HomeMy WebLinkAboutBy-law 3769/91THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 3769/91 Being a by-law to adopt Amendment Number 64 to the District Plan for the Town of Pickering. Whereas, pursuant to the Planning Act, 1983, S.O. 1983, c. 1, subsections 17(6) and 21(1) the Council of the Corporation of the Town of Pickering may by by-law adopt amendments to the District Plan for the Town of Pickering, being an official plan, and submit them to the Minister of Municipal Affairs for approval; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: L Amendment Number 64 to the District Plan for the Town of Picketing, attached hereto as Exhibit "A" and including the Explanatory Text, ~s hereby adopted. The Clerk of the Town of Pickering is hereby authorized and directed to submit Amendment Number 64 to the District Plan for the Town of Pickering to the Ministry of Municipal Affairs for approval. 3. This By-law shall come into force and take effect on the day of the final passing hereof. By-law read a first, second and third time and finally passed this 7th day of August, 1991. Mayor Clerk I'TOWN OF PICKERING ^PPR~)VED AME~NDMENT NO. 64 TOTHE TOWN OF PICIC~RING DISTRICT PLAN ~t~ co~ eLA~0 ANIFdCDM~NT NO. 64 TO TH~ TOWN OF' PIC~-3~G DISTRICT PLAN (LIVERPOOL COMMUNITY PLAN) PURPOSE: LOCATION: BASIS: ACTUAL AMENDMENT: The purpose of this amendment is to permit a mixed use development consisting of banquet facility, hotel, hotel support commercial, office, office support retail, and medium density residential uses on the subject property. The subject lands consist of approximately3.18 hectares located on the south side of Finch Avenue between Brock Road and Royal Road. The lands are generally described as Part of Lot 19, Concession 1, Town of Picketing. The proposal for a mixed use development has been determined to be appropriate given the locational attributes of the site, the creation of additional employment opportunities, the oppornmity to establish uses which are currently lacking in the Town, the maintenance of medium density housing, and the opl?ormnlty to achieve a comprehensive and integrated site plan for the entire property. The Town of Pickering District Plan - Liverpool Commnnity Plan is hereby amended by: (i) Deleting in its entirety, Section 5.B.(d) and replace it with the following: "Precinct No. 1 includes lands bounded by Kingston Road, Brock Road, Finch Avenue and Royal Road. The Precinct is situated in close proximity to the Town Centre, and is highly v/sible and accessible. These lands are suitable for the development of a variety of commercial and medium density residential uses. The southerly portion of the Precinct may be developed as a Local Central Area in accordance with subsection 3.B.(d) of this Community Plato -2- The northerly portion of the Precinct may be developed as a Mixed Use area in accordance with the following: (i) Residential medium density I uses oriented toward Finch Avenue and Royal Road and designed such that the residential neighbourhood to the west of Royal Road is not adversely affected by loss of privacy or sunlight, or increased traffic; (a) Hotel, hotel commercial, banquet, office, and office-support retail uses oriented toward Brock Road; and (iii) An architectural and/or landscaping focal point oriented toward the comer of Brock Road and Finch Avenue. Development within Precinct No. I shall proceed by site-specific amendment to the zoning by-law. The site-specific amendment shall establish appropriate zoning provisions including parking restrictions, building heights and forms, floor areas, and locations for the various perrmtted uses within the Precinct. In considering whether to ap. prove a site-specific amendment, Coundl shall consider the relauve locations and conceptual designs of the p. roposed buildings and structures within the Precinct, the compaubiiity of the development proposal with adjacent lan.ds,, and the appearance and relationship of the proposal to the adjacent streets. If approved, development shall be subject to the landowner entering into an appropriate site/development agreement with the Town." (ii) amending Schedule III A, Planning Community No. 3, Liverpool Community Plan, as indicated /n Exhibit "A" attached to this Amendment. IMPLEMENTATION: The provisions set forth in the Town of Pickering District Plan, as amended, regarding the implementation of the Plan shall apply in regard to this Amendment. INTERPRETATION: The provisions set forth in the Town of Picketing District Plan, as amended, regarding the interpretation of the Plan shall apply in regard to this Amendment.
