HomeMy WebLinkAboutBy-law 1997/85THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO. 1997 /85 Being a by-law to authorize the execution of an Application to Amend the Land Titles Register to delete therefrom certain agreements dated from July 29th, 1975 to ~arch 2nd, 1981, between Torwest Properties Limited or Bramalea Limited and The Corporation of the Town of Pickering respecting the servicing/deve]opment/slte planning of that part of Lot 19, Range 3, B.F.C., Picker- lng, designated at Part 4, Plan 40R-2384 (draft plan 18T-83013) WHEREAS The Corporation of the Town of Pickering has released Torwest Properties Limited or Bramalea Limited from the provisions of various servicing/development/site planning agreements dated between July 29th, 1975 and March 2nd, 1981, inclusive, respecting that part of Lot 19, Range 3, B.F.C., Pickering, designated as Part 4, Plan 40R-Z384 (now comprising draft plan 18T-83013); NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The Mayor and Clerk are hereby authorized to execute an Application, in the form attached hereto as Schedule A, to Amend the Land Titles Register to delete from the title to that part of Lot 19, Range 3, B.F.C., Picketing, des- ignated as Part 4, Plan 40R-2384, (a) Site Plan Agreement dated July 29th, 1975, registered August 27th, 1975 as Instrument No. D13812, between Torwest Properties Limited and The Corporation of the Town of Picketing; (b) Development Agreement dated August 8th, 1978, registered September 8th, 1978 as Instrument No. D76417, between Torwest Properties Limited, The Corporation of the Town of Picketing and Harvey Hubbell of Canada Limited; (c) Agreement dated March 2nd, 1981, registered May 28th, 1981 as Instru- ment No. D123259, between Bramalea Limited, The Corporation of the Town of Picketing and The Royal Bank of Canada; (d) Agreement dated March 2nd, 1981, registered May 28th, 1981 as Instru- ment No. D123260, between Bramalea Limited, The Corporation of the Town of Pickering and The Royal Bank of Canada; and (e) Agreement dated March 2nd, 1981, registered May 28th, 1981 as Instru- ment No. D123261, between Bramalea Limited, The Corporation of the Town of Picketing and The Royal Bank of Canada. BY-LAW read a first, April, 1985. second and third time and finally passed this 1st day of SCHEDULE A TO BY-LAW NUMBER 1997/85 LAND TITLES ACT APPLICATION TO AMEND REGISTER (Section 80) TO: The Land Registrar for the Land Titles Division of Durham (No. 40) THE CORPORATION OF THE TOWN OF PICKERING having a legal interest in the land registered as Parcel Plan-1, in the Register for Section 40M- , Picketing, of which BRAMALEA LIMITED is the registered owner, hereby applies under section 80 of the Land Titles Act to have the Register for the Parcel amended by deleting therefrom: (a) Site Plan Agreement dated July 29th, 1975, registered August 27th, I975 as Instrument No. D13812, between Torwest Properties Limited and The Corporation of the Town of Picketing; (b) Development Agreement dated August 8th, 1978. registered September 8th, 1978 as Instrument No. D76417, between Torwest Properties Limited, The Corporation of the Town of Picketing and Harvey Hubbell of Canada Limited; (c) Agreement dated March 2nd, 1981, registered May 28th, 1981 as Instru- ment No. D123259, between Bramalea Limited, The Gorporation of the Town of Picketing and The Royal Bank of Canada; (d) Agreement dated March 2nd, 1981, registered May 28th, 1981 as Instru- ment No. D123260, between Bramalea Limited, The Corporation of the Town of Picketing and The Royal Bank of Canada; and (e) Agreement dated March 2nd, 1981, registered May 28th, 1981 as Instru- ment No. D123261, between Brama]ea Limited, The Corporation of the Town of Pickering and The Royal Bank of Canada.
