;
OW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
ICKERING HEREBY ENACTS AS FOLLOWS:
ECTION 1: BY-LAW 3036
y-law 3036, passed by the Council of the Corporation of the
own hip (now Town) of Pickering on the 3rd day of August
965, and approved by the Ontario Municipal Board on the 7th
r ay of October 1966, and amended from time to time, is hereby
t urther amended to the extent necessary to give effect to the
rovisions of Sections 2 and 3 of By-law 1002/79
ECTION 2: TEXT AMENDMENT
ection 10 of By-law 3036 is hereby amended by adding
hereto the following subsection:
0.3 SPECIAL ZONES
0.3.1 SPECIAL SINGLE DETACHED DWELLINGS (SPECIAL SIDE YARD PROVIS:
Notwithstanding the provisions of Sections 10.1
and 10.2 hereof, the lands designated R4-1 on
Schedule "I" to By-law 1002/79 . shall not be
used except in accordance with the provisions
of this subsection.
`DEFINITIONS
In this subsection the following definitions shall
apply: %
(i) "DWELLING" shall mean one or more habitable
rooms occupied or capable of being occupied
as a single,independent and separate housekeeping
unit containing a separate kitchen and sanitary
facilities.
(ii) "SINGLE DWELLING" shall mean a building containing
not more than one dwelling and uses accessory
thereto.
(iii) "SINGLE DETACHED DWELLING" shall mean a single
dwelling which is freestanding, separate and
detached from other main buildings.
(iv) "LOT FRONTAGE" shall mean the horizontal distance
between the side lot lines, such distance being
measured along a line which is parallel to and
7.5 m distant from the front lot line.
(v) "FLOOR AREA" shall mean the total area of
all storeys contained within the outside walls
of a building excluding, in the case of a
building containing a dwelling or dwellings,
any private garage, porch, verandah, sunroom,
balcony, basement recreation room, unfinished
attic or basement.

(vi) "PRIVATE GARAGE" shall mean an enclosed or partially
enclosed structure for the storage of one or more
vehicles, in which structure no business or service
is conducted for profit or otherwise.
(vii) "YARD" shall mean an area of land which is appurtenant
to and located on the same lot as a building or
structure and is open, uncovered and unoccupied
above ground except for such accessory buildings,
structures or other uses as are specifically permitted
thereon.
(viii) "FRONT YARD".shall mean a yard extending across the
full width of a lot between the front lot line
of the lot and the nearest wall of the nearest main
building or structure on the lot.
(ix) "FRONT YARD DEPTH" shall mean the shortest horizontal
dimension of a front yard of a lot between the front
lot line and the nearest wall of the nearest main
building or structure on the lot.
(x) "REAR YARD" shall mean a yard extending across the
full width of a lot between the rear lot line of
the lot or, where there is no rear lot line, the
junction point of the side lot lines, and the nearest
wall of the nearest main building or structure on
the lot.
(xi) "REAR YARD DEPTH" shall mean the shortest horizontal
dimension of a rear yard of a lot between the rear
lot line or,._where there is no rear lot line,
the junction point of the side lot lines, and the
nearest wall of the nearest main building or
structure on the lot.
(xii) "SIDE YARD" shall mean a yard of a lot extending
from the front yard to the rear yard and from the side
lot line to the nearest wall of the nearest main
building or structure on the lot.
(xiii) "SIDE YARD WIDTH" shall mean the shortest horizontal
dimension of a side yard of a lot between the side
lot line and the nearest wall of the nearest main
building or structure on the lot.
(xiv) "FLANKAGE SIDE YARD" shall mean a side yard immediately
adjoining a street or abuttinrr on a reserve on the
opposite side of which is a street.
(xv) "INTERIOR SIDE YARD" shall mean a side yard other
than a lankage side yard.

USES PERMITTED
No person shall within the lands designated R4-1 on
Schedule "I" to By-law 1002 79erect, alter, or use any
building or structure for any purpose except the following:
(i) single detached dwelling residential uses

C. ZONE REQUIREMENTS
No person shall within the lands designated R4-1 on Schedule
"I" to By-law 1002/79 erect, alter or use any building or
structure unless such lot is served by a public water system
and a sanitary sewer system and except in accordance with
the following provisions:

SPECIAL SIDE YARD PROVISIONS:
(a) each lot to which this section applies that abuts
on its side lot line a lot to which this section
does not apply shall provide a side yard having
a minimum side yard width of 1.8 metres, adjacent
to the latter lot.
(b) no doors or windows from habitable rooms shall be
permitted on a wall of any building when that wall
of the building is closer than 1.2 metres to the
side lot line closest to it.
(c) the horizontal distance between buildings on
adjacent lots to which this section applies shall
be not less than 1.8 metres.

SECTION 3: SCHEDULE "A" AMENDMENT
Schedule "A" to By-law 3036, as amended, is hereby further
amended by altering from "A" to "R4-1" the zone designation
Df the lands designated R4-1 on Schedule "I" hereto
and comprising Block Z of Plan M-1058.
SECTION 4: EFFECTIVE DATE
No part of this By-law shall come into force without the
approval of the Ontario Municipal Board but, subject to
such approval, this By-law shall take effect from the day
Df passing hereof.

EFFECT OF BY-LAW
"R4-1" Special Single Detached
Dwelling Zone
The purpose of this by-law is to amend
Restricted Area By-law 3036 to create an
"R4-1" Special Single Detached Dwelling Zone.
The effect of this by-law is to enable the
development on the subject lands of:
- 39 single detached dwelling units each
on a lot with a minimum 10 metres lot
frontage and 300 square metres lot area
subject to certain other provisions as
indicated.
