Being a by-law to authorize the execution of a Release
and Discharge of the Subdivision Agreement, and
amendments thereto, respecting Plan M-lO40, Pickering.
WHEREAS, pursuant to the Planning Act, 1983, S.O. 1983, c.1, s.50, or a predecessor thereof, The
Corporation of the Township of Picketing and Simon-Henry Kaptyn Estates Limited entered into an
Agreement dated December 10, 1973, Notice of which was registered on September 24, 1975 as
Instrument No. LTD9072, which Agreement was subsequently amended by Agreements dated July 6,
1977 and October 16, 1978, Notices of which were registered on July 28, 1977 and November 20, 1978
as Instrument Numbers LTD48686 and LT80875, respecting the subdivision and development of Plan
M-1040, Picketing; and
WHEREAS The Corporation of the Town of Picketing, as successor to The Corporation of the
Township of Picketing, wishes to acknowledge that the terms and conditions of those Agreements are
redundant due to the development of the land by means other than those required by those Agreements;
NOW THEREFORE, the Council of The Corporation of the Town of Pickering HEREBY ENACTS AS
FOLLOWS:
The Mayor and Clerk are hereby authorized to execute a Release and Discharge, in the form
attached hereto as Schedule A, of the Agreement dated December 10, 1973, Notice of which
was registered September 24, 1975 as Instrument No. LTD9072, between Simon-Henry Kaptyn
Estates Limited and The Corporation of the Township of Pickering, as amended by Subdivision
Agreements dated July 6, 1977 and October 16, 1978, Notices of which were registered on July
28, 1977 and November 20, 1978 as Instrument Numbers LTD48686 and LT80875, respecting
the subdivision and development of Plan M-1040, Picketing.
2. Schedule A hereto forms part of this By-law.

RELEASE AND DISCHARGE
WHEREAS the Agreement dated December 10, 1973, Notice of which was registered September 24,
1975, in the Land Registry Office for the Land Titles Division of Duxham (No. 40) as Instrument No.
LTD9072, between,
SIMON-HENRY KAPTYN ESTATES LIMITED
hereinafter referred to as the "Company"
THE CORPORATION OF THE TOWiX~~G
of which The Corporation of the Town of Pickering is the successor
hereinafter referred to as the "Town",
as amended by Agreements dated July 6, 1977 and October 16, 1978, Notices of which were registered
on July 28, 1977 and November 20, 1978, in that Office as Instrument Numbers LTD48686 and
LT80875, provided for the subdivision and development of lands affected hereby; and
WHEREAS The Corporation of the Town of Picketing wishes to release the Company from the terms
and conditions of those Agreements respecting the lands affected hereby;
THE TOWN HEREBY remises, releases and forever discharges the Company, its successors and
assigns, from any and all liabilities, actions, causes of action, debts, claims or demands of any kind
whatsoever which the Company may have been, is, or may become subject to pursuant to the provisions
of the Agreements referred to herein.
THIS RELEASE AND DISCHARGE affects the lands described as:
Lots 1-32, inclusive, Blocks A-J, inclusive, Henry Street, Captain Street and Simon Street, Plan
M-1040, Town of Picketing, Regional Municipality of Durham.
IN WITNESS WHEREOF the Town has hereunto affixed its corporate seal, attested to by its properly
authorized officers.
