HomeMy WebLinkAboutBy-law 8120/24The Corporation of the City of Pickering By-law No. 8120/24 Being a by-law to amend Zoning By-law 3036, as amended by By-law 7446/15, to remove the “(H)” Holding Provision from the subject lands, being Lot 1, Plan 40M-2597 (A 03/24) Whereas Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended, permits a Council to pass a by-law prohibiting the use of land, buildings or structures within a defined area or areas; Whereas Section 36 of the Planning Act, R.S.O. 1990, c.P.13, as amended, permits a Council to pass a by-law to specify the use to which lands, buildings or structures may be put at such time in the future as the hold symbol is removed by amendment to the by-law; Whereas Zoning By-law 3036, as amended by By-law 7446/15, is the governing By-law of The Corporation of the City of Pickering pertaining to the subject lands, being Lot 1, Plan 40M-2597; Whereas the Council of The Corporation of the City of Pickering has deemed it advisable to amend Zoning By-law 3036, as amended by By-law 7446/15; Whereas it has been confirmed to the Council of The Corporation of the City of Pickering that the condition required for the removal of the “(H)” Holding Provision from the subject lands has been addressed to the satisfaction of the City; and Now therefore the Council of The Corporation of the City of Pickering hereby enacts as follows: 1. Schedule I Schedule I to By-law 7446/15, is hereby amended by removing the “(H)” Holding Provision preceding the “S5-2” Zone designation on Lot 1, Plan 40M-2597, as set out on Schedule I to this By-law. 2. Text Amendment Section 6 of By-law 7446/15 is hereby repealed. 3. Area Restricted By-law 3036, as amended by By-law 7446/15, is hereby further amended only to the extent necessary to give effect to the provisions of this By-law as it applies to the area set out in Schedule I to this By-law. Definitions and subject matters not specifically dealt with in this By-law shall be governed by relevant provisions of By-law 3036, as amended by By-law 7446/15. By-law No. 8120/24 Page 2 4.Effective Date This By-law shall come into force in accordance with the provisions of the Planning Act.
