Delegations 4.1 Chris Uchiyama, LHC Heritage Planning & Archaeology Re: Part IV Designation of 301 Kingston Road Chris Uchiyama, LHC Heritage Planning & Archaeology spoke to the Heritage Impact Assessments conducted for 301 Kingston Road, and that the latest assessment does not recommend the designation based on the structures current condition. A question and answer period ensued between the Committee and Ms. Uchiyama regarding: • concerns regarding the scope of the first assessment being focused on what material could be salvaged rather than whether the property should be designated; • whether it was possible to determine the amount of damage that occurred while under ownership of the current owner; • clarification regarding the Committee’s past discussions on the 301 Kingston Road property; • concerns regarding the time constraints around a decision to designate; • concerns around the potential demolition of the building and the loss of cultural heritage value; • changes made to the features of the property between 2022 and 2023; • clarification that LHC Heritage does not recommend designation of the building at 301 Kingston Road; • clarification that designation would prevent the demolition of the structure and require heritage permits to be issued to perform any work on the building; and, • clarification that the structure is the only two-storey Georgian type building in Pickering. 4.2 Iain Donnell, Donnell Law Group Re: Part IV Designation of 301 Kingston Road Iain Donnell, Donnell Law Group provided comments on behalf of the owner, indicating that the City and the owner have differing ideas of - 2 - Page 3 of 5 Item/ Ref # Details & Discussion & Conclusion (summary of discussion) Action Items/Status (include deadline as appropriate) commemorating the heritage value of the property. He stated that while he understood the concerns raised, he questioned the value of designation of the building which had been considerably modified. A question and answer period ensued between the Committee and Mr. Donnell regarding: • clarification that the owner would require a permit to make changes and alterations to the building if designated; • clarification regarding the cost figures provided by Clark Engineering in the Report; • clarification that the designation would apply to the home in its current condition; • clarification regarding the opportunity to incorporate heritage materials and recognition into any new structure on the site; • clarification that the designation of the house would not prohibit the owner from building elsewhere on the property; • concerns regarding the property continuing to sit in its current condition; • whether it was possible to place a covenant on the land to force the owner to implement heritage design elements on the property in the future; • concerns regarding the timelines imposed by the owner through the application for a demolition permit; • concerns regarding the significant cost to restore the building; • clarification regarding the client’s intention with the property; and, • whether the client would be willing to withdraw the latest demolition permit application to continue working with the City. 5. New Business 5.1 Part IV Designation of 301 Kingston Road - 3 - Page 4 of 5 Item/ Ref # Details & Discussion & Conclusion (summary of discussion) Action Items/Status (include deadline as appropriate) Game provided an overview of Memorandum provided regarding the Part IV Designation of 301 Kingston Road and indicated that the City identifies this building as a valuable Heritage resource. Discussion ensued amongst the Committee regarding: • clarification regarding the current ownership of the property since 2016; • the differing opinions offered by the Reports regarding the structural integrity of the building; • potential scenarios that could occur if heritage designation is applied; • the Notice of Intention to Designate and appeal process that would occur should Council resolve to designate the building; • whether there are other options that can be considered to incorporate heritage elements into any potential future development on the site; and, • concerns regarding the potential for ongoing neglect of the property. Moved by C. Doody-Hamilton Seconded by A. Bhadra 1. That Heritage Pickering refuse the “Request for Demolition” of the house at 301 Kingston Road based on its cultural heritage value or interest; 2. That the property at 301 Kingston Road be designated under Part IV of the Ontario Heritage Act; and, 3. That the recommendations of the Heritage Pickering Advisory Committee be forwarded to Council for their consideration. Carried 6. Delegations 3.2 Shea Lasky Re: Municipal Heritage Register Review and Update - 1027-1031 Dunbarton Road, Part IV Designation under the Ontario Heritage Act Shea Lasky spoke to his opposition to the proposed heritage designation citing fears that it could reduce the value of the property. He - 6 - Page 2 of 6 Item/ Ref # Details & Discussion & Conclusion (summary of discussion) Action Items/Status (include deadline as appropriate) indicated that he did not intend to sell the property and that he is looking to add an extension. He spoke to his intention to raise his family in the home and expressed that he thought it was unfair for Council to potentially make a decision that could decrease the property’s value. A question and answer period ensued between the Committee and Mr. Laskin regarding: • the potential for future buyers to be scared off by a heritage designation on the property; and, • clarification as to why there is concern for reduced property value if there is no intent to sell the property at present. 3.1 Alexis Whalen, Chair, Land Over Landings John Sabean, Founder, Pickering Township Historical Society Re: Brougham Hall Community Centre Alexis Whalen, Chair, Land Over Landings and John Sabean, Founder, Pickering Township Historical Society spoke to the Brougham Hall Community Centre, noting its historical significance, the building’s current condition, and the lease that the City has with Transport Canada. They requested that the Committee advise Council regarding the risks and costs of the Community Centre’s continued closure. A question and answer period ensued between the Committee and Ms. Whalen and Mr. Sabean regarding: • clarification regarding the City’s lease agreement with Transport Canada for the use of Brougham Hall Community Centre; • clarification regarding the facility being part of the Federal Airport Lands historically expropriated and still owned by Transport Canada; • the various historic buildings identified on the Federal Airport Lands; • clarification that the land is not protected as part of the Oak Ridges Moraine; • the importance of the building in the surrounding context of historic Brougham; - 7 - Page 3 of 6 Item/ Ref # Details & Discussion & Conclusion (summary of discussion) Action Items/Status (include deadline as appropriate) • whether Transport Canada could be engaged regarding the upkeep and maintenance of the facility; • the City’s responsibility for maintenance and upkeep of the building under the current lease agreement; • Transport Canada’s repair of the roof of the facility in 2019; • concerns regarding the various levels of government involved and whether preserving historical buildings is one of their priorities; • whether the federal heritage agency is aware of this building; • concerns regarding the building being within the City’s Facility Renewal Study conducted in January 2024; • whether there were funding opportunities to assist with the maintenance or restoration of the building; • the revenue opportunities for the City if the building was reopened for facility rentals; • the current federal heritage designation under the Federal Heritage Buildings Review Office (FHBRO); and, • clarification that the federal government does not have to abide by a municipal designation under the Ontario Heritage Act. The Committee discussed drafting a Motion to recommend action to City Council regarding Brougham Hall Community Centre. The Committee indicated that a Motion could be drafted for consideration at a future meeting. The Committee engaged in discussion regarding whether potential loss of property value is a valid concern for owners of heritage properties. C. Doody-Hamilton agreed to work with the Committee to create an initial draft Motion for consideration at a future meeting. 5. New Business 5.1 2023 Year-End Report and 2024 Work Plan E. Carried 5.2 Notice of Intention to Designate - 895 Wonder Drive (formerly 815 Highway 7) E. Game provided an overview of the Notice of Intention to Designate 895 Wonder Drive (formerly 815 Highway 7) including the draft Notice of Intention to Designate and Designation By-law. Moved by C. Doody-Hamilton Seconded by S. Monaghan That Heritage Pickering Advisory Committee supports the draft designation by-law attached in Attachment 5 of this report. Carried 5.3 Municipal Heritage Register Review and Update - 1027-1031 Dunbarton Road, Part IV Designation under the Ontario Heritage Act E. Game provided an overview of the subject property including: • a brief background the property; • the Cultural Heritage Evaluation Report (CHER) conducted for the subject property; • the description of historic place • statement of Cultural Heritage Value; and, • a list of heritage attributes. The Committee engaged in discussion regarding: • the rarity of the structure type throughout Ontario; - 9 - Page 5 of 6 Item/ Ref # Details & Discussion & Conclusion (summary of discussion) Action Items/Status (include deadline as appropriate) • the owner’s expressed concerns regarding impacts to property value; • concerns regarding provincial legislation that could put the property at risk of demolition in not designated by January 1, 2025; • concerns regarding future window replacement and what materials would be permitted to be used if designated; • the adjacent building at the kitty corner that was built in 1953. Moved by L. Jeffrey Seconded by J. White That Heritage Pickering supports the Part IV designation of 1027-1031 Dunbarton Road under Section 29 of the Ontario Heritage Act. Carried 6. Other Business 6.1 301 Kingston Road Update E. Game provided an update regarding the Council decision on March 25, 2024 regarding the designation of 301 Kingston Road, and indicated that she will keep the Committee updated throughout the process. 7. Next Meeting The next regular meeting of the Heritage Pickering Advisory Committee is scheduled for April 24, 2024. The Committee discussed the Special Meeting that may be called regarding Brougham Hall Community Centre prior to the next scheduled meeting. 8. Adjournment Moved by S. Monaghan Seconded by C.
