HomeMy WebLinkAboutBy-law 3709/91THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 3709/91 Being a By-law to amend Restricted Area (Zoning) By-law 2511, as amended, to partially implement the Official Plan of the Town of Picketing District Planning Area, Region of Durham in Part of Lot 18, Range 3, Broken Front Concession, in the Town of Picketing. (A 22/90) WHEREAS the Council of the Corporation of .the Town of Picketing deems it desirable to amend By-law 2511, as amended, to permit a vehicle sales and rental establishment in addition to uses presently permitted on the subject lands being Part of Lot 18, Range 3, Broken Front Concession, (Part 1, Plan 40R-1986) in the Town of Picketing; AND WHEREAS an amendment to By-law 2511, as amended, is therefore deemed necessary; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: 1. TEXT AMENDMENTS Section 17.4.2 of By-law 1572/82 is hereby amended by renumbering clauses (I) and (2) clauses (1)(a) and l(b) and by adding thereto the following clause: (2) (a) For the purpose of this subsection, the following definitions shall apply: as (b) (c) (i) "Body Shop" shall mean an establishment primarily engaged in repairing or painting vehicle bodies. (ii) A "Floor Area" shall mean the aggregate of the floor areas of all storeys above or below established grade, but shall exclude the floor area of any parts of the building used for mechanical equipment, stairwells, elevators, and any part of the building below established grade other than that used for retail commercial or office purposes; B "Gross Leasable Floor Area" shall mean the aggregate of the floor areas of all storeys above or below establishedgrade, designed for owner or tenant occupancy or exclusive use only, but excluding storage areas below established grade; (iii) "Vehicle Replair Shoo" shall mean an establishment containing facilities for the repair and rhaintenance of vehicles on the premises, in which vehicle accessories are sold and vehicle maintenance and repair operations are performed in return for remuneration, but shall not include a body shop or any establishment engaged in the retail sale of vehicle fuels; (iv) "Vehicle $a1¢~ or Rental Establishment" shall mean an establishment having as its main use the sale, service, rent or lease of vehicles and which may include an accessory vehic!e repair sho. p, but shall not include any establishment engaged in the retail sale of vehicle fuels. In addition to the provisions of Section 17.1 hereof, the lands designated "M2" on Schedule I to By-law 1572/82 may be used for the purpose of a vehicle sales or rental establishment. If these lands or any pa.rt of the. se. lands are used for a vehicle sales or rental establishment, the following prowsions shall apply: (i) All vehicles for sale or being displayed shall be kept totally within an 'enclosed structure or structures on the lot. (ii) The ~gross leasable floor area of any vehicle sales and rental estabhshment shall not exceed 325 square metres. (ii) There shall be provided and maintained on the subject lands a minimum of 123 parking spaces. BY-LAW 1572/82 By-law 2511, as amended by By-law. 1572/82, is. hereby furt.her am. ended only to the exte.nt necessary to give effect to the provisions of this By-law as It apphes to the area set out m Schedule I to By-law 1572/82. Definitions and subject matters not specifically dealt with in this By-law shallbe governed by the relevant provisions of By-law 25H, as amended. 3. EF This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
