HomeMy WebLinkAboutBy-law 3777/91THE CORPORAT!ON OF THE TOWN OF PICKERING BY-LAW NO. 3777/01 Being a by-law to amend By-law 3740/91, authorizing the execution of a Subdivision Agreement respecting the development of part of Lot 33, Range 3, Broken Front Concession, Pickering (Cougs Investments Ltd.; 18T-88100). WHEREAS the proposal to subdivide and register a plan of subdivision of Part Lot 33, Range 3, Broken Front Concession, Pickering, has been recommended for approval by the Council of The Corporation of the Town of Picketing and approved by the Commissioner of Planning of the Regional Mumcipality of Durham as Draft Plan 18T-88100, subject to several conditions, one of which requixes the entering into of a satisfactory Subdivision Agreement with The Corporation of the Town of Pickering, pursuant to the provisions of the Planning Act 1983, S.O. 1983, chapter 1, section 50(6); and WHEREAS, pursuant to those provisions, the Council of The Corporation of the Town of Picketing enacted By-law 3740~I on June 18, 1991, authorizing the execution of such an Agreement which formed Schedule A thereto and which it is now deemed advisable to amend in certain respects; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: Section 32 of Schedule A to By-law 3740/91 is hereby deleted and the following substituted for it: 32. pROVISION OF pARKL4~qD (1) Following the transfer to the Town of that part of Lot 27, Concession 2, Pickering, designated as Part 1, Plan 40R-13525, as parkland pursuant to the provisions of the Subdivision Agreement affecting Draft Plan 18T-89052(R), now Plan 4OM- , Pickering, the Owner had a parkland credit of 0.3058725 hectares which was to be applied to the Town's future parkland requirements for the development of lands in Lot 27, Concession 2, Pickering. (2) A portion of that credit, namely 0.1536848 hectares, has been accepted by the Town in full satisfaction of the Owner's obligation to provide parkland for the development of Draft Plan 18T-89054, now Plan 4OM- (3) A further portion of that credit, namely 0.1388121 hectares, has been accepted by the Town in full satisfaction of the Owner's obligation to provide parkland for the development of this plan, notwithstanding that this plan is not within Lot 27, Concession 2, Pickering. (4) Following the registration of this plan, therefore, the Owner's parkland credit shall be 0.0133756 hectares. Schedule A of Schedule A to By-law 3740/91 is hereby amended by adding to it the following section: 10. FENCING (1) The Owner shall erect 1.8 metres high wood privacy fencing along the east boundary of Lots 22 to 28 within the six months immediately following the occupancy of the first dwelling unit to be occupied on any of Lots 22 to 28, despite the provisions of section I of Schedule A. (2) ($) Despite the provisions of subsection (1), where the occupancy of the first dwelling unit occurs in November or December of any year, the time limit for construction of the fencing shall be extended to June 30 in the following year. The fencing required to be erected by the Owner pursuant to this section shall be constructed so as to meet or exceed the requirements for swimming pool enclosures as set out in Part II of the Town's By-Law 425/76, as amended from time to time, or any successor thereto, BY-LAW read a f/xst, second and third time and finally passed this'~ day of August, 1991. _--lllll ".
