BY-LAW NO. 2428/87
Being a by-law to authorize the execution of a
Transfer from The Corporation of the Town of
Picketing to Janice Raven respecting Part Lot 7,
Plan 221, Picketing, designated as Part 54, Plan
40R-4433 (Sheppard Avenue).
WHEREAS the Corporation of the Township of Pickering (of which The Corporation of
the Town of Pickering is the successor) is the owner of certain lands in Lot 7, Plan
221, Pickering, designated as Part 54, Plan 40R-4433; and
WHEREAS those lands are no longer required for the purposes of the Corporation, the
lands having been stopped up as public highway by By-law 1097/80, enacted April 8,
1980, and registered as Instrument No. D106177 on April 14, 1980;
NOW THEREFORE, the Council of the Corporation of the Town of Picketing HEREBY
ENACTS AS FOLLOWS:
The Mayor and Clerk are hereby authorized to execute a Transfer in the form
attached hereto as Schedule A, of Part Lot 7, Plan 221, Pickering, designated
as Part 54, Plan 40R-4433, between the Corporation of the Town o{ Picketing
and the owner of the lands immediately adjacent, on the north side, of the
lands referred to above.
The Mayor and Clerk are hereby authorized to execute an Indemnification
Agreement, in the form attached hereto as Schedule B, between Janice Raven
and The Corporation of the Town of Picketing, respecting the indemnification of
the Town for any utility relocation costs which may be incurred as a result of
the Transfer referred to in section 1.
BY-LAW read a first, second and third time and finally passed this 6th day of April,
1987.

THE CORPORATION OF THE TOWN OF PICKERING
hereinafter called the "Town"
OF THE FIRST PART,
- and -
JANICE MARIE RAVEN
hereinafter called the "Owner"
OF THE SECOND PART.
WHEREAS, by Instrument dated , 1987, and registered in the Regis-
try Office for the Registry Division of Durham as Instrument No. , the Town
has conveyed to the Owner certain land in the Town of Picketing;
NOW THEREFORE, TtlIS AGREEMENT WITNESSETtl

The land affected by this Agreement (herein called the "Land") is that p.art of
Lot 7, Plan 221, Pickering, designated as Part 54, Plan 40R-4433.
The Owner shall save harmless and indemnify the Town from and against all
claims and demands in respect of the conveyance by the Town to the Owner of
the Land, and from and against all losses, damages, costs, charges and ex-
penses which the Town may sustain or incur as a result of the location or
relocation of any public or quasi-public utility or service necessitated by,
caused by, or. resulting in any way from the above-mentioned conveyance.
This Agreement and everything contained herein shall enure to the benefit of
and be binding upon the Parties hereto and their respective heirs, administra-
tors, successors and assigns.
IN WITNESS WHEREOF the Party of the First Part has hereunto set her hand and seal
and the Party of the Second Part has hereunto affixed its corporate seal, duly au-
thorized by its proper officers.

I, David Raven, spouse of Janice Marie Raven, the Owner herein, hereby consent to
the execution and entering into of this Agreement by Janice Marie Raven and to the
registration of the Agreement upon the title to the lands affected hereby and agree to
be bound by the terms of the said Agreement.
