That Council approve the change in scope of work to Tender No. T-2024-7, Beachfront Park Master Plan (Phase 1 Implementation) and Alex Robertson Park Gravel Parking Lot construction contract, awarded to Rutherford Contracting Ltd in the amount of $165,839.00 (HST included); 2. That Council authorize the Director, Finance & Treasurer to finance the scope of work change from the contingency approved by Council (ENG 15-24, Resolution #567/24) for Beachfront Park Master Plan (Phase 1 Implementation); and, 3. That the appropriate officials of the City of Pickering be authorized to take the necessary actions as indicated in this report. Executive Summary: The purpose of this report is to obtain Council approval to use contingency funds from the Beachfront Park Master Plan (Phase 1 Implementation) construction contract to reconstruct the asphalt Waterfront Trail from Sandy Beach Road to Beachfront Park as a scope of work change. This section of the trail has been used as the equipment and materials access route to Beachfront Park for the duration of the construction work. An allowance for localized repairs to the trail were included in the project, however a full reconstruction of the trail was included in the 2026 Capital Forecast. Rather than having the full trail reconstruction as a separate and future project, staff recommend that the work be completed at this time, while the trail is already fenced off and closed to the public. There is an opportunity for the City to realize significant future cost savings if Council approves the additional work, and there are sufficient funds remaining in the Beachfront Park Master Plan (Phase 1) contingency to cover the additional cost to fully reconstruct the trail. Rutherford Contracting Ltd. have provided an estimate of $146,760.00 (excluding HST) to complete this work and have confirmed that it can be completed prior to the scheduled reopening of the Waterfront Trail and the Beachfront Park boardwalk in July. Relationship to the Pickering Strategic Plan: The recommendations in this report respond to the Pickering Strategic Plan Priority of Advocate for and Inclusive, Welcoming, Safe & ENG 13-25 June 9, 2025 Subject: Waterfront Trail Reconstruction Page 2 Healthy Community and Lead & Advocate for Environmental Stewardship, Innovation & Resiliency. Financial Implications: Beachfront Park Master Plan (Phase 1 Implementation) is being funded from Casino Reserve (50%) and the DC Parks & Recreation Reserve Fund (50%) under Account C10320.2206.01. The approved contingency amount on this project was $1,618,775.00 which represented 20% of the tendered costs for this portion of the project (the contingency for this project was higher due to construction risks associated with water related construction). As this project is nearing completion, staff can confirm that a significant amount of this contingency is unspent leaving sufficient funds to cover the estimated additional amount of $146,760.00 (excluding HST) and the net project cost of $149,343.00 (net HST) for the full reconstruction of the Waterfront Trail between Sandy Beach Road and Beachfront Park. The reconstruction of this trail was included as a project in the 2026 Capital Forecast in the amount of $226,900.00, with 50% funding from the DC Parks & Recreation Reserve Fund. A considerable savings will be recognized by awarding this work to the existing contractor through efficiencies such as utilizing the existing site security fencing and mobilization charges. Rutherford Contracting Ltd., who are the contractors for the Beachfront Park Master Plan (Phase 1 Implementation) project have provided an estimate in the amount of $146,760.00 (excluding HST) to complete this additional work, and have confirmed that it can be completed prior to the scheduled reopening of the Waterfront Trail and the Beachfront Park boardwalk. The work would include the pulverizing of the existing asphalt pathway surface, regrading, compacting and providing additional Granular ‘A’ material as required, asphalt pavement (40mm HL3 on 40mm HL8 asphalt) and terra-seeding areas that have been disturbed along the edge of the path. The contractor will also install two cross culverts and provide some localized ditching in areas where there is currently surface drainage across the path. The existing 3.0 meter width of the path will be maintained and a center line will be painted down the path. The work will extend from the intersection of Sandy Beach Road and Montgomery Park Road (east limit) to Beachfront Park (west limit) and will also include the connecting paths that run north into Alex Robertson Park, to the entrance of the new gravel parking lot. Staff recommend that rather than having the reconstruction of this section of the Waterfront Trail as a separate and future project, the work be completed at this time while the trail is currently fenced off and closed to the public. There are sufficient funds remaining in the project contingency for Beachfront Park Master Plan (Phase 1 Implementation) construction to cover ENG 13-25 June 9, 2025 Subject: Waterfront Trail Reconstruction Page 3 the costs to reconstruct the entire section of Waterfront Trail from Sandy Beach Road to Beachfront Park.
