HomeMy WebLinkAboutBy-law 3674/91THE CORPORATION OF THE TOWN OF PICKERING BY-LAW NUMBER 3674/91 Being a By-law to amend Restricted Area (Zoning) By-law 3036, as amended, to implement the Official Plan of the Town of Pickering District Planning Area, Region of Durham on Lot 7, Plan 40M-1511, North Part of Lot 10, Plan 1511 (Parts 13, 14 & 15, 40R-11631), North Part of Lot 11, Plan 40M-1511 (Part i0, 40R-11631), and North Part of Lot 13, Plan 40M-151l (Parts 2 & 16, 40R-11631), in the Town of Pickering. (A 23/90) WHEREAS the Council of the Corporation of the Town of Pickering passed By-law 2015/85 amending By-law 3036, to amend certain development provisions applicable to the subject lands; AND WHEREAS the Council of the Corporation of the Town of Pickering now deems it desirable to further amend By-law 2015/85, to permit the establishment of uncovered platforms in the rear yard; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF PICKERING HEREBY ENACTS AS FOLLOWS: Section 5(3)(b) of By-law 2015/85 is hereby further amended by adding thereto the following subclause: (xii) EXEMPTION: A This exemption applies only to the following lands: I Lot 7, Plan 40M-1511, Pickering; II That part of Lot 10, Plan 40M-1511, Pickering, designated as Parts 13, 14 and 15, Plan 40R-11631; III That part of Lot 11, Plan 40M-1511, Pickering, designated as Part 10, Plan 40R-11631; and IV That part of Lot 13, Plan 40M-1511, Pickering, designated as Parts 2 and 16, Plan 40R-11631. B Despite Section 5(3)(b)(vi) of By-law 2015/85 and Section 5.7(b) of By-law 3036, uncovered steps and platforms exceeding 1.0 metre in height above grade may project a maximum of 2.5 metres into the required rear yard of each lot so long as no part thereo[ shall exceed 2.5 metres in depth or 6.0 metres in width. C Despite Section 2.16 of By-law 3036, for the purpose of calculating maximum, lot coverage under Section 5(3)(b)(vii) of By-law 2015/85, uncovered steps and platforms shall be deemed not to be buildings or structures. BY-LAW 2015/85 By-law 2015/85 is hereby amended, only to the extent necessa~ to give effect to the provisions of this By-law. Definitions and subject matter not specifically dealth with in this By-law shall be governed by the relevant provisions of By-law 2015/85. 3. EFFECTIVE DATE This By-law shall take effect from the day of passing hereof subject to the approval of the Ontario Municipal Board, if required.
