HomeMy WebLinkAboutBy-law 3785/91THE CORPORATION OF THE TOWN OF PICKERING_ BY-LAW NO. 3785/91 Being a by-law to assume Dahlia Crescent, Plan M-1128, Pickering, for public use as public highway under the jurisdiction of the Town. WHEREAS, Dahlia Crescent is a highway shown on a plan of subdivision and is therefore deemed, pursuant to the Surveys Act, R.S.O. 1980, c.493, s.57, to be public highway; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, s.259, the Council of The Corporation of the Town of Picketing has jurisdiction over that highway (the Council of The Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipality of Durham Act, R.S.O. 1980, c.434, s.28, to add that highway to the regional road system); and WHEREAS pursuant to the Municipal Act, s.258, the soil and freehold of that highway is therefore vested in The Coq>oration of the Town of Pickering; NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS FOLLOWS: The following highway is hereby assumed for public use as public highway under the jurisdiction of the Council of The Corporation of the Town of Pickering: Dahlia Crescent according to Plan M-1128, Town of Pickering, Regional Municipality of Durham. The Town Solicitor is hereby authorized to apply to the Land Registrar pursuant to the Land Titles Act, R.S.O. 1980, c.230, s.151, to have the Corporation entered as the owner of the highway referred to in section 1.
