HomeMy WebLinkAboutBy-law 3721/91THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NO, 3721/91 Being a by-law to assume Portland Court, Plan 40M-1352, Pickering, fi~r public use as public highway under the jurisdiction of the Town. WHEREAS, Portland Court is a highway shown on a plan of subdivision and is therefore deemed, pursuant to the Surveys Act, R.S.O. 1980, c.493, s.57, to be a public highway; and WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, c.302, s.259, the Council of The Corporation of the Town of Picketing has jurisdiction over that highway (the Council of The Regional Municipality of Durham not having enacted a by-law pursuant to the Regional Municipality of Durham Act, R.S.O. 1980, c.434, s.28, to add that highway to the regional road system); and WHEREAS pursuant to the Municipal Act, s.258, the soil and freehold of that highway is therefore vested in The Corporation of the Town of Picketing; NOW THEREFORE, the Council of The Corporation of the Town of Picketing HEREBY ENACTS AS FOLLOWS: The following highway is hereby assumed for public use as a public highway under the jurisdiction of the Council of The Corporation of the Town of Picketing: Portland Court according to Plan 40M-1352, Town of Picketing, Regional Municipality of Durham. The Town Solicitor is hereby authorized to apply to the Land Registrar pursuant to the Land Titles Act, R.S.O. 1980, c.230, s.151, to have the Corporation entered as the owner of the highway referred to in section 1. BY-LAW read a fn'st, second and third time and finally passed this 3rd day of June, 1991. TOWN CF PICKERING APPROVED AS TO FORM LEGAL D£PT.~
